Last Sunday (4/7), the Defense filed yet another Motion for Mistrial.

(Inability To  Provide Effective Assistance of Counsel due to Prosecutorial Misconduct)

In addition to referencing “the circus like atmosphere inside the courtroom” and the likeness to the Salem Witch Trials… the Motion cites specific acts of  prosecutorial misconduct, including:

* Counsel for the State yelling at witnesses, attacking witnesses on a personal level and throwing evidence.

* The State releasing evidence to the media.

* Evidence tampering.

* Martinez showboating on the courthouse steps.

* The berating of defense witnesses via e-mail, telephone and in various internet forums.

The Motion also includes these direct statements:

…This State of affairs has placed counsel for Ms. Arias in a position that they cannot fulfill the duties they owe Ms. Arias, pursuant Arizona Rules of Criminal Procedure, Rule 6.8.

…In further efforts to prove his case in the court of public opinion rather than a court of law on April 4, 2013, the State unapologetically admitted that it had released a plethora of damming evidence that would not otherwise come into trial to the media.

…Counsel for Ms. Arias cannot meet the dictates of these guidelines when defense experts are being harassed inside the courtroom by the prosecutor and outside the courtroom by those who chose to mimic his  behavior in other public forums.

…Based on the facts and law cited above it is beyond legitimate dispute that the conduct of the Prosecutor has placed counsel for Ms. Arias in a position where she cannot present a complete defense and where she cannot receive effective assistance of counsel during the trial and any potential sentencing phases. Thus, the trial at issue does not comport with the dictates of the 5th, 6th and 14th Amendments to the United States Constitution and Art. 2, §§ 4, 15, 23, and 24 of the Arizona Constitution meaning that at this point in time that the only constitutional course is to declare a mistrial.

There’s not much more that can be said regarding the Snow White related circus from last Thursday… or the respective ages and/or living conditions of the 7 dwarfs… but you can always click here if you want to watch the highlights again.

Consensus of opinion regarding Martinez — in addition to him being a dickhead, and having lost the plot, lost the jury, and lost the trial a long time ago — is that he’ll not be continuing with his cartoon themed antics today. I wouldn’t be so sure though, because it’s never easy to forecast the activities of a total lunatic. No doubt we’ll find out soon enough.

Having said all that, there’s no getting around the fact that Alyce LaViolette is more than holding her own right now against the little guy, and that’s certain to continue throughout the remainder of her cross. She’s basically playing him like a fiddle… just like Jodi did a few weeks back.

Are we sitting comfortably?

Ok. Then I’ll begin

Soooooo… just when we thought we’d literally seen it all, this trial circus has managed to out-do itself once again.

Not content with enough prosecutorial misconduct to sink several ships… or Martinez’ grandstanding outside the courthouse, and his office releasing Jodi’s journals & videos to HLN… we’ve now had a day that literally started and ended with a fairy tale.

In between all of that, we also had reconfirmation (in text & email format) of what totally abusive & manipulating bastard TA really was. I’ll cover more on that later.

But getting back to today’s post…

Fairy tale #1 relates to Judge Pickles… where she assumes that none of the jurors have seen anything relating to the trial in the media, as highlighted again by Kirk Nurmi… yeah, right……. and fairy tale #2 relates to Martinez’ ongoing revelations relating to Snow White & the 7 dwarfs, during his piss-poor attempt at cross examining Alyce LaViolette.

The phrase “comedy farce” would be an understatement.

Here’s one of numerous highlights from the start of his cross, where Alyce calls him out on his recurring bad temper issues – and subsequently has everyone in the courtroom rolling with laughter. She served Martinez his ass on a plate, and you can be sure it’ll not be the last time she does that.

But seriously… is this really what it’s all come down to now? Snow White, the 7 dwarfs, how old the dwarfs were – and whether they lived in a shack or a cute cottage?

I posted earlier in the week that this cross would be interesting, and that Alyce is well accustomed to dealing with arrogant bad tempered little shits. How true that was. So what will we have next week? Juan and The Beanstalk? Jeez.

And let’s not forget… in the middle of this bullshit circus… this was yet another AWESOME WEEK for Jodi.

Over the past couple of weeks, Dr Richard Samuels and Alyce LaViolette really have done a truly outstanding job… not just for Jodi, but for every DV victim out there. And for that, we will be eternally grateful.

Remember peeps… WE ARE TEAM JODI – AND WE WILL BE VICTORIOUS!

Following yesterday’s events where the County Attorney’s office leaked interview videos & Jodi’s diary contents to the media, the trial day started with Kirk Nurmi requesting the jury be sequestered. As he rightly stated, to assume the jurors are not seeing or hearing anything relating to the trial is “absolute fiction” and a “fairy tale“.

The Nurminator also said he’d witnessed the media (who also provide pics to HLN) filming the arrival at the courthouse this morning of “jurors 1, 4, 6, 17 & 13”. As is typical in this trial, the request for juror sequestration was denied by Judge Pickles. She asks them if they saw or heard anything, and they say no. To that I say BS.

Following Alyce LaViolette being taken ill just prior to the noon recess, yesterday’s trial turned into a half day, and the afternoon session was cancelled. Let’s hope Alyce is raring to go again today and we can finish the week on another high note.

With all the BS currently flying around featuring Facebook posts & pages, Amazon reviews, website attacks, hating, lies, threats, harassment, prosecutorial dirty tricks, jury shenanigans – and diary pages & videos being slow-leaked to HLN… we’ve just gotta plough on regardless. These things are popping up regularly to try and throw us off course. Screw all that. We’re on a mission… and we’re gonna see it through to its victorious conclusion.

We are TEAM JODI… and… well… you know the rest by now…

Ok then… so we kind of already knew what a player, expert manipulator, sexual deviant and a total bastard TA was. It basically states the same in the 2011 Plea Bargain document.

But it’s good that the specific details are now coming out through Alyce LaViolette’s testimony. No wonder the state went out of their way to try and hide the 8,000+ emails & texts. So much for Dave Hall’s recent TV comments, where he states that Jodi was only dating TA for his “cars” and his “money”. That’s the car he sold due to being broke, and all the money he begged & borrowed from Sky Hughes & others, right?

The cross with Alyce should be interesting to say the least. She is well accustomed to dealing with arrogant bad tempered little shits, but nevertheless it’ll be interesting to see how long it takes JM before he asks her if she has “memory problems”, and subsequently if Alyce can resist bouncing the water jug off JM’s new wig. We shall see.

Thanks to everyone for their ongoing support of Jodi, and in helping get this site into the top 19,000 most visited sites in the US right now. It’s also great to see that we can have ongoing meaningful (and sometimes highly humorous) discussion during the trial, without resorting to hateful comments and stupid-ass death threats. That’s say a lot…. and it’s testament to what I’ve mentioned many times before. The grass on this side of the fence is definitely greener… while you can hardly see the grass on the Taliban side of the fence for BS.

Following the dismissal of juror #5 this morning, Alyce LaViolette is now back on the stand continuing her direct testimony. The various email exchanges detailing TA’s systematic abuse are finally get some serious airplay.

USA Today stated as follows:

Furthermore, according to the filing, the case agent, Mesa police Detective Esteban Flores, told the defense attorneys that there was nothing “out of the ordinary” among Alexander’s emails; about 8,000 were turned over to the defense in June 2010, including the Hughes emails.

The 2011 filing details the email contents, including “A response from Mr. Hughes … wherein he asserts that he believes Jodi would be his (Travis’) next victim and that Jodi was just another girl that he (Travis) was playing.” Alexander allegedly replied by saying “I am a bit of a sociopath.”

Other emails from Sky Hughes, the filing says, say that Alexander considered Arias to be a “booty call,” and said “How he, Mr. Alexander, was abusive to Jodi and … how he was beating her emotionally in part by making out with her without giving her a commitment.” And there is an email from another woman Alexander was seeing at the time “wherin she complains of Mr. Alexander’s conduct making her feel used and dirty.”

How much of those emails make it into testimony remains to be seen. Chris and Sky Hughes have already testified for the prosecution regarding an earlier allegation of misconduct by Martinez, but the topic of the emails was not discussed. They could be called back.
