Jodi Arias Retrial, Day #46 – Closing Arguments (2/24)

Welcome to Day #46… as we finally get to the closing arguments & jury instructions bit of the retrial. Looks like Pickles was right all along with her earlier “25th-26th” finish date… but  it’s about the only thing she has got right since January 2013.

Anyways… let’s not get too carried away today. Closings & stuff will likely take up a day or so… then we’ll have to wait a short space of time for the ever decreasing hung jury to come back with their split decision. After that, Pickles then has to trot back to her chambers – light a few candles – and toss a coin to see what “verdict” to come up with to try and keep everyone happy — and she might even do that by the end of this week like she planned.

But here’s the thing folks… and here’s what we need to remember above all else:

The verdict… whenever & however it arrives… is basically a decision on who’s gonna end up paying for Jodi’s appeals, so Jodi can finally get justice – and this whole BS fiasco can be straightened out once and for all.

So in the big scheme of things, the verdict is not so ground-breakingly critical. It can get a bit complicated, but either the overly generous AZ taxpayers are gonna have to foot the bill for the appeals… or Jodi may have to pay for some or all of the appeals herself, including the hiring of a competent appellate lawyer. This is why we’ve been preparing for that and including reference & links to the JAA Appellate Fund site in every post, for when it’s needed.

Overall though – all we do know for certain right now is that this trial will go down as the longest, biggest & most comprehensive judicial fuck-up in AZ’s history. So hopefully lessons will be learned to save any repetition in the future. In fact several trials have already cited this trial in an attempt to avoid a repeat.

So with all that said & done… today’s kick-off is currently scheduled for 9.30 am MST.

  2. Good morning, SJ. I have been following every day but not commenting much due to lack of time. My thoughts are always with Jodi and everyone here. I pray she gets life rather than DP though, as despite the appeals process I feel DP is just too risky an outcome.

I don’t understand how the judicial system of my own country can stoop SO low…I am ashamed and embarrassed by it.

  5. I was happy to blog on this site and meet such interesting and intelligent people. Many of you have incite that is amazing. I do wish Jodi and her family the best. If this retrial does not come out the way we would like, I can see some hope in the appeals.

    After hearing that Jodi is on meds, I have some questions. There had to be a psychiatrist that wrote the script. Who is he or she and why wasn’t this person called to testify? I agree BB that this case is incomplete.If I were on the jury, I would want a complete picture. We did not get it from either side.

    Prisons are full of people with serious mental issues because in this country mental health has not become a priority.Jodi Arias is in many ways a victim of the system that now wants to kill her.

    • Exactly. Killing a mentally ill person is even more horrific than killing by DP a mentally healthy person. The whole thing is just so sick and wrong.

  8. I still do not understand what happened yesterday. I thought the defense still had three witnesses…. all of a sudden two jurors are being thrown out and the defense is resting????

      • I already read it thank you Cindy and I still do not understand what happened. How did they go from three witnesses to none and defense rests?

          • In my point of view if they had proven their case then the death penalty should be immediately off the table and a sentence reduction should be in place.

            • The only Something BIg I think may have happened is that the PA’s office wants to rush this through because Martinez starts a new trial tomorrow… They want him to be able to take the time to have his closing arguments, I doubt anything has been taken off the table and will be pleasantly surprised if it has been.

              • I figure it will be a hung jury also, but then it makes no sense to have quashed the last three rebuttal witnesses.

                • Dr. Geff’s testimony doesn’t need anyone to bolster it. It stands on it’s own, and perhaps the tech guys were a maybe all the time dependant on circumstances. The expert testimony from them all was that porn did exist on TA’s computer, one site being called “Child Villa”.

                • Two affidavits were submitted. That might account for two of the three witnesses. Fonseca would only have backed up what Geffner already said. Pseudonym would have been strictly limited to arguing JM’s very weak at nonsensical rebuttal – could NOT have introduced anything NEW about porn evidence or child porn. And why end Jodi’s case for mitigation by beating up on Deanna or Abe?

                  I can’t think of anyone they could have called that would have further strengthened their case.

          “Earlier in the retrial, the judge denied a bid by Arias’ lawyers to stop prosecutors from seeking the death penalty on several grounds.

          They alleged authorities examining Alexander’s laptop destroyed thousands of files — including files from pornographic websites — that would have been beneficial in defending Arias. They said the computer files could have helped them argue that Alexander had treated their client in a sexually humiliating manner.

          Arias’ lawyers also asked the judge to dismiss the death penalty because three witnesses on her behalf have refused to testify in open court for fear they will be harassed.

  13. I wonder if Nurmi or JW will do closing arguements. I hope it is JW. My reason for this is that I can STILL recall the part of Nurmi’s closing from the first part of this trial. The part that he mentions his personal opinion of Jodi. Was that intentional? It still angers me. I hope it is JW today. She is concise and articulate. She has a gentle confidence that Jodi needs to convey to the jury what she felt unable to convey herself. This is only my opinion and my desire.

    • Dorothy, KN will do closing because he is the lead attorney. I know many people did not like his remark. But if you go back a watch it you will see Jodi smiling. He was trying to make a point.

      I’m sure no such remarks will be made this time around…..

        • Dorothy, same here. He might had tried saying that ‘9 out of 10 days’ comment to try and be funny and prove to the jury that they shouldn’t decide based on their personal opinion about Jodi. BUT it was highly inappropriate! It back fired if you ask me.

    • I think it will be both Dorothy.. if I am not mistaken the defense goes first this time so either nurmi or wilmott will speak then martinez and then whichever lawyer didn’t speak the first time will finish up closing arguments.

            Although closing arguments at the guilt phase of capital trials are generally similar to closing arguments
            in other criminal trials, closing arguments at the penalty phase of capital trials are distinctive. After
            evidence has been presented at the penalty phase, the state and the defense present jury arguments.
            Defense counsel have the statutory right to present the last argument whether or not the defendant
            presents evidence at the sentencing hearing, but, in contrast to the rule at the guilt phase, they do not have the right to make the first argument as well.15 As with jury argument at the guilt phase, defense
            counsel may make as many addresses to the jury as they want and without any time limitations. The
            trial judge may limit to three the number of defense counsel who may make the last argument.

    • Well… I think it’s down to everyone seeing through all the media hype & BS about today, and instead seeing the verdict as basically a decision on who’s gonna pay for Jodi’s appeals. Either that, or everyone has fallen asleep :mrgreen:

I still haven’t got a good answer as to why the last 3 witnesses are not being called….it makes me very nervous bc as an attorney doing your due diligence for your client you want EVERYTHING out there on the record for the appeals….these 3 witnesses I believe would have been able to answer the prosecution’s BS, and with regard to the porn I believe would have added more damning evidence that TA was a pedophile……so if DT had JM backed into a corner and then just let him out I’m NOT happy but I don’t know that is the case…so at this point I just have to wait and see and hope that KN and JW have got Jodi’s back on this one……..attorneys have to juggle trials all the time so I don’t think it had anything to do with JM starting a new trial….KN and JW are not going to just give up the rest of their case so JM can start a new trial on time, no way……so I just don’t know…….

  19. Going by the tweets yesterday, which is like chewing on used gum, it was a hugely bad day for the prosecution. When have you seen all the usual pro-prosecution media plants uniformly pointing out that Jodi seemed unusually pleased?

    Why do you think they pointed out how pissed Martinez seemed to be and wanted a chance to address the jury to point out that they need to understand if they don’t come back with a death penalty verdict that she may be eligible for parole? Martinez certainly wouldn’t have been pissed because THESE three witnesses were not going to testify. That was his worst nightmare. The eye rollers certainly wouldn’t have been crying because they were overjoyed about something.

    I also would be stunned if Fonseca, Dworkin and Pseudonym were unwilling to return. They had all already been there at least twice and Fonseca acted like she almost enjoyed putting Martinez in his place. Pseudonym had not been publicly identified to my knowledge and he was diligently at work preparing the info that was secreted away in that hard drive.

    Plus Nurmi could have subpoenaed all three and even taken them as hostile witnesses if he wanted to and that would been monumental for the jury if the info that was devastating to the prosecution came out under those circumstances. It would have showed that their fear of testifying was the underlying reason why they had to be subpoenaed and it would have put a lot in perspective for the jury. They may have already suspected that was the reason that Jodi didn’t continue her testimony.

    I also cannot see Nurmi acquiescing to “rush” the trial along now after he was about to have witnesses that would have creamed Martinez just because Martinez didn’t find it convenient in his schedule to proceed. He would have or damn sure should have tell him tough tobangas–if you don’t want to give a closing when we’re ready, then don’t give it–your choice.

    The New York Times is just trying to climb back on the wagon now that the trial appears about to end as if they know something. I don’t think they know jack.

    Whatever went on in that battleaxes chambers yesterday had to be sufficient enough of a trade-off for Nurmi to rest and then plan to do the closing of his life. If that wasn’t the case, he should be brought up before the bar.

    We’ll see.

    • You know Jade I was wondering if maybe just maybe there was some message or something on Jodi’s phone that was found that would be a detriment to the prosecution. The reason I am wondering that is because a statement was put up by a person who stated she found the phone in her dad’s car and turned it over to Sandy who in turn gave it to the lawyers.

      • The expert Neumeister trusted to do all the detailed forensics and really expose the layers of porn he had already identified on the hard drive. He was another “Smith”–but the defense’s Smith.

        He’s the one that said the hard drive was accessed by someone at MPD at 11 pm the day Maria Schaeffer had been there.
