   • Was the motion to disqualify the court of appeals approved ? I can’t find the answer in reference to the response anywhere on line.

       I’ve been waiting for it all morning, too. Like you, I searched everywhere. I’m following Michael Kiefer on Twitter but he hasn’t commented since October 5 so he may be on another trip. That guy is always going somewhere.

     • I suspect it’s been filed but not released yet.

     • Supposedly Beth Karas has published a reply by the Attorney General’s office. Haven’t heard of a COA decision.

3. Let’s replay this whole scenario but in this one let’s say Travis wins the fight and kills Jodi. Now he’s on trial, on the stand, claiming that Jodi attacked him:

   That she had been stalking him (even though the evidence shows he was corresponding with her, having sex with her, making plans with her).

   That she came uninvited and unwanted (even though he was waiting up for her at 4 am and then proceeded to sleep with her and have sex with her).

   That she intentionally attacked him at 5:30 in the afternoon when anyone could be walking by or coming in the front door.

   That she didn’t attack him while he stood in the shower for 40 seconds with his back to her but instead waited until he has facing her and could more easily respond and hurt her.

   That this 120 pound woman was attacking him for more than a minute as he moved around the bathroom and down the hall but he had no way of defending himself.

   That he paused at the sink in the middle of the violence.

   That even though he displayed an abusive personality (in his emails and text messages and an issue pointed out by one of his best friends) and Jodi never displayed any such behavior toward him, that she was the one most likely to attack.

   And that the reason she attacked him is because she loved him so much.

   Would these people, the ones who are currently so sure (beyond all reasonable doubt) of his innocence, have actually fallen for this? I doubt it. (They couldn’t possible be that stupid, could they?). But they certainly are falling for that same bullshit here!

4. Thanks for posting the MOTION…there is ONLY one question that judge should be FORCED under law to answer JUST HOW DID YOU KNOW SHE WAS …GUILTY…..! Was he there? Is he GOD like and this problem that is not his business or anyone,s problem…a trial costs what it costs SUCK IT UP AZ. or the FED.s can run your courts and YES they can…trust me on that. This is why the U.S. has in the past used MILITARY COMISSIONS to try any who seek to bring harm to the REPUBLIC…and his disregard for THE CONSTITUTION…..shows very well in his writing. why does any GOV. type get the right to a civil trial….remember they are GOV. and hence NOT civilians…unless all have the same rights and power…and do WE? far from it.My how them in Gov just love to judge but scream to the heavens when We the people dare judge them.TWO FACED indeed. 7. This motion seems to me well-argued, albeit somewhat repetitive. Questioning not just Judge Cattani’s statements about Jodi’s guilt, but also his research into the costs of the case, is a nice touch. I’m glad to see Jodi’s appeals team trying to make the most of his shocking behavior. But the leap from disqualifying Cattani to disqualifying Division I, and then the whole COA, isn’t explained. I didn’t look at the reference cited, however.

We have all heard of the thin blue line….does any think there,s NOT a thin black line…JUDGES…lok how any group in our society just loves to stick together….right or WRONG….tribal, cult ,gang ,or mob. Yes that motion did go on as the justice system is finds it SO hard to speak in PLAIN english. But my that works so well for a RAILROAD. If any think otherwise take REASONABLE DOUBT…..one sees a person being killed…..how could You or any know it was MURDER…..or SELF DEFENCE….when they were asked how(juror interviews) all they could do was MOCK HER. So much for FACTS and TRUTH and JODI was the only one in that trial who did speak truth other then HER side and at great risk…some pro bono…..that there speaks volumes. As for shocking behavior….this person took an oath to defend THE CONSTITUTION..his words are more TREASON then just shocking….if this is leadership….GOD SAVE the U.S.A.. But that,s were We the people do and must stand up to this injustice.he did write that SHE was guilty before TRIAL unless that to was a typo…! If this is what is what AMERICA wants well just get rid of the legal system….seems to work well in most of the world…so much for JUSTICE for ALL…well it did have a good run.But be that what it may….cattani showed the world just how VERY little he does believe in JUSTICE. his actions shame AMERICA as he SHAMES himself. Why would any trust the C O A he sat on …birds of a feather flock together…ring a bell. When any person worries about the cost of JUSTICE that shows their hate for JUSTICE.     One consolation is that the folks on the Team Travis ship of fools seem to think that the denial of this motion means the APPEAL has been denied.

    That deserves an eye roll, Samantha style! 🙄

    • Well, it’s even worse than that, since there hasn’t been any “denial” of the motion yet, just a response to it by the Attorney General’s office. Some of them apparently believe the AG office rules on motions to a court.

      • They are so eager and ready to jump on anything that gives them an excuse to mock and ridicule us (and, of course, Jodi) that they don’t even stop to check out the facts – but are we surprised?

        The final two sentences of the AG’s “Response to the Motion” read as follows:

        “Appellant’s motion to disqualify the Court of Appeals should be denied. Further, Appellant’s motion to disqualify Judge Cattani should be denied as premature.”

      • So, after reading this entire mumbo jumbo……. the AG acknowledges and confirms that judge cattani’s actions were wrong and inappropriate BUT Jodi’s request should be denied because they believe the COA can be fair and impartial especially in a case like JODI’s. And even though JODI’s team has a strong case for dismissal the AG deems it inappropriate to dismiss the entire COA because they think its premature to do so even if other judges COA could of contributed to judge cattani’s published info.

        It’s obvious that the AG is scrounging for an educated response even after their asses have been handed to them by JODI’s appeals team by filing this motion. They know very well that judge cattani discussed his findings of the costs with the other judges in the COA.

        These incompetent fools in the COA must be smoking the pipe, to think that by responding with sweet nothings is sufficient to justify their dog and pony show.

13. Question: Does the COA decide whether the COA should be disqualified?

    • Yes, I assume so, but their decision could be appealed to the ASC.

14. Great motion and it seems (although early days) that this attorney is pretty sharp. Would this be the attorney that will lead Jodi’s appeal? Or, will she hire the more professional (and more expensive) attorney to take the appeal forward into high gear? How will this work, I wonder, and roughly how long will this take before we are back in court?

    • Maureen,

      A little quibble and a comment.

      Just because these lawyers are with the PD’s office doesn’t necessarily mean they’re not professional. Some PD office attorneys probably handle more appeal cases than other attorneys. In fact a lot of appeals that are won, probably are handled by PDs.

      Also, there is a possibility that this case never goes back to court unless an appeals court somewhere remands it back for retrial and the County attorney decides to retry it.

      The appeal will be filed as a written brief. It is completely up to the COA as to whether or not they want to hear arguments. So they can just rule based on the briefs.

      If the appeals court doesn’t hear arguments, then there are two outcomes – it overturns the verdict, or it lets it stand. If it lets the verdict stand it’s up to Jodi to appeal to the next court up the chain. If the COA overturns the verdict and orders a new trial it then it goes back to the trial court, and then the County attorney has to decide whether or not to try it again, or do a plea bargain deal or whatever.

      If the COA decides against a hearing, that’s it. Someday we’ll see a decision, which will explain their reasoning behind it. I’m not sure if AZ televises appeals hearings, but if so we might get a view into the arguments if any.

15. My first impression of her new attorneys is that they are certainly better at writing motions than Nurmi when it comes to grammar. They sound like compassionate people and they certainly convinced me that this judge is as out of line as JSS was for her Juanita. Thumbs up!

      • I know that he didn’t type them himself, but Geez Louise he had to read them before he signed them. It seemed to me that either he didn’t care enough or he was too busy to read them before he sent them off. 🙂

        • I’ve always suspected Nurmi was using speech to text software. Most of the errors you see in his documents are just the sort that you get when a computer is taking dictation. But, yes, I agree – a proofreader would have improved them considerably.

16. I am just glad something is happening. – I think her new Attorneys seem like they have their shit together as this was well written. A little repetitive but well written. – I had to stop and think if I a frustrated about how long these things take imagine how our Miss Jodi feels.

    The wheels of justice do move very slowly.
