Jodi Arias’ prosecutor Juan Martinez has been disbarred
PHOENIX (3TV/CBS5) — The lawyer best known for prosecuting in the Jodi Arias trial has been disbarred. Juan Martinez was fired from the Maricopa County Attorney’s Office earlier this year amid a number of misconduct allegations.
Martinez was accused of leaking a juror’s name in the Arias case to a blogger with whom he was in a sexual relationship, and then lying to investigators about it. Martinez is also accused of staring at a court reporter during the Arias trial and making comments about her appearance that made her feel uncomfortable.
“In my opinion this is long overdue. His misconduct goes back years,” said Karen Clark, Arias’ legal ethics attorney.
A law firm also filed an ethics complaint, claiming Martinez wrote a book about the Arias case while the trial was still going on. They also say he wrote the book on County time and at taxpayers’ expense. Martinez was reprimanded by the county prosecutor’s office in 2018 for inappropriate and unprofessional conduct toward female law clerks.
“The Jody Arias case was a very high profile trial and the allegations in these bar charges involved things that were going on behind the scenes that the public did not know about,” said Clark.
“Wouldn’t be surprised to see claims filed by people in prison saying their cases were barred by his misconduct,” said lawyer Dan Barr.
The State Bar of Arizona released the following statement:
“The Presiding Disciplinary Judge of the Arizona Supreme Court has issued an order accepting a consent to disbarment for Juan Martinez.
Martinez filed a consent to disbarment in the pending discipline case of In re: Juan Martinez, PDJ 2019-9008. The Presiding Disciplinary Judge accepted his consent and issued an order disbarring him, effective immediately. This judgment of disbarment effectively ends the pending discipline case against him.
Juan Martinez filed the consent to disbarment pursuant to Rule 57, Ariz. R. Sup. Ct., which allows him to consent to disbarment without making any admission of misconduct; rather he confirms that he no longer wants to defend against the charges.
The State Bar believes this is a just outcome and appreciates the time and effort of both the State Bar lawyers and staff who litigated this case, particularly Senior Bar Counsel Craig Henley and Staff Bar Counsel Stacy Shuman, as well as the witnesses involved in the underlying charge.”

Recently learned about this case. I believe Jodi is innocent and it is staggering how men (I am one) can abuse women and push them to the brink, be a pedo and a pervert but SHE is the bad person here? It is too bad that Jodi can’t just hire Karen Clark as her attorney period and let her fight for a retrial. I’m an extreme mountain biker myself (Freeride+Downhill) and can relate.
The problem with dirt bikers is though, despite their often borderline tricks/jumps in dirt parks, they usually don’t wear any protection except for an even very weak/lightweight helmet and gloves, as opposed to especially downhill bikers who wear all kinds of stuff, like several body armor parts/back protection, Fullface/integral helmet, neck break protection and whatnot.

I was going to ask the same thing myself. Does anybody have any idea about how much time Jodi has on the state’s dime? I am asking because she obviously has civil attorney costs related to Karen Clark’s work.
My understanding is that the state pays for the post-conviction relief petition (PCR) but after that nothing, and in no case anything to Adams and Clark.

That was the main point of my question that I had brought up around last year. If anybody has any idea about how long the PCR goes regarding filing deadlines etc. I remember somebody saying about five years after her transfer to prison which was June. The costs have increased substantially due to all of the civil work regarding Martinez which her criminal fund can’t pay if I remember correctly?
There is no information available on when the PCR begins or how long it will last.

And here’s something to know about the two former cellmates who are interviewed afterwards to provide us with more unsubstantiated dirt on Jodi:
– Both were supporters of Jodi until they discovered fame, and possibly some type of fortune, by turning on Jodi. Nothing occurred between either of them and Jodi to cause a riff. They just suddenly decided that the reason they thought Jodi was a kind and caring person was because Jodi had “manipulated” them into believing that. (No evidence needed just the need to believe.)
– Donavan Bering spent her prison time for arson, being one of three who, in 2008, set fire to a dental office in Sun City West – for insurance purposes.
– Tracy Brown spent her time for kidnapping, credit card theft, identity theft and drug paraphernalia violations. And during eight years of her incarceration she was cited and found guilty of 18 institutional infractions including theft and fraud.
And these are the people Lifetime wants us to believe wouldn’t possibly turn on someone for self-serving purposes.

Yes, I do know that Jodi is a kind and caring person. I also know that she is not a liar. I know that from personal experience. I could tell that when I spoke to her face to face back in 2014 when she was in jail in Buckeye. I’ll never forget looking her straight in the eyes and feeling the sincerity in everything she said. She didn’t know me. She had no obligation to be truthful with me, none whatsoever. But she was – about everything. I should like to know how Donavan and Tracy were “manipulated” by Jodi. I’d also like to know how she “ruined their lives.” They served time in prison but it was SHE who ruined their lives. (Sounds familiar, doesn’t it? Everything was Jodi’s fault.) Those are questions I would certainly like to have answers to. In my opinion these are just two people who decided it was much easier to leave Jodi behind and join the lunatics on the other side. You see, it’s hard work to fight for and support someone or something that you believe in. It’s tough to square off every day against nut bars who want nothing more than to hurt you or put you down or make you look bad and destroy your beliefs. It’s hard to have unwavering faith in someone and stand by them even when it seems that nearly the entire world is against you. Yeah, THAT’S hard. And it was obviously too hard for Donavan and Tracy so they took the easy way out. As friends, they failed. Miserably. The worst thing you can do is turn your back on a friend in need.

Now, I should like to know when Maricopa County and the State of Arizona are gonna grow some balls and investigate every damn case he ever prosecuted here. Reopen ALL of them. If for no other reason, it’s the right damn thing to do.
I have said several times that Maricopa likely knew about many of these incidents and decided to disregard them because criminal law is a bottom line profession… either Guilty or Not Guilty. I don’t think any of us can argue that some really bad people have come through MC who deserved prison like that woman.. Shauna Forde as well as any other male inmates. The fact that it took a high profile case like this for everyone to see what an asshole this guy was professionally and personally is very ironic in that if this case had just been “another murder case” in MC, No one, other than the courtroom itself, would have seen this behavior.

One clarification. I believe the state pays all Jodi’s appeal costs up through the Arizonna Supreme Court (If it decides to hear her case).
I believe Post Conviction Relief (PCR) is just a slang term for all filings in the appeal of a conviction and/or a sentence (e.g. Motions to Overturn or for New Trial, Motions for Reconsideration of Sentence, etc …).
Donavan Bering and Jodi were never cell mates as is sometimes claimed.

No, PCR is not a slang term. It’s how the next stage of appeal, the last Arizona state appeal, is called.
However, still no update/reply from the Arizona Supreme Court regarding the petition for review of the current appeal decision Jodi’s lawyers have filed.
The reply was delayed for a month to 07/27 but now we have September of course and still no new entry/update in the appeal. PDF file, and nobody including Jodi talks about it.
I mean that is an important/crucial decision. Does anybody know what’s going on there?

I believe JM’s disbarment is permanent which is why he is appealing. He may know he is done in Arizona and just wants to drag this out as payback. The next question would be… does any other state even think about interviewing him for another ADA position considering what he has now been shown to be in AZ?

I think he pled out (no contest, no admission of guilt) similar to Nurmi. I don’t think he’s going to continue his appeal.

Thanks for the clarification. I would like to believe that this ruling and the publicity that it has received would prevent him from practicing law anywhere in the US. JM and Nurmi can go form their own POS law firm somewhere. I brought up the question of whether anybody had any idea about how long Jodi may have remaining on her state paid appeals before the clock runs out and that bill comes to her. I understand that these civil bills have drained a decent amount out of her savings as her attorneys aren’t working pro bono.
I am also concerned about how Jodi’s team can bring some new evidence or information to the court to get a new trial. If you have read my previous comments, I was harping on her two hard drives which had stamped pictures of her at the monastery on the Oregon border at the time of her GP’s home burglary. I had felt that destroying the premeditation angle of the prosecution and showing that the weapons were Travis’ and weren’t brought. I was also asking about how JAII can draw a line from TA’s previous unreported assaults of Jodi to the June 4th fight. I have been amazed that Jodi seemed to be the ONLY person who saw this side of him. Unfortunately, the judicial system prefers documentation and eyewitnesses which Jodi hasn’t had. Thoughts?

I’ve had mixed emotions about the Martinez disbarment effort and did not contribute to the GoFundMe. You might remember the Appellate Court not wanting to punish Martinez by overturning the verdict or reducing the sentence. Now that she has got her “pound of flesh”, it may feel vindicated in not granting her any post conviction relief (PCR).
Btw, anyone know how the suit against Nurmi is going? How much is that estimated to cost? Yes, that’s a rhetorical question. I can’t wait for those bills – lol.

I too advised against the Martinez disbarment effort, on the grounds that it was very unlikely to succeed and funds were limited. But I was wrong. Good thing Jodi and A & C didn’t take my advice.
As to the Nurmi lawsuit, a judge put it on hold some time back until Jodi’s criminal appeals are over. There was some talk of holding depositions now, but I don’t know if that ever happened. In any case, A & C took this case (as is typical) on a contingent-fee basis, for a percentage of damages recovered, so it won’t cost Jodi or her supporters anything. The main remaining need is for more money for the future, privately funded appeals of her conviction.
I just mailed Jodi $2500 for the remainder of her Adams & Clark legal fees. But there may be more in the future because Jodi said there are two other separate bar complaints on Martinez which may require pursuing in the future.
Anyone know the court and case number for Jodi’s suit against Nurmi?

Hope you are staying safe in Germany! The Supreme Court does this a lot, especially in criminal/murder cases. They do seem to follow the lower courts a lot. I think you are absolutely right in your “predictable” statement. I am assuming Jodi is very disappointed but maybe not surprised?
As you may already know, AZ went Blue this week mainly because of Maricopa County and Phoenix.
Since there still seems to be some confusion about the next steps in Jodi’s case, here’s a recap. The next phase is the post-conviction-relief (PCR) petition, which goes back to Sherry Stephens in Superior Court. This is the opportunity, among other things, to present new evidence or allege ineffective assistance of counsel or judicial misconduct. It may take several years. After that the decision can be appealed to the Court of Appeals or the AZ Supreme Court.
If all state remedies fail, then Jodi must hire a private appeals lawyer to take her case into federal court. This begins with a habeas-corpus petition to the federal district judge. If that judge does not grant relief, the case is appealed to the Ninth Circuit federal court of appeals. Only after all that could it end up with the US Supreme Court.
This information comes from two knowledgeable AZ sources, so I think you can rely on it.

Due to the Covid situation here I’d rather want to be in Germany though. It’s not remotely as fucked up here YET like in Trumpland but the morons and self – declared “rebels” here are working hard on it…
Also full-lockdown here for I think 2 weeks already and in Germany only semi-lockdown since Monday, but I can’t leave atm, however, Mediterranean Sea and Côté d’Azur make up a bit for all this shit if you violate the lockdown a bit, but I consider kitesurfing no risk for me or anyone, but the cops still make you leave the beach if they patrol it. I hope you are well too dude.
We can only hope that Arizona effectively, not only election-wise, turns more liberal, less reactionary and corrupt/depraved and more decent, in general but of course especially for Jodi.
I always said that the sad state of affairs in Arizona is a big part of why Jodi was charged and convicted the way she was in the first place.
It’s fucked up now though since the 1st appeal is indeed over and done, and that even with 3+ months unexplained delay because their reply was already due 07/27. And they did nothing, like looking really into thé case, they just dismissed the petition for review. That leaves the question why these assholes needed 3+ months extra and 6+ months total to do literally nothing.
It’s also important to note that Bill Montgomery, Martinez’ corrupt to the core ex boss, is meanwhile on that very Arizona Supreme Court which rendered this “decision” for J.
It seems, unfortunately, that J gets dealt very bad cards all the time.
I have serious doubts she has good odds in Arizona at all, including the next/last state appeal stage PCR appeal, but maybe if somethijg seriously changes in Maricopa County. after this election. Let me be wrong, something I usually never wish for hehe.

Sounds like France is better than Germany now. I have an aunt from Karlsroo who says that Merkel is thinking about locking down again like the UK. Time will tell I guess. Other than being unemployed for over 3.5 years due to COVID and flat out resume discrimination, I am OK here in the East. my state is doing fairly well even though cases have gone up.. the question is what part of the state.
According to Alan, it does seems that the PCR still has a way to go which is good for Jodi. I would love to send some money but the problem is… I need a job to do that!!!!!!

It seems Michael Kiefer is spreading nonsense that J’s appeal was the last AZ/state appeal, he’s usually better informed.
PCR, the next stage that can sadly need years, is still state level though and mostly paid for, after that one it switches to federal level and self pay so to say (after habeas corpus but I don’t think that has any bearing/chance to succeed for J) to the 7th circuit Court or something, and then eventually to the federal Supreme Court of course.
This all needs way too long and that’s not fair to J or any other inmate.

France and Germany, along with UK and Italy are getting a lot of attention here in the US because of their move toward partial lockdown although the US stock market doesn’t seem to care. It really does seem that pandemic fatique has set in across the country, especially among young people who have been doing the math about the lower death rate among healthy people. Pro and college games are getting delayed or canceled due to outbreaks on the teams.

The job issue will be a problem for a while as I have been out for several years due to a collapse in my legal industry field and COVID causing widespread job losses as the unemployment claims number remains very high (725000 plus) this week in the US.
I am surprised that Kiefer would not know that info as well read and informed that we know he is. I will be the first to admit that I do not know criminal appeals law, even in my own state. I do know that clock is still ticking and Jodi and JAII need to come up with a plan to create reasonable doubt that would convince an appeals court that Jodi was telling the truth.

I think and said it back then already after the oral argument last October that J’s appeal lawyers totally fucked up during that hearing. I’m not sure what was brought up in writing though.
They just relied on their (justified) misconduct line of arguments but totally missed to challenge the state side’s empty and any substance lacking claim of “overwhelming evidence” which they just let float through the court room that day, totally unchallenged, and so the state was never asked/in trouble to fill that empty line with substance.
That was a BIG mistake from J’s lawyets.
The court then came back with “Yes, misconduct, but irrelevant because of “overwhelming evidence of guilt” which they filled with exactly 4 points that were not at all overwhelming evidence but just very weak circumstancial evidence in one instance (burglary/gun theft), and no evidence at all in the 3 other instances (rental car, gas cans, phone off temporarily but switched on again IN Arizona), the latter which have all 3 totally harmless every day explanations and are not in any way eligble to justify a 1st degree murder conviction.
Yet, they had the audacity to label all 4 “overwhelming”.
None of this qualifiés for that label though. Overwhelming would be evidence like video footage of the killing, having the actual gun that was used (and afaik, personally from a witness who also provided an affidavit about that fact, which Martínez managed to bury for whatever reason, that the pedophile scumbag actually possessed such a 0.25 gun himself, the close to pedobear witness had it in his own hands and even overhauled it because it was a cheap model with a weird/insecure securing mechanism) and similar stuff.
There is no overwhelming evidence for 1st degree murder in that whole fucking case, just for J being the one who killed him eventually, however it came to that point.
It’s impudent by this corrupt appeal court to use this empty label and justify the denial of the appeal on that whole lot of nothing. Outrageous imho…
Regarding Covid in Perryville, and I think all of Arizona prisons, they don’t allow any visitors since March or April, including legal advisors, literally no visitors at all. I know from J that they got some self-made masks from an inmate production site which broke on day 1 for her lol, they got tested, no idea if repeatedly, etc.

If you’re referring to the recent TV interview, it was the host, not Kiefer, who was wrong about “the end of the line.” Kiefer corrected him on it and said it was more like the beginning. If I recall correctly, he has said publicly that he expects Jodi’s conviction to be overturned in the 9th Circuit.

Frank, I can tell you, in my state out here, the governor has just tightened mask wearing restrictions to bars/restaurants and moved up closing times and to younger children in essential stores etc.
AZ has been a hotspot for a while now like the entire Midwest as you have heard on the news mainly due to many Republican areas defying masks and Trump rallies without masks etc. AZ had no choice on that issue very likely.
Regarding Jodi’s appeals, I have been trying to figure out which aspect would be the EASIEST to attack and counter which would then lead to a domino effect and would give her the best chance. I would assume that even if her memory returned as vivid as yesterday, the judicial system needs corroboration which she has been unable to give, i.e. Travis’s violent outbursts in private, the beatings in private along with all of the mundane events that are easily explained away.

While the interviewer was even more wrong than Kiefer in implying “That’s it in general”, Kiefer was wrong about saying “That’s it in Arizona” while in fact PCR appeal stage, the next one, is still state level.

Is there any general idea about how much appeal time Jodi has left before the state drops it in her lap?
There are some new things that come from the second trial, that did not come up during the first trial. First, the gun that was stolen from Arias’s grandparents’ home was filled with Jacket Hollow point bullets, but the one found at the crime scene was a, round point bullet. That would mean the gun used to kill Travis was not Arias’s grandfather’s gun. Also, if you look at all the receipts Jodi kept during her trip in June 2008, she was completely out of gas when she came to Pasadena California. This would mean that she would have to stop for gas in Arizona. Finally, the 3rd gas can was returned because during the 2nd trial Amanda Webb did testify that the store Arias went to purchase the gas can, switched stores in 2010. She was not sure if all records were completely transferred. All the evidence could disprove the State of Arizona’s theory of premeditation.

The gun issue has been so screwed up for years because of several factors. First, the gun that Jodi used was Travis’ gun that his friend Chris had given him some time before as a gift and/or home protection. Jodi knew where this gun was kept due to the cleaning arrangement the two had when she moved to Mesa. Another problem was that Jodi, in her immediate panic, took the gun with her and likely spread it all over the grand canyon. Imagine if she had taken the camera too although the law doesn’t like either one of those scenarios as you know. Anyway, Jodi’s statement that she was up on the Oregon border with her sister taking pictures at a Buddhist monastery at the time of the robbery AS WELL AS the fact that the Yreka police NEVER CONSIDERED her as a suspect in that robbery in the first place for that reason does not sway the other side at all. Jodi made a lot of mistakes and bad judgments in the initial aftermath that make her look bad. The biggest issue is… short of any closed circuit or surveillance video footage or any ear or eye witnesses to the event itself, how does Jodi’s legal team present “evidence” of her statements?
Just a general info for all, Jpay, the company that runs the website/smartphone app/means to send J email, Snapchat like messages, videos, general and media funds, etc. is undergoing some (STUPID!) changes.
They move ONLY the email/messaging funcionality entirely to their parent company Securus while leaving everything else with Jpay, also supported by a website and a separate/additional Securus smartphone app (imho the dumbest thing imaginable if they don’t plan to move the rest of the features to Securus as well anytime soon).
You usually get a notification email about these changes but obviously not everyone gets that, hence my info here.
And you SERIOUSLY can’t create a Securus account yet if you live outside the US or Canada (they must have forgotten that entirely in their incompetence because they still disable the Jpay messaging functionality for none US/Canada citizens asking you to create a Securus account (which you can’t with no US/Canada mail address) and link your Jpay account (in order for the email history to be imported).
So for me and all other outside those 2 countries that currently means email option is gone until they fix that, if they do that at all and it isn’t intended, but it should work for US/Canada peeps.

Found this on AZ website.. It seems that the ethics charges against Bill Montgomery regarding cover-up misconduct in Jodi’s case have been dismissed. Whether anyone is actually surprised is another story?? I would imagine these charges were very hard to prove as well as the fact that the guy is now a sitting judge in AZ.
