Dr. Geffner: Decimation of The State’s Case [by Jade]

Check out the post below. It was based around a post made by Jade prior to the in initial verdict in May, but for some reason it never actually got posted. Interesting reading to say the least, and still applicable.

“All roads lead back to Dr. Geffner. You can bet the term dura mater is reverberating around that room.

It was the epicenter that the entire case for Martinez rested on. Without convincing the jury beyond a shadow of a doubt that a 25 caliber bullet above the right eye had the immediate effect of rendering Alexander helpless, the entire case fell apart for disproving self defense. Now at the very end of the case, it’s been held up to ridicule. That couldn’t have happened at a better time because the ME repeated over and over three different times on the stand it HAD to go through the brain. The emphasis Jennifer put on it with the question ‘do you know how serious this case is’ riveted that ME’s incompetence or deliberate lie in their brains.

Now all the other things that possibly seemed so unlikely can much more logically fall into place as Jodi described it. Once they can accept the premise of the POSSIBILITY of Alexander fighting, the self defense is automatic.

It then morphs right into why? And the second prong, domestic violence, i.e having the same man’s hands around her neck that caused the shutoff of oxygen to her brain once before is now not able to laughed at by any juror who tries to dismiss it and argue it. Now it is very real that he was trying to get on top of her just as she described on June 4th to do again. The flashback is now very believable and again it was Dr. Geffner who pulverized the only witness who tried to indemnify it as the preformed mentality of a violent and dangerous woman.

The twelve in there are mostly seniors. Seniors have life experiences, they have raised their own families. They are envisioning some of their sons or daughters being abused in the manner they heard on the tapes and the texts and the emails. They are realizing these weak inferences don’t add up and they have seen the sham attempted to be perpetrated on them by a rabid bloodthirsty egomaniac that I bet most of them couldn’t stand.

It had to be made clear to them when it was laid out like a road map in Nurmi’s closing how common sense will tell them that to believe the hyperbole Martinez pleaded with them to construe as premeditation beyond a reasonable doubt, not only didn’t meet that standard, it should be an insult to their intelligence.

There is a lot of material those folks are going over and any that may be pro prosecution in there is not having an easy time convincing those who are not I can assure you of that. I had said from midway in the trial this is no Simpson jury. There are some very bright people who are pointing out many of the same things we have for months. But now, with what I had said all along about this amateur ME being eviscerated if only a top coroner expert had been able to testify, it was all done by the one person who came at the final hour, decimated the State’s case and shined the spotlight on the real murderers.

I believe we will see that, although this isn’t truly a jury of Jodi’s peers in age, it will be a jury where Martinez will not like what he hears. And it couldn’t happen to a more deserving prick.

Fifty Shades of Bullshit: Second verse, same as the first…

Hi everyone.  MB here!

The topics of sex and BDSM within the context of abusive relationships seems to be frequently revisited, so here are my own thoughts concerning this undercurrent in Jodi’s case.

Since the beginning of the trial, there has been a concentrated effort to dismiss or downplay the abusive behavior Travis Alexander showed to Jodi Arias.

First they said that everything Travis did was just “uh… guy stuff’ as though being the most aggressive jerk one could be was the only way to show he was a a “real man.”  They tried spinning it that it was fucking awesome for Travis to be a sexually aggressive and abusive POS that was just doing what comes naturally.  I repudiated that notion then, and I repudiate it now.  Even better, Real Men™ have started opening up to repudiate it as well.

When that didn’t work, the Travistown pedo-huggers did everything they could to compartmentalize and sanitize every disturbing detail of Travis and Jodi’s relationship as if it meant nothing; as if it was just a series of isolated incidents that didn’t fit into the pattern that showed consistently that Travis Alexander was indeed an abuser.  But that didn’t work either, especially after the testimony of Alyce LaViolette.

Then they tried pretending that Travis’ abusive behavior was just him engaging in BDSM.  Of course that didn’t work then, and it doesn’t work now, but it hasn’t stopped some of the pedo-huggers from trying to spin everything to make it sound like Jodi somehow wanted, and deserved, to be treated like a used piece of toilet paper.

I know women who are into BDSM, and they are in fact victims of domestic violence.  They can attest to the fact that there is a huge difference between enjoying a spanking during intimate moments; and getting a laptop thrown at your head.  Or, in Travis and Jodi’s situation, being thrown to the ground, kicked in the side resulting in a broken finger; and choked until you pass out.  The difference between abuse and kink should be crystal clear; if it weren’t for Jane Velez Mitchell and the rest of Travistown waving around the book Fifty Shades of Gray like it somehow explains Travis’ behavior.

As far as I know, Jodi has never been into BDSM.  Jodi and Travis never claimed to be part of the BDSM lifestyle, nor did Jodi have the privilege of having a safe word to ensure her participation continued to be consensual.  If there was evidence that Jodi and Travis were just a BDSM couple doing what BDSM couples do; wouldn’t Juan Martinez have brought that up in his cross examination?

The fact is, Jodi and Travis’ sex life; like most all couples, fell somewhere in the spectrum of kinky sexual behavior.  That does not, however, make them full fledged members of the squidgy pleather parade.  The Travistown Cult also tries to pretend, that anyone who isn’t into BDSM or doesn’t believe it’s appropriate for abusive behavior to be conflated with kinky sex must be “old fashioned.”  As much as I’d like to say that the concept of BDSM started as a collection of writings in the Marquis De Sade’s jail cell after he was locked away for being a general sex pest; the co-mingling of sex and aggression has been acted out since the dawn of Patriarchy.  It’s magical thinking to pretend that thousands upon thousands of years of human culture entrenched with women being sexualized, bought, sold, trafficked, beaten, kidnapped, raped, and treated as beasts of burden has zero impact on our modern attitudes towards sex and love.  That’s just the reality of historical events and their ongoing influence; and if anything domination and submission is the oldest known expression of human sexuality since we started keeping track.  Perhaps we are collectively unable to shake off the effects of this psychological dynamic at this point of human history; however modern BDSM allows for D/s roles to be filled regardless of sex or gender, and consent is an important concept that is earnestly sought and ensured.  So that is progress!

Travis and Jodi’s relationship was definitely “vanilla” in the sense that gender roles were rigid and enforced; and Travis used sex as a way to establish dominance over Jodi, and Jodi was seen to be just fulfilling her role as a female.  In BDSM culture, she would have had the privilege of a safe word, aftercare, and the Dom’s acceptance of responsibility as comparable by what level of power they assumed over their sub.  Travis accepted no responsibility for the safety, health, and welfare of Jodi during their relationship (with exception to helping her after breaking her finger); and this fact hasn’t been better attested to in that Travistown has done everything to absolve him of all accountability.

I would also like to point out, that there would be no discussion of Travis’ sex life if the pedo-huggers weren’t hell bent on portraying Jodi as an evil seductress with magical sexual powers and the evil eye that preyed upon poor, innocent, virginal Travis who was the elder of a church.  They opened that door all by themselves by perpetuating a false narrative; propped up by the notion that only “good girls” can be victims of domestic violence, while “bad girls” somehow deserve to be treated poorly and with contempt when they come forward about their abuse.  This false dichotomy deflects responsibility away from the abuser, and instead tries to assign it to the victim in proportion to what value she is perceived to have in society.

Contrary to what people assume, we do not believe Jodi is a victim because she is perfect or pure.  We KNOW Jodi is a victim because of what Travis did to her.  It’s HIS actions towards HER that determine whether she falls into the status as an abused woman, not how many boyfriends she’s had or whether she has had anal or oral sex before her relationship with Travis.  And judging by the raging text messages from Travis, Jodi’s permanently deformed finger, and sex tape where Travis brags about intimidating people – she certainly is a battered woman.

No, Jodi is not perfect but I am not ashamed of her nor will I ever be ashamed of defending her.  She has made poor decisions and she admits to making poor decisions but I understand why she made those decisions.  She made them within the context of an abusive relationship where she was treated like a second class citizen.  Her relationship with Travis was not unhealthy because they experimented with kinky stuff.  It was unhealthy because Travis abused Jodi emotionally, physically and sexually; nor was she able to make fundamental decisions in the interest of her own self preservation during and after their relationship.  If they were a BDSM couple, perhaps she really could have walked away and started a new life with Ryan Burns.  But Travis wasn’t having that, was he?  He attacked her during the most dangerous time of their relationship – when she was moving on from him and getting back to his old self.  If that doesn’t convince people that he was an abuser (aside from all the other evidence admitted into court), then nothing will.

32 Reasons To Love Jodi Arias + “Dear Jodi” video

Happy Wednesday peeps! :mrgreen:

Hot on the heels of the recently posted video, here’s one of JM’s posts from last week, titled “32 Reasons To Love Jodi Arias”:

1) Her tenderness. She has a huge heart.

2) Her intelligence. She is so smart and knowledgeable about so many different things.

3) Her voice. I love to listen to her talk because her voice is so soothing.

4) Her laugh. I hate listening to the sex tape, but the only thing I could possibly find positive about it is that I like her laugh.

5) Her smile. She hasn’t had a lot to smile about lately, but I love her smile-with or without showing teeth.

6) She doesn’t take any crap from HLN or others. I love a woman like that.

7) Her eyeglasses. The only thing negative about them I could ever say is that they cover her eyes. Which leads to #8.

8) Her eyes. I love Jodi’s eyes. Maybe I’m crazy, but I can see so much love and pain in those eyes of hers.

9) Her sense of humor. I got to see that on her blogs and even on some of her Twitter tweets.

10) She rose from humble beginnings to become a self-made woman.

11) Her bond with her sister. She’s very family-oriented and while her relationship with her Mom and Dad has been strained, I know that her and her sister love each other very much.

12) She is beautiful as a blonde or brunette. Jodi could shave her head and be beautiful to me.

13) She stood her ground against Don Juan Martinez.

14) Her paintings.

15) Her drawings.

16) Her writings.

17) How she wants to prepare herself for an interview. I know some people find it to be vain or “diva-like”, but I find it endearing for some reason. Personally, I already think she is beautiful anyway with or without makeup.

18) She likes Napoleon Hill and often quotes from his books. Yes, Travis did, too, but Travis obviously didn’t apply a lot of Dr. Hill’s lessons to his life.

19) She coined the phrase “Nancy Disgrace”. How can you not love her for that?

20) Her singing voice. She has a beautiful singing voice and sounds like an angel.

21) Her love of animals. Bonus points with me.

22) Her love of children. I think that Jodi would be a wonderful mother someday.

23) Her positive mental attitude. All women have PMS, but not all women have PMA. Jodi does.

24) She didn’t back down from the jury to the point of even displaying her “Survivor” t-shirt in court. Chutzpah? Yes. But when I saw that I couldn’t help but smile.

25) She didn’t take any crap from the TV reporters before the “hung jury” decision. Even the local news anchor she liked that turned on her, she didn’t back down from him either.

26) Her sincerity. I know that Jodi will do whatever she says she’s going to do for domestic abuse victims. I would just rather her be outside of a jail or prison cell doing that.

27) Her taste in movies.

28) Her taste in music.

29) Her interests as listed on her MySpace account. Any woman who lists “stargazing” as an interest you’ve got to love.

30) Her facial expressions in the trial. I really pay a lot of attention to people’s body language and I remember watching Jodi a lot during the trial when someone else was speaking and trying to figure out what she was thinking. I just really like how she focuses on someone and then another person.

31) Her romanticism. Some people talk about how sexual she is, but they fail to see that what Jodi wants more than anything is to love and to be loved. It’s not just a want, but a need for her. And, she has a very romantic soul.

32) Last but not least, her generosity. She is very charitable with her money and her artwork which she does not have to do. And she never forgets those who treat her with kindness. I want to send her one of my poems that I wrote so that she reads it and it lifts her spirits. I don’t expect a response back from her, but if I do get one, I’ll be very grateful. It’s more important for me that she feels happy knowing that someone out there cares about her and helped make her smile that day.

Dissecting the photographs [RE-POST]

Here’s a re-post of my “Dissecting the Photographs” post from Jan 27th. The only addition is Pic #6, where I added the knife & dishwasher pics that were apparently never shown during the trial.

With regards to the camera strap and its suggested usage, Heather Conner testified (on Day 4) that the camera strap was found still unwrapped and in the camera bag (exhibit #213). Kirk Nurmi also deliberately highlighted this on cross examination. Excluding the use of a secondary strap, this therefore confirms there was no strap used while any of the pictures were being taken with the Sony camera.

Pic # 1: One of the hallway pics, where the body is allegedly being dragged and photographed at the same time – also featuring “the foot” and “the pants with the blue vertical stripe”. I’m not convinced this picture was taken while the camera was on the ground. Pictured timed at 5:32:16 PM.

Pic #2: A second picture where TA is allegedly being “dragged”. Very hard to make out what’s actually shown in the picture, but it could easily be a shoe as it could be anything else. If it was TA’s body being dragged on a “sheet” (as some pundits have stated), then how would it be possible to be dragging the body and taking the picture at the same time? 98. Who was the main factor in your decision to move from Palm Desert to Mesa? Travis or Rachael?
99. You testified that you thought you heard his footsteps. If you weren’t sure, why didn’t you run down the stairs and out the front door?
100.Why would you take the time to delete the pics off the camera after you killed TA?
101.You stated you remembered dropping the knife and hearing it hit the tile. What did you do w/it after that?
102.If your phone had died while at TA’s, why not use a wall charger so it would be charged before you hit the road?
103.In your email to TA after 6/4/08 you stated you’d sleep in his bed while he was in Cancun. Did you sleep in his house when he wasn’t there?
104.How is it you were so calm in your interview w/CBS?
105.You stated in 48 hrs interview that TA’s family deserved to know the truth. If that was true, why didn’t you confess then?
106.If TA wanted the sex convo recorded why didn’t he record it?
107.If you didn’t want to be tied to a tree, why did you go and look for a place where he could do that?
108.If you dropped the camera on the bathmat, how is it that it rolled all the way to the bath tub?
109.On the phone sex tape, when TA was talking about photos/taking vids, was that all part of his fantasy?
110.Did you ever voice anything to TA about being uncomfortable with his fantasies?
111.Why didn’t you call Ryan and tell him you were going to AZ when you decided you were going to AZ?
112.You have testified to many occasions where you performed sexual favors for TA to keep him happy. Are you saying you never got any pleasure out of it?
113.Why would you continue to carry journals around w/you if it was possible that others including TA might read them?
114.Why were the laws of attraction so important to follow but the law of chastity was not?
115.Do the laws of attraction also apply to recording phone sex conversations?
116.You stated there were times TA made you tear out pages w/negative things you said about him. Right before that you said you didn’t write anything bad about TA. Which is it?
117.Were you mad at TA while you were stabbing him?
118.How is it that you remember so many sexual encounters, including ex-boyfriends, but you don’t remember stabbing TA or dragging his body?
119.During cross, you were asked if you were crying when you were stabbing Travis and you said no. How do you know that if you don’t remember?
120.You stated you bought a gun to commit suicide but never ended up doing it. What stopped you from doing it?
121.You stated you would not want kids w/TA because you would be worried about them. If that’s the case, why’d you tell Leslie you couldn’t wait for your kids to play together at future PPL events?

Dissecting the photographs

Check out the pictures below – all produced as evidence in the trial – and leave your comments below. This should also enable us (for now at least) to keep discussions regarding the pics in one central page for easier reference.

With regards to the camera strap and its suggested usage, Heather Conner testified (on Day 4) that the camera strap was found still unwrapped and in the camera bag (exhibit 213). Kirk Nurmi also deliberately highlighted this on cross examination. Excluding the use of a secondary strap, this therefore confirms there was no strap used while any of the pictures were being taken with the Sony camera.

Pic # 1: One of the hallway pics, where the body is allegedly being dragged and photographed at the same time – also featuring “the foot” and “the pants with the blue vertical stripe”. I’m not convinced this picture was taken while the camera was on the ground. Pictured timed at 5:32:16 PM.

Pic #2: A second picture where TA is allegedly being “dragged”. Very hard to make out what’s actually shown in the picture, but it could easily be a shoe as it could be anything else. If it was TA’s body being dragged on a “sheet” (as some pundits have stated), then how would it be possible to be dragging the body and taking the picture at the same time? JANE VELEZ-MITCHELL, HOST: Tonight, beautiful but deadly Jodi Arias, charged with the gruesome murder of her ex-boyfriend, appears in court as lawyers try to suppress evidence they say could make her appear like a cold-blooded killer. Will this seductive murder defendant be able to charm a jury into believing that she`s innocent? That story, next.

VELEZ-MITCHELL (voice-over): Tonight, did this beauty kill her ex-boyfriend when he tried to tell her it`s over? Jodi Arias, accused of shooting and slitting her former flame`s throat and stabbing him 27 times. She says it was self-defense. Now will some last-minute courtroom maneuvers make it more difficult for the state to prove its case?

JODI ARIAS, ACCUSED OF MURDER: Sorry. Don`t roll the tape yet.

UNIDENTIFIED FEMALE: Jodi Ann Arias puts on her makeups right before the cameras went on. The soft-spoken 28-year-old remained calm and composed during this jailhouse interview. Jodi Arias is behind bars on a charge of first-degree murder.

The petite 28-year-old from Yreka, California, is accused of murdering her ex-boyfriend, Travis Alexander. His body was discovered June 9 in his basement home.

UNIDENTIFIED FEMALE: Motivational speaker Travis Alexander was viciously murdered at his Mesa home back in June, stabbed 27 times, his throat slit. He was also shot in the head. Police say DNA evidence, including a bloody palm print found at the scene, links Jodi Arias to the murder.

VELEZ-MITCHELL: Tonight, toxic secrets inside a truly shocking murder case. It sounds too bizarre to be true, but it is.

Good evening. Jane Velez-Mitchell coming to you live.

It all centers around this woman, 31-year-old Jodi Arias. This petite angel-faced young woman is accused of the unthinkable: shooting and stabbing her ex-boyfriend to death inside his house. And now her attorneys are trying to suppress evidence that they say could make her — make her look like a cold-blooded killer with absolutely no remorse.

Prosecutors say Jodi went to the Arizona home of her ex-boyfriend, Travis Alexander, in June of 2008, and shot him in the face, stabbed him 27 times, and slit his throat from ear to ear. Travis` friends found him, and here`s what they immediately told the 911 operator. Listen.

UNIDENTIFIED MALE: He`s — he`s dead. He`s in his bedroom in the shower.

UNIDENTIFIED FEMALE: OK. How did this happen? Do you have any idea?

UNIDENTIFIED MALE: We have no idea. Everyone has been wondering about him for a few days.

UNIDENTIFIED FEMALE: OK. You said that there`s blood. So is it coming from his head? Did he cut his wrists?

UNIDENTIFIED MALE: It`s all over the place.

VELEZ-MITCHELL: Jodi`s explanations have been all over the place, too. She told police that two people broke into the house and attacked both of them. Jodi claims she escaped and drove off without telling anyone.

But now court documents reveal Jodi may be claiming she did kill him but in self-defense. That her ex was violent towards her. But then at other times, Jodi has insisted she did not kill him.

UNIDENTIFIED FEMALE: Did you kill Travis Alexander?

ARIAS: Absolutely not. No, I had no part in it.

UNIDENTIFIED FEMALE: Who do you think killed him?

ARIAS: I have no idea. I`ve done many things that — that are shameful. But this is not one of them.

VELEZ-MITCHELL: What is a jury going to do with all these changing stories? And what about when you add this: police found a camera in Travis` washing machine, and cops found secret photos, a series of naked shots of Jodi and Travis together in sexually provocative poses and photos of a bloody Travis as he lay dying?

And I forgot to mention: Jodi`s profession? She is a photographer.

Straight out to — we`re delighted to have with us tonight former prosecutor Marcia Clark, author of the fantastic book, “Guilt by Degrees,” and famous, of course, for prosecuting the O.J. Simpson case.

Could the trial, Marcia, of Jodi Arias potentially be as big as that case? Some are saying it`s going to be the biggest case since Casey Anthony.

MARCIA CLARK, FORMER PROSECUTOR: I think it`s going to be very big; there`s no question about it. It has all of the elements, Jane. It`s got the young girl who doesn`t look like a murderer. You have the young man who is an upstanding citizen, and you have a very heinous crime that is a shocking thing to happen among people of that nature, of that type. So it`s all possible. A very dramatic case.

VELEZ-MITCHELL: Yes, it sure is. And I`ve got to say that the thing that has created so much attention is Jodi herself. Her demeanor, her behavior. She`s acting like it`s a big party. She`s not acting like her life is hanging in the balance. This is a death penalty case.

Take a look at her smiling mug shot. Exhibit A. Look at this. This looks like — well, it kind of looks like a high-school yearbook photo or a photo you`d put on Linked In when you want to get a job. She`s just been arrested for allegedly murdering her ex-boyfriend, and this is what she looks like?

Here`s how she explained that smile to CBS News` “48 Hours.”

ARIAS: And I thought to myself, you know, what would Travis do if he were in this situation? This is why I`m here. And, you know, barring the fact that he would likely not get himself into such circumstances, he would — he would be smiling. He would be like, hey, you know. He would just flash this grin that he always does, and so there was part of that. And then also part of the fact that I knew it would be all over the Internet. So why not?

VELEZ-MITCHELL: Wendy Walsh, we`ll show you in a bit. She engaged in a singing test behind bars. This woman`s behavior has brought a lot of attention to this case. Is she a sociopath, do you think? Is she a psychopath or is she just in complete denial about the level of trouble she`s in?

WENDY WALSH: Let me tell you, Jane, I am fascinated by this young woman`s psychology. I mean, I don`t know enough about it yet, but we`re sure going to see more of it as the trial continues.

But I would say a certain degree of narcissism. She`s smiling because she knows already it`s going to be all over the Internet and maybe she could get famous from this. This young woman definitely has some mental issues. It`s going to be interesting to see as they come out in court.

VELEZ-MITCHELL: All right. Let`s go to the phone lines. Cathy, I believe you`re from Florida. Cathy, your question or thought?

CALLER: Yes.

VELEZ-MITCHELL: Hey, how you doing?

CALLER: Hi. I watch your show every day. I love everything about it. My — I`m sorry. My comment is, I don`t understand how this lady, this girl is saying she`s taking revenge, but to slice his throat, shoot him and stab him multiple times? That`s more than revenge.

VELEZ-MITCHELL: Well, it could — it could also be revenge.

Prosecutors are describing her as a scorned woman, a woman who is out for revenge, and she did a lot of bizarre things. Exhibit A on the bizarro factor, the photos she allegedly took, according to prosecutors. Secret photos found on a camera inside Travis` washing machine. There were naked photos of the two of them, photos of sexually-provocative positions, and then photos of Travis naked in the shower, and then photos of him bleeding. It`s an unbelievable series of photos. Something, if you saw it in a horror movie, you`d say, “My God, this is over the top.”

ARIAS: They`re just photos that we took, and that we deleted with the intention of — that wasn`t — that wasn`t a one-time incident. I mean, there were many times where, you know, we took pictures, whatever, and any kind of media. And it was deleted because it`s just — it`s just something that we didn`t intend to ever keep.

VELEZ-MITCHELL: I want to go to Shannon Hogan, journalist, true crime author, who was there in Phoenix, Arizona. She`s writing a book on this case; she knows it inside out.

What were some of the bizarre things that Jodi, according to Travis` friends, did leading up to this? Apparently, she broke into his e-mail, was stalking other women that he dated. Tell us about that.

SHANNON HOGAN, JOURNALIST/AUTHOR (via phone): Yes, she hacked his Facebook account. If he befriended a girl and she heard about it, she would friend that girl on Facebook or MySpace. She allegedly sent harassing e-mails to women he was dating, which invoked heavy religious undertones, and she allegedly slashed his tires, not once, but twice.

VELEZ-MITCHELL: Yes, and I understand that she actually would find out if he was dating another girl, allegedly, and then she at one time snuck into the house and watched them sleeping?

HOGAN: That is one of the things that his friends are saying, that he was at the house with his new girlfriend, and they woke up to her standing over them.

VELEZ-MITCHELL: Unbelievable. But the truth is that — does anybody dispute that they were still having a sexual relationship? In other words, the victim had broken up with the defendant, but they were still having sex?

HOGAN: That is according to Jodi. There isn`t — the victim can`t speak for himself in this case. He can`t say that — you know, whether the sexual relationship continued. As far as his friends knew, he was still a virgin.

VELEZ-MITCHELL: Well, we`re going to have to examine that on the other side, given those photographs. Stay right there.

UNIDENTIFIED FEMALE: Were you in love with Travis?

ARIAS: I think that being in love and loving someone are two different things. And there was a point in time where we were in love, but it was short-lived.

UNIDENTIFIED FEMALE: Why did you guys break up?

ARIAS: There was sort of a breach of trust in our relationship.

UNIDENTIFIED FEMALE: On your part or his part?

ARIAS: Both.

VELEZ-MITCHELL: OK. That woman, and the murder victim, met and began dating in February of 2007. We`re told in reports that they did about five months, broke up in around June of `07, and he was dead by June of `08, a year later.

But Shannon Hogan, I have to go back to you. You know the story inside out. They had broken up, but they were allegedly still having sexual relations secretly, because I`m connecting that to the digital camera that supposedly takes pictures of them naked at the same time, or shortly before there`s a photo of him dead.

HOGAN: Yes, their sexual relationship isn`t really in dispute. It was the amount of time it happened after they broke up. You know, obviously, from the photos it`s very clear that they did have a sexual relationship. But it was something that he kept a secret, because it was something that`s against his religion. He was a Mormon.

VELEZ-MITCHELL: Jon Lieberman, HLN contributor, let`s listen to the victim`s best friends say that, when he found out that Travis was dead, he initially, immediately pointed to Jodi and said Jodi was involved. Listen to this.

UNIDENTIFIED MALE: There was one instance where he called me up and told me that he had caught her breaking into his Facebook account. Four days, five days later, he goes missing, and then we find him dead. And I – – that was the first thing to my mind is that, oh, my gosh, Jodi actually killed him.

VELEZ-MITCHELL: So a lot of people think, this is an open and shut case. You`ve got all the evidence, Jodi`s bloody palm print in the room. The photo — the camera with these bizarre photos on it.

But then again, Jon Lieberman, everybody thought the Casey Anthony murder trial was an open and shut case. And the thing is, there`s a lot of similarities between these two cases. Each involves a very pretty defendant and a defendant with a tendency toward sort of acting out sexually.

LIEBERMAN: Well, look, Jane, as you very well know, it only takes one juror. It only takes that one person and reasonable doubt, and this woman walks.

But I will tell you, the difference in this case is there is just a plethora of physical evidence. You mentioned it. The bloody palm print on the wall. There`s fibers, hair fibers, her hair fibers at the scene. There`s DNA.

There`s also the fact that she changed her story three different times, finally landing with this self-defense theory. Well, Jane, I`ve never seen a case where the victim is shot first and then stabbed 27 times and then almost decapitated, cut ear to ear, in a self-defense case. I mean, the shot itself would have, you know, kept — kept the attacker away.

VELEZ-MITCHELL: Jayne Weintraub, criminal defense attorney, this is a death penalty case. Why don`t her attorneys insist, if this evidence is so overwhelming, that she take some kind of plea deal to get the death penalty off the table, if possible?

WEINTRAUB: Well, first of all, we don`t know that those kind of discussions have not taken place. We don`t know what the prosecutor`s point is, whether or not they`re willing to waive the death penalty or not. That`s No. 1.

No. 2, interestingly enough, first of all, she`s been in that place before many, many times. So the hair fibers, the DNA, none of that matters. The only piece of evidence so far that matters to me would be the bloody hand print, and that could have happened if she came onto the scene after he was already dead, and that is a possibility, Marcia.

CLARK: Oh, please. Please.

WEINTRAUB: Hold on, hold on. It could happen. Remember, he`s not discovered for five days, Jane. This is not where she — you know, she is at the scene and the bloody fingerprint or palm print and then they come in and find the dead body. The dead body is not discovered for five days. That`s No. 1.

No. 2, along the lines that you were talking before, they are trying to introduce the lack of remorse as part of the, I guess, proof that she`s guilty, when that hearing will take place in the next week. And I just think that`s absurd. It`s like for maintaining her innocence, the state is going to blame her and say find her guilty?

VELEZ-MITCHELL: On the other side of the break I want to get Marcia Clark`s reaction to that, because the evidence that is overwhelming that you didn`t mention is in the camera. It`s in the camera. On the other side.

ARIAS: There`s a lot of forensics suggesting that I was, you know, in his house. The evidence is very compelling. But none of it proves that I committed a murder. None of it proves I committed a crime. What it does substantiate is what I did tell detectives.

VELEZ-MITCHELL: Marcia Clark, she`s told three different stories, and there`s this camera that has them, first naked in sexually provocative positions. Then him in the shower naked, then him dying in the shower. Isn`t that — well, do you think — what is the defense going to do with that?

CLARK: I don`t think there`s any, any possibility that the defense is actually going to actually try to sell the story that she didn`t commit this crime. I think what they`re going to have to do is focus — or they`ll lose all credibility with the jury. I mean, because this is — this is really overwhelming evidence that she committed it.

But the question will be not who done it but what they done. And that`s where I think the defense is wise to focus their attention. What is it that she did? Was this an act done in self-defense and then she kind of lost her mind and had a psychotic break and went crazy on him, or was this a rash impulse kind of thing? Was there some kind of provocation that she can claim he did to make her act out in this way and had some form of temporary insanity that had her overkill him, basically: 27 stab pounds, and a throat cut as well as a gunshot to the face. That`s really overkill, and that`s the kind of thing you see in rage killings.

I`m sure they could get a forensic psychiatrist to talk about a state of mind that is less culpable, not “not guilty,” but less culpable than someone who, A, deserves the death penalty; or B, maybe even less culpable than someone who deserves a first-degree conviction. So I think that`s where the defense would be smart to focus their attention.

VELEZ-MITCHELL: Wendy Walsh, psychiatrist, got to show you this clip. It`s Jodi`s winning performance in a prison-wide caroling competition. She beat 50 other prisoners to — you`ve got to check this out. This is beyond comprehension.

VELEZ-MITCHELL: OK. Wendy, she told three different stories. She seems to think that this is literally going to be a walk in the park. What does that say about her psychology?

WALSH: OK, she`s a smart, manipulative, misguided and distorted young woman. So here she is performing, and she knows once again this is going to go all over the world on the Internet, so she`s singing a religious song. She`s singing a Christmas song. She`s trying to portray this innocent, religious little girl here.

The truth is, if you believe all the evidence so far that she was breaking into his Facebook account, that she broke into his house and was watching him sleeping with his new girlfriend, that she was a stalker with an obsession.

Unfortunately for this young man, and Jane, this is so common, because the difference in men`s and women`s sexualities is so different. He probably thought, she`s my ex-girlfriend who says it`s OK, that we can now be friends with benefits. But he doesn`t understand that the sexual act has huge emotional impact on women. So it was probably fueling her feelings of obsession and jealousy.

VELEZ-MITCHELL: I like your analysis. I agree. Obsession. What is that old tag line, “between love and madness lies obsession”? It applies here, I think.
