With regards to yesterday’s Motion for Protective Order hearing, the judge granted the request to HLN/ABC, but only to include details of hours billed, dollars paid & rates paid. No detailed billing information will be provided. Click here to see the ruling (PDF).

Following on from yesterday’s non-event – for reasons we’re still not aware of – it’s Groundhog Day as we prepare again for day 38 of the trial. It’s also currently scheduled to be a short day, running from 9.30 am to 12.30 pm.

After today, and taking the Easter break into account, the trial will resume again on Tuesday April 2nd @ 10am.

A Message from Dr Richard Samuels

Having recently exchanged emails with Dr Samuels and thanked his for his valued testimony, I also invited him to write a message for inclusion in the website.

Here’s the message he kindly sent me:

“Thanks to all of those who have expressed support for my testimony.  While I can’t comment specifically on the case until it is over, rest assured that the PTSD diagnosis is real as is memory loss during acute stress.  Those were the points I tried to make and hope that the message was clear enough for the jury to understand. Again, thanks for your support.” — Richard M. Samuels, Ph.D.

As Dr Samuels rightly stated to Martinez last week – “You have no knowledge in this area” – because you can’t study something for 35 minutes and know more about it than someone who’s studied it for 35 years.

Ain’t that the truth…

Moving on…

So now we have the media referring to Dr Richard Samuels as “the amnesia quack” and Alyce LaViolette as “the lesbian social worker”. But the fact is, had this Dream Team of accomplished & distinguished experts been testifying for the prosecution, there’s no doubt that the very same media would be singing their praises from the rooftops 24/7. That’s the difference.

It’s not only Martinez that’s doing every abuse victim a grave disservice with his questioning the very existence of PTSD & DV, but the media are following suit. What a bunch of ignorant clueless bastards they really are.

Here are a few comments posted yesterday which sum everything up:

(gibby gibson) — “…Alyce LaViolette is absolutely NAILING the type of abuse Jodi endured!!!! It has been such a tremendous concern–this whole minimizing of the “abuse” that Jodi suffered. LaViolette is completely clarifying that non-extreme abuse is just as real as the obvious type. Take that and shove it, HLN. I’m sorry, but those people who have been criticizing Jodi for making a mockery of “real abuse” are a bunch of Aholes!”

(MB) — “The Travis Taliban and HLN have joined forces to roll back the progress on women’s rights and awareness of abuse and rape. They present themselves as a legitimate news outlet with a progressive agenda, but at the end of the day they are nowhere to be found when it comes to women and girls.

Besides, who are THEY to decide what “real” abuse is? Ms Violette has more experience and understanding in her little pinkie than they do collectively.”

Jodi Arias Trial – Day 37

Following on from his sexual innuendo, his desk banging antics and his little pen throwing incident, did anyone else catch Martinez telling Jennifer Willmott to piss off during his follow-up of Dr Richard Samuels late yesterday afternoon?

After another one of his trademark meltdowns, and after Jennifer objected to his yelling and his BS, he distinctly says “I’m gonna object to this speaking objection, she can piss…..” – but he never got around to adding “off” to the end of his sentence, and seemed to stop himself just in time. Aside all those theatrics, yesterday was yet another awesome day for the defense, with Dr Richard Samuels more than holding his own, despite Martinez’ repeated attempts to undermine his 35 years of experience and his claims that all psychological problems are BS because, unlike his favorite “crater”, they can’t be seen – right?

Taking into account that the next witness for the defense – Alyce LaViolette – has actually taught prosecutors how to cross examine witnesses, it’s gonna be more than interesting to see what happens when he tries to pull the same shit on her. Jodi Arias Trial – Day 36

Following on from the little guy’s recent wayward references from Websters dictionary and The Book of Mormon, I thought I’d take the opportunity to look up the meaning of “Prosecutorial Misconduct” in my handy US Legal dictionary.

Here’s what it says:

Prosecutorial misconduct is conduct which violates court rules or ethical standards of law practice. Examples, among others, may include:

*** Courtroom misconduct (making improper remarks or improperly introducing evidence designed to prejudice the jury: violating rules regarding selection of the jury; or making improper closing arguments);

*** Hiding, destroying or tampering with evidence, case files or court records;

*** Failing to disclose evidence that might tend to exonerate the defendant

*** Threatening, badgering or tampering with witnesses.

So how many of the above violations have we witnessed so far throughout Martinez’ dismal performances? I’d say all of them. The only exception being “making improper closing arguments” – mainly due to the fact that we’ve not yet reached that stage… but no doubt he will.

Ashley Reed (Thompson) – the autopsy report

According to the Flores Police Report, Ashley Reed (Thompson) called in an anonymous tip claiming her husband Dustin Thompson should be investigated with regards to TA’s death.

Here’s an excerpt from page 12 of the Flores Police Report:

On 6-11-08, I received a tip through the Apache Junction Police Department. They had received an anonymous phone call from a female who stated we needed to look at a person named Dustin Thompson as someone who might have something to do with or might have information regarding the death of Travis Alexander. The message was short, but they were able to trace the phone number. Utilizing the phone number provided by A.J.P.D. we were able to get the subscriber information on that number, which returned to a cellular phone owned by Dustin Thompson.

A records check revealed that Dustin Thompson was married to a female named Ashley Thompson who worked at Dillard’s distribution center located in Gilbert, AZ. On 6-12-08 at 1530 hours, Detective D. Kaufman #11674 and I met with Ashley at her work for a brief interview. Ashley had a cellular phone with her during the interview. We asked for her cell phone number and confirmed it was the same number that had called in the tip to A.J.P.D. We did not confront her about the phone tip, because we were still in the process of gathering intelligence on her husband, Dustin.

Ashley confirmed she and Travis were close friends and mentioned they had known each other for about three years. She said her husband also knew Travis. During the interview, she kept referring to her husband, Dustin, as her ex-husband. She explained that they were currently in the process of a divorce and is currently living separately from him. She said they were having financial issues and it was causing stress in their marriage.

Ashley gave us basic information regarding her relationship with Travis saying they were just friends and nothing else. The last time she actually saw him or talked with him was at his last UFC (Ultimate Fighting Champion) party about three weeks ago. She said Travis would have UFC parties about every Wednesday where they would watch the fights. She said she tried to call him on Monday the 9th of June, but she didn’t get an answer. She stated that she first heard about Travis’ death the day after he was founds. She heard from another mutual friend named Deanna. Ashley said her husband, Dustin found out about Travis that first night. When she talked to Dustin, he told her he found out that first night and went over to see what was going on. Ashley gave us information about her husband, Dustin, including his work address and work schedule. She never mentioned during the entire interview that she was the one who called in with the anonymous phone tip. We finished the interview and asked if we could contact her again if we had any additional questions. She said that was fine.

Here’s an additional excerpt from page 17 of the Flores Police Report:

After his interview with Ashley Thompson, Detective Kaufman briefed me on his findings. He said Ashley did confirm that she was the one who called A.J.P.D. and left the anonymous information about her husband. She explained that she and her husband were having a lot of difficulties and he was just acting strange during that time. She and Travis were very close and she had even asked Travis about moving in with him as a roommate after her separation from her husband, Dustin. Both she and Travis agreed it was not a good idea she move in, because of the way it might look. They were just good friends and they didn’t want people to think something inappropriate was going on. After Travis was found she thought how strange Dustin had been acting. It was during the few weeks leading up to Travis’ death that she had moved out to her own apartment and they were both dealing with the possible foreclosure of their house.

Dustin Thompson was not interviewed that day, because of time constraints. He did agree to come in on another day for an interview if needed.

Ashley Reed committed suicide on March 3rd 2010.

It was ruled a suicide (from a single gunshot wound to the head) according to Dr Robert Lyon, Maricopa Medical Examiner.

Here’s an excerpt from the ABC15 report:

“ABC15 Investigators asked the Maricopa County Office of the Medical Examiner to respond to our questions about the case and explain why Dr. Robert Lyon would not meet with the family, the county spokesperson denied our request.

An internal email obtained by the ABC15 Investigators shows Dr. Lyon reacted to our request for information by sending an email to another staff member containing the following message, “WTF.”

Lyon did not make an official ruling in the case after more than 400 days had passed since Drenth’s death.”

Martinez: losing the jury, the plot and the trial…

Yesterday afternoon, we were treated yet again to another piss poor showboating display of prosecutorial cluelessness by Martinez. In full knowledge that he lost this case a long while ago… and not withstanding his antics with the camera, the autopsy picture stunt and his deliberate withholding of evidence from the defense… his revised strategy now appears to be based around a Wayne Dyer self-help book and the meaning of the word “compassion” (as defined by Websters dictionary).

He also proceeded (again) to question Dr Richard Samuels’ memory problems and his ethics. I think the only person in this scenario with memory issues & ethical problems is Martinez himself… right?

But in the midst of all this, whatever happened to Martinez trying to prove his BS-riddled & overcharged pre meditated murder & felony murder charges in this trial?

For Martinez, that has now become a major issue.

And it’s an issue because it AIN’T GONNA HAPPEN.

He’s lost the jury… he’s lost the plot… and he’s lost the trial. Plain & simple.

Here’s a quote from Vladimir Gagic’s excellent post last week:

“As far as I am concerned, the only issue in the Jodi Arias trial is has the government proven premeditation. That of course, is important because if the government has not proven premeditation, they cannot convict her of murder in the first degree and thus the death penalty is off the table. And while the government has also alleged murder in the first degree by way of felony-murder, that allegation is so specious as not to even warrant a response.

The government has not proven premeditation, and in fact, could not do so under any circumstances. Without direct evidence, either a confession by Ms. Arias that she intended to kill Mr. Alexander, as in “I wanted to kill to him”, or an overt act such as hiring a hit man or waiting in wait in ambush, the government cannot prove premeditation beyond a reasonable doubt. Note that I am not saying she did not intend to kill him or that there is not very good reason to suspect that she intended to kill him, just that the government will not be able to prove it beyond a reasonable doubt. And that has been clear since day one. Someone asked me on twitter a question along the lines of “she lied so she doesn’t get the death penalty?”. My answer, yes, exactly right. To paraphrase Lt. Kaffee from a “Few Good Men”, it doesn’t matter what we know; it only matters what we can prove.

Instead of proving premeditation with direct evidence, the government is trying to do so with circumstantial evidence. So far the attempt has been, with the most charitable interpretation possible, pathetic. While the law does not recognize a distinction between direct and circumstantial evidence, there is a jury instruction that says exactly that, the inference the government wishes the jury to draw from the circumstantial evidence is, dare I say, comically lacking.”

So Forget all the state’s smokescreen BS about gas cans, Walmart receipts & hair dye. What matters is THE EVIDENCE. Some of the more important evidence we have to date are TA’s rape specific text messages – and his 12 year old girl bondage & orgasm fantasies… we’ve seen and heard those already.

As Jose Baez said on last week’s HLN “bathroom re-enactment” show…

“The physical evidence does not lie”

And by the way… Jose Baez turned George Anthony inside out on the stand countless times, without ever resorting to bellowing or doing the Harlem Shake.

As for the Travis-Towners & TA fans out there, all they’re really concerned about is hating, retribution & vengeance. “Justice” doesn’t come into it. It never has. That’s not what they’re after.

Take yesterday for example… where 2 trial observers were thrown out of the courtroom after stating multiple times that they wished “Jodi were dead.”. Apparently one of Jodi’s family members complained and security removed the two women.

But at the end of the day… and just a few weeks from now after the “Jodi Arias Reality TV Show” is over, and the relevant dust has finally settled on this trial and the specially built studio sets, mock courtrooms, faux jurors & cardboard bathroom reconstructions… it’ll be largely remembered as the trial Martinez lost. It happens sometimes when you overcharge a case without any conclusive evidence.

Just ask Jeff Ashton… he knows that only too well.

Like I’ve said before…

Armed with very little aside assumption, speculation, hearsay & hot air, it’s ultimately gonna come down to Jodi’s word against Martinez’. And despite the valiant repeated efforts of Martinez to turn this into an ego-driven pissing match — there’s just no way all 12 jurors are gonna be convinced beyond and to the exclusion of all reasonable doubt. He knows that already. He’s known it for a long while. So have we. So has everyone else. Give it up FFS.

So let’s not stress too much over the verdict. Why? Because it’s already been decided. It’s just gonna be a little while longer before it’s “officially” announced.

And if you’re still getting worked up & stressed out every day over NG and her ongoing BS coverage, I have a simple solution for you. Stop watching her. Simple as that. Just shut it out, remove yourself from all negativity completely and quit wasting your energy… whether it’s NG, JVM, VP, some other website, some haters’ comments or anything else. The same applies. Rise above it all.

Stay positive and keep the faith, as always.

Remember… We are Team Jodi – and WE WILL BE VICTORIOUS.
