Martinez faces formal misconduct complaint from Arizona Bar

Jodi Arias prosecutor Juan Martinez faces legal issues once again.

The State Bar of Arizona filed a formal misconduct complaint against the deputy Maricopa County attorney Tuesday, including numerous allegations from women in the County Attorney’s Office that he sexually harassed them.

According to court documents, the complaint concerns Martinez’s actions during and surrounding Arias’ murder trial.

The complaint alleges Martinez had flirtatious or sexual relationships with a blogger during the Arias trial, and tried to get her to get information about jurors or leak confidential case information to him.

A court reporter for Maricopa County Superior Court also accused the prosecutor of making inappropriate comments about her, according to court documents.

Actions during Arias trial:

According to court records, confidential information was leaked to the media during the trial.

Documents allege Martinez had sexual relationships with a blogger and asked her to seek information from the jury. He told the blogger that if anyone found out he would be disbarred, according to records.

Also, he is accused of talking to jury members directly about how other members viewed the case. Documents state he had a sexual relationship with a juror that included her sending unsolicited nude photographs.

Court records accused Martinez of lying during his deposition about his relationship with the blogger and his communication with the juror.

Allegations of sexual harassment:

A court reporter with Maricopa County Superior Court claimed she was warned by a supervisor that certain people, including Martinez, were flirtatious and that she should avoid them, according to court records.

During hearings for the Arias case, she claims, Martinez stared at her and commented on her appearance. She said he would make inappropriate comments.

Martinez is also accused of making comments toward coworkers at the County Attorney’s Office. The office investigated the prosecutor in December 2017 and interviewed 30 employees, according to court records.

“The allegations included making inappropriate comments, primarily to law clerks, which were of a sexual nature, engaging in unwanted touching and making persistent unwelcome invitations to go to lunch or on a date,” court documents stated.

According to records, Martinez took a law clerk to lunch and asked if she had a boyfriend. He made a comment about “putting a hit on the boyfriend” in order to have her to himself. The clerk claimed she felt he was looking at her “like he was taking her clothes off with his eyes,” which made her hide in the bathroom at work to avoid him.

Another clerk claims Martinez told her “he wanted to climb her like a statue, or words to that effect,” according to court records. The documents stated the prosecutor invited her to Las Vegas and said he could guess the color of her underwear…….

Dr Oz, Nurmi, laxatives, lies & videotape…

Later today (check your local TV listings) the Dr Oz show will be airing a recent interview with Kirk Nurmi regarding his “relationship” with Jodi. Nurmi’s interview will then be followed by a segment on laxative abuse. I’m guessing the laxative feature will be infinitely more entertaining than Nurmi – but we shall see.

In the initial letter the Dr Oz show sent to Jodi, they stated that they wanted to look at the case from the perspective of Jodi being a domestic violence survivor — but in the cold light of day, there’s gonna be more lies, BS & misinformation than you’d get on your typical CNN show.

The emphasis won’t be on domestic violence at all… it’ll basically be Dr Oz giving Nurmi a platform he can use to throw Jodi under the bus, and tell everyone how Jodi ruined his life (as he puts it.) Well, boo-fucking-hoo.

With all that said & done, here are some points to remember:

– Nurmi was DISBARRED because of his complete lack of ethics, morals, and integrity in how he mishandled Jodi’s case.

– Nurmi was offered countless opportunities to get off Jodi’s case but he refused because he wanted the money and fame.

– Jodi petitioned the court over and over to remove Nurmi from her case and Nurmi fought it every time, digging in his heels, trying to hang onto the case for the money ($225/hr.)

– Nurmi always takes all the credit for “saving Jodi’s life” and never acknowledges the outstanding hard work of the phenomenal women on the legal team. They deserve a lot more credit than Nurmi.

– Juror 17 saved Jodi’s life, not this unethical goon.

– Doctors (such as Oz) are supposed to help people, not hurt people. (Click here for more info)

At SJ’s invitation, here is a slightly expanded version of my earlier post about Jodi’s appellate process. I welcome any corrections if I am wrong.

First, as Justus noted, appeals are almost always about law – whether the defendant did or did not get a fair trial – not about the facts showing guilt or innocence. Those would only get reexamined in a new trial.

Second, the main aim of Jodi’s appeals is to overturn her conviction, not to reduce her sentence. According to a Michael Kiefer article last year in the Arizona Republic — (click here to read the full article at AZCentral.com) — in 2013-15 Arizona did not even have a life-with-parole sentence option for first-degree murder, though many lawyers and judges believed that it did. Since then, the Arizona Revised Statutes seem to have changed, but I’ve been unable to determine whether and how the changes might allow Jodi to request a sentence reduction to life with possible parole. At any rate, the primary goal is to nullify Jodi’s conviction.

There are six courts that could overturn Jodi’s conviction. First, after at least two more briefs are filed, the Arizona Court of Appeals will hear oral arguments later this year and eventually rule. If that fails, the next step is a Post-Conviction Relief petition, which goes back to the trial court. Some or all of the issues in the PCR petition will be different from those raised in the CoA appeal brief. For example, that is the venue for raising claims against Nurmi of ineffective assistance of counsel. Both the CoA appeal and the PCR are handled by Jodi’s state-paid lawyers.

After PCR, Jodi would need to hire a private appellate lawyer to take her through the last four possible steps. First is the Arizona Supreme Court. Then, if she can persuade the federal district court to take her case, there are three levels of federal courts: the district court, the 9th Circuit Court of Appeals, and the US Supreme Court. She is lucky in that the 9th Circuit is notoriously liberal, and a few years back, a panel of it wrote a scathing opinion throwing out another Maricopa County murder conviction (Debra Milke’s).

There may also be extra steps in this process if any of the four appellate courts uses a three-judge panel to make a decision, since such a decision may then be appealed to the full court.

To hire a private appellate lawyer, the working assumption has been that Jodi needs about $250,000 as a retainer. However, I’m not convinced the full $250K will be required. Her appellate trust currently has about $104,000.

Finally, if any of these six courts throws out her conviction, Maricopa County will have the option to retry her. My bet would be that at that point it would instead accept a plea bargain with a reduced sentence, allowing her eventual freedom. But you never know; they could choose to retry her, at a cost of many more millions if she were by then indigent again.

One last point: in two weeks or so, we should be able to read the state’s reply to Jodi’s initial appeal brief. I will be very interested to see how the state’s lawyer tries to evade the second argument in that brief: that Martinez, over the repeated objections of the defense before and during trial, built his case for premeditation mainly on hearsay evidence. Since the hearsay evidence was Jodi’s own grandparents’ statements to Yreka police about the burglary, this may not motivate an appellate judge to want to throw out the conviction. But it seems to offer an ironclad hook to hang a reversal on, in case such a judge is motivated by something else, such as the first and sixth arguments (prejudicial publicity and prosecutorial misconduct). We’ll soon see what the state has to say!

In August, as sexual harassment and other charges against Deputy Maricopa County Attorney Juan Martinez were being investigated by the State Bar of Arizona, The Arizona Republic submitted a request to the County Attorney’s Office for any of the office’s human resources reports about Martinez.

The request also asked for information about a former media personality with whom he was alleged in Bar complaints to have had an affair. That woman is now working at the County Attorney’s Office.

The office did not acknowledge any investigation at the time and as yet has not complied with either request. The former media personality told a Republic reporter that what she did at the County Attorney’s Office was none of his business, even though she works for a government agency.

Weeks after the public records request was made, the County Attorney’s Office had 847 documents concerning the Martinez investigation submitted to the State Bar and requested that the material be filed under a protective order.

Presiding Disciplinary Judge William O’Neil, who oversees bar complaints, granted the request.

In recent weeks, County Attorney Bill Montgomery told a Republic reporter that his office recently completed an investigation of internal allegations against Martinez and disciplined him based on the findings. Montgomery did not elaborate.

The Republic reiterated its public-records request for the documents related to the Martinez investigation after Montgomery confirmed their existence. Amanda Steele, his office’s spokeswoman, replied that she was “aware of the request.” Four days later, she said that they had been subpoenaed by the State Bar.

Having brought a serious bar complaint against Juan Martinez, Jodi now has legal fees that are not covered by the Appellate fund.

The attorneys she retained are now in possession of still more information that warrants another bar complaint. Right now there are several pending bar complaints against Martinez, and this additional submission would help to strengthen the overall case against him.

Jodi has been paying what she could, when she could… but her attorneys now require that she pay off what she currently owes for the original complaint before they proceed further. The balance due now is approximately $12,800. Time is of the essence – so the sooner Jodi’s lawyers are able to act, the more weight the new complaint will carry collectively with the others.

An investigator for the State Bar of Arizona on Wednesday asked a state bar committee to consider disciplinary action against Deputy Maricopa County Attorney Juan Martinez because of allegations that he manipulated women to leak and obtain information during the Jodi Arias murder trial.

Martinez also is alleged to have flirtatiously communicated with a juror who had been removed from the trial to try to glean information about sitting jurors. The juror told investigators during a sworn deposition that she had texted photos of her naked breasts to Martinez after he told her he was “a breast man.”

The State Bar’s Attorney Discipline Probable Cause Committee could suggest a range of sanctions, from a reprimand, probation or suspension to a disciplinary hearing that could result in disbarment.

The Arizona Republic has learned that Martinez is likely a subject of a recent internal investigation into possible inappropriate behavior toward female employees of the County Attorney’s Office.

The Republic also learned that one of the women alleged in the State Bar complaint to be romantically linked to Martinez is now working in the County Attorney’s Office as a law clerk, which is similar to an intern.

The Republic in August requested copies of the county personnel investigation and an explanation of the clerk’s duties but has not yet received them.

The County Attorney’s Office and Martinez’ current attorney, Donald Wilson, declined comment. Martinez did not respond to a request for comment.

Multiple bar complaints filed:

As of March, Maricopa County had paid $150,000 in attorney’s fees to defend Martinez against bar complaints. That particular attorney no longer represents Martinez in newer bar complaints.

One complaint, which covered a decade’s worth of cases Martinez tried, including Arias, resulted in an offer of probation for Martinez from the Probable Cause Committee, but Martinez opted instead to face a disciplinary hearing.

If I had been Jodi’s defense attorney, what follows are the final five (of 25) questions I would have put before the jury during closing arguments to counter the State’s bizarre theories. (Or if I had been on the jury, I would have presented these to my fellow jurors.)

Question #21: Why would anyone leaving a crime scene at approximately six in the evening (when a whole neighborhood might be arriving home from work) think it is a great plan, after just killing someone, to be squatting down, reattaching a license plate when, as the State contends, the whole purpose of removing them was to make the car unidentifiable, untraceable and certainly unassociated with her?

Question #22: Why does she make cell phone calls in Arizona heading north from Kingman toward Hoover Dam, thus negating the supposed reason for borrowing the gas cans or turning off her cell phone?

Question #23: Why does she fill the gas cans in Salt Lake City if their purpose was to hide her trip into Arizona? Was she also supposedly hiding her trip from her so-called alibi home to Yreka?

Question #24: How is it Jodi supposedly came up with the most moronic murder plan in modern times but (according to the State), was able to use all her “caginess” to pull the wool over the eyes of three experts with more than 90 years of collective experience in their respective fields? (Are we really allowed to have it both ways when someone’s life is at stake?)

Question #25: If Jodi was planning to lie about the whole horrifying event while under oath, why during those 4+ years incarcerated did she not come up with a reasonable scenario about what happened during those final moments rather than telling us she can’t remember? Why supposedly fake PTSD when she could easily have just made up something to fit the scene that she supposedly remembers?

A journey of 1,000 miles begins with a single step — or in this case, it begins with Jodi’s recently filed 342 page Appeals Court Opening Brief.

The first 163 pages deal with the specifics of the appeal, while the remainder of the document includes appendix & additional materials.

* CONCLUSION *
Reversal is required based on pervasive and prejudicial prosecutorial misconduct, the due process violations resulting from the court’s failure to control the media’s access to the trial, the improper admission of hearsay testimony that helped establish premeditation, the improper testimony from the state’s expert regarding Arias’s mental state that helped establish premeditation, the fact that Arias wore a stun belt throughout trial without justification, and the prosecutor’s exercise of peremptory strikes in a discriminatory manner during jury selection. For these reasons, Arias respectfully requests that her conviction for First Degree Murder be reversed.
