Happy New Year peeps!!!

With 2014 now underway, I thought this would be a good time to re-watch the trial from last year. Defense attorney Jennifer Willmott began her opening statement by telling the jury Arias killed Alexander in self-defense. She described the couple’s relationship as psychologically abusive and controlling, stating Alexander kept Arias as his “dirty little secret,” Meanwhile, Willmott stated Alexander repeatedly degraded Arias by telling his friends that she was a stalker.

On the day of the murder, Willmott said Arias was subjected to rough vaginal sex. Willmott stated Arias killed Alexander while she was defending herself against her angry ex-boyfriend after she dropped his new camera. Willmott discussed two time stamped photos taken on the day of the murder. One photo points up at the bathroom ceiling light after apparently accidentally falling. The other, a bloody photo of Alexander. Willmott concluded by telling the jury that if Arias had not chosen to defend herself in the one minute that passed in between those photos being taken, she would not be here today.

As we look back at 2013, we all know first hand that Jodi’s trial has been a piss-poor excuse of a judicial circus throughout the year, and that still continues to this day. We also had two “high profile” trials (including Zimmerman’s) actually start and finish in-between one status hearing and the next a few months back.

Whether we’ll ever get a re-trial in 2014 or even an unbiased jury is another thing altogether. Come to think of it, we never managed to get an unbiased jury the first time around, did we? So how that could be achieved at the second time of asking is anyone’s guess.

As I documented back in May, we’ve still never seen any conclusive proof of pre-meditation. And despite Kermit’s shambolic showboating escapades and countless acts of blatant prosecutorial misconduct, the State never even came close to proving their case beyond and to the exclusion of all reasonable doubt. Nor will it ever. No amount of assumption or wishful thinking will ever change that fact.

The autopsy pics never proved pre-meditation either. All they prove is that the pedo-animal Jodi was defending herself against came off decidedly second best. Jodi – the potential VICTIM – turned the tables on her attacker. Self defense. Plain & simple.

So yes, let’s see how this BS unfolds next year… if and when the AZ State Circus ever manages to come back to town.

In the meantime, and from a purely personal perspective, DECIDE TODAY that you’re finally gonna achieve your dreams in 2014. Don’t just try to do something either, because trying means having the intention to fail. Decide you’re gonna do it instead.

Because sometimes, you just gotta put all your excuses to one side and go for it… whether you wanna be an astronaut, a brain surgeon, a professional golfer, a porn star, an author, an artist… or even if you wanna be something ridiculous like a State Prosecutor. Whatever it is you wanna do or whatever you wanna be — even if it’s something relatively mundane like losing weight or stopping smoking (or both) — decide you’re gonna do it and to hell with anyone that tries to stand in your way and stop you.

I could go on as usual, but I’ll leave it at that for now.

I hope you have an awesome New Years Eve, whether you’re in the US, Canada, the UK, Grease or even Australia… and I hope you have an equally awesome, peaceful & prosperous 2014.

Thanks again for all for your support throughout the year, and for your continued support in 2014 and beyond.

Strange that at times with our Criminal Justice system, we wonder on what side the real unrepentant criminal is.

On December 10, 2012, the circus/trial of Jodi Arias started in Maricopa County Superior Court.

I refer to Arias as Candy Crush because throughout her trial, a string of Mormon/PPL (Prepaid Legal now Legal Shield) men referred to her in the media as ‘having a stripper vibe’. And a stripper needs a good stage name before the show/trial can go on.

It was easy to come up with a name; she had become an addiction for the nation not unlike the Candy Crush game and candies like Tootsie Pops and Pop Rocks were an inherent part of the cheap mystique floating around her sex games.

As an attractive lady who was considered eye candy most of her life and used as such by Travis Alexander, the name could not have suited her any better. And let’s face it, not many people cared enough to find out who she truly was anyway. So Candy Crush was born and the game began!

Having worked in courtrooms for years as an Interpreter, I had to listen carefully to what was said in these sacred rooms and learn to be an instrument of communication without taking sides. I had to interpret the words of a defendant without trying to make him/her look better or worse. This is how I approached Arias’ trial.

From the very beginning of the trial, with Judge Sherry K. Stephens at the helm, prosecutor Martinez showed he was going to play hard ball. During jury selection, he was trying to ‘’systematically exclude’’ women and African-Americans. Knowing how some Arizona residents despise Mexicans, the fact that Arias was of Mexican descent probably convinced him to also eschew Mexican jurors.

And then entered Juan Martinez; the prosecutor who was accused of prosecutorial misconduct countless times and who was known to play fast and loose with the truth. When he walked into the courtroom, it felt like Apocalypse Now and Juan ‘loved the smell of death penalty in the morning.’ He came across as a sadist who did not give a damn about the truth.

I had never witnessed such a legal fiasco while working as a court Interpreter and the trials I had watched on TV, always had order in the court with a judge running a tight ship.

As a juror, I would have been flabbergasted by some of the whoppers I heard. Detective Flores, who had conducted the original interview with Arias and sat at the table like a dummy throughout the trial, had said countless times that Travis had been shot first and stabbed afterwards. But, as it did not fit Martinez’s strategy to introduce the cruelty factor in order to qualify for the death penalty, he did a switcheroo. Now Travis had been shot last by Jodi in a final sadistic ‘Sayonara’.

The problem is that medical examiner Dr. Kevin Horn had told Flores that Travis was shot first and it was written in his report that Travis’s brain’s Dura matter had not been perforated, meaning that the bullet had stayed in the sinus cavity. Which meant he was conscious and wrestling with Jodi.

Conveniently, the Judge, the prosecutor and the medical examiner changed the order of the crime so it would fit their scenario. When asked by the defense attorney about his report, Dr. Horn said it was a typo. I could not believe my ears.

In my opinion, the best defense witness was psychologist Dr. Robert Geffner. His experience and testimony were unsurpassed and he explained the defense argument with brilliance. The weakest prosecution witness was psychologist Dr. Janeen DeMarte who had no experience whatsoever in domestic violence and was too green for the type of assessment asked of her. But by all accounts, the jury went with her version and totally resisted anything the experienced experts had to say. It showed the prejudice that prevailed in this case…….

1st Anniversary & Happy Holidays!

Today marks the 1st anniversary of the launch of our website.

And while we’ve witnessed first-hand just how bent, corrupt and easily manipulated the whole judicial system really is, we continue to plough on regardless in our quest for Justice for Jodi.

Always have. Always will.

I was tempted to finish off this post with the obvious choice of Jodi singing “O Holy Night” (from last Christmas)… or even the “Survivor” video that went down so well from several months back… instead I decided instead to go with something more fitting instead, and with a video that sums everything up way more than any other — “We Can’t Stop.”

So with Christmas just 9 days away – or only 8 days away in my case – I’d like to take this opportunity (together with our awesome Admins)  to thank you all for your support throughout 2013, and for your continued support moving forwards.

Change of Venue + Hearing scheduled for 8 am

Following on from Sunday’s Motion For Reconsideration for change of venue, and last week’s defense request to seal the twitter accounts of potential jurors — both of which Pickles took under advisement — the AZ State Circus rolls back into town today for an 8 am performance.

UPDATE: The hearing is over and it was sealed.

The law of attraction cannot change anything in your life that you hate, because hate prevents the change from coming. Since the law is giving us exactly what we are putting out, when you hate something the law must continue to give you more of what you hate. You will not be able to move away from it. Love is the only way. If you focus completely on the things you love, then you are on your way to a beautiful life.

CHANGE OF VENUE – DENIED

The Court has no basis for finding the publicity about this case has been so outrageous that it will turn the new sentencing proceeding into a mockery of justice or mere formality. The mere exposure to publicity resulting in knowledge of the case does not create a presumption of prejudice when jurors can set aside the acquired information and render a verdict based upon the evidence. This Court will not be in a position to make such a determination until the jury selection process commences and potential jurors are questioned. The Court will inquire about a potential juror’s exposure to, and effects of, the pretrial publicity on that juror. Jurors with preconceived notions about the appropriate sentence will be excused. See State v. Greenawalt, 128 Ariz. 150, 624 P.2d 828 (1981).

The Court finds the Maricopa County jury pool is sufficiently large to assure impartial jurors can be found. A change of venue would create logistical issues for the parties, witnesses, court and involve substantial expense to the taxpayers of Maricopa County. No good cause appearing,

INDIVIDUALIZED VOIR DIRE – DENIED

A new trial on the penalty phase is pending. In the experience of this Court, the procedure followed at the first trial affords the Court and counsel an ample opportunity to explore relevant areas of inquiry and to evaluate “cause” and “preemptory challenges”.

During jury selection for the first trial of this case, there were very few requests by the prosecutor or defense counsel for individual voir dire of prospective jurors.

For the retrial, the jury questionnaire can be comprehensive enough to cover subjects that would otherwise be the topic of individual voir dire. While the

Court acknowledges there are unique concerns that have arisen because of the substantial publicity surrounding the case, the revised jury questionnaire may be expanded to address these issues. Since jurors will be questioned in small groups, the defendant’s concern that one juror’s statement might color an entire jury panel’s outlook is minimized. The Court acknowledges that it may be necessary to question some jurors individually. The Court’s procedures will allow for that to occur as deemed necessary by the Court.

The Court finds it is not in the interest of justice to permit individual voir dire of all potential jurors. The procedures used to select the jury in the first trial will be followed in the second trial, with minor revisions

IT IS ORDERED denying Ms. Arias’ Renewed Request For Individualized Voir Dire By Counsel filed August 21, 2013.

MOTION TO PRECLUDE OR LIMIT LIVE MEDIA COVERAGE OF SENTENCING PHASE RETRIAL – GRANTED

For the reasons stated in this Court’s sealed minute entry dated November 14, 2013,

IT IS ORDERED granting Defendant’s Motion to Preclude or Limit Live Media Coverage of Sentencing Phase Retrial. Still photographic coverage will be permitted unless an objection is made by a specific witness prior to testifying. Use of electronic devices will not be permitted in the courtroom. Any media coverage must comply with Arizona Supreme Court Rule 122 and the policies of the Maricopa County Superior Court. Consistent with this ruling, FTR disks of the trial proceedings will be available to the media and public after the jury has reached a verdict.

It’s well worth listening to.

With specific regard to the bathroom shoe print, I firmly believe law enforcement know who it belongs to, but the information has been purposefully suppressed.
