It is wonderful to announce that regular reporting of donations to the JAA Appellate Fund has resumed.

The interruption was initially due to Jodi’s insistence – against the advice of several close advisers – that fundraising efforts should stop during the Christmas season.  She felt strongly that during holiday season, people should spend their money on family and friends, not on her legal bills.  The rest of the delay came from communication and coordination problems, together with uncertainty over when a new matching-pledge drive could start.

It now seems that no matching-pledge drive will happen soon.  Fortunately, no such drive is necessary for the fund to reach its goal.   It needs about $150,000 more to reach $250,000.  But the original donation rate, in the fund’s first 1 ½ years of existence, was $3000/month ($54,000 in 18 months).  By contrast, donations during the match drive were running at almost twice that rate, $5700/month, before being matched.

If Jodi’s supporters can just return to the original $3000/month rate for the next 5 years – the estimated time till her state-paid appeals end – the fund will have about $280,000.  That will suffice to hire a private appellate lawyer to take her case into the Federal courts.  If, as I expect, no relief will be granted by Arizona courts, Federal courts are Jodi’s only hope of ever leaving Perryville prison.

I therefore urge all supporters & friends to resume donating immediately, as so many generously did in 2014 and 2015.  Understandably, many people have been holding back contributions in the hope that later they could be doubled in a match drive.  However, it’s time to get back to the monthly base rate, which is entirely satisfactory by itself.  At all costs, we must be sure to avoid the disaster of the Arizona appeals’ ending before the fund has enough money to move Jodi’s case into the Federal system.

“While the photos supported our belief that Arias had been with Travis on the afternoon of his killing and provided the story of how his life ended, they still didn’t prove that she hadn’t walked out before Travis was killed.” “How can we be absolutely certain that Arias didn’t leave the house in between the photos time-stamped earlier in the afternoon and when Travis was killed?’ I asked.” “We don’t know,” Flores answered. “We’ll have to wait for the fingerprint results to come back,” referring to a latent palm print found in blood on the wall in the hallway leading to the bathroom. “I put a rush on the request.”

Lisa Perry, a forensic scientist for Mesa PD stated that the unidentified biological substance containing the DNA from TA & Jodi was NOT blood at all.

Following on from that, here’s Mesa PD latent print examiner Heather Conner again, testifying why it’s not possible to accurately date a latent print impression, despite Kermit’s best efforts to get her to state differently – (launches YouTube in a new window):

And how about the strand of Jodi’s hair – attached to the wall in the hallway?

Here’s what it states in the book:

“There were also DNA results from a strand of hair that was found attached to the wall with blood. It, too, was from Jodi Arias. Like latent prints, the hair’s presence was not enough to tell us when it was left at the house or how it ended up becoming stuck in his hallway. Arias had been to the house many times, so the hair could conceivably have been left there and only disturbed and attached to the wall later, during the attack.”

So with the inconclusive photographs (see the previous post in this series)… together with equally inconclusive forensics relating to the latent print, the dating of the latent print, the renegade strand of hair, the DNA and the “blood”, here’s how Kermit quantified all of that in his book…

“The combination of the latent prints, the DNA, and, most importantly, the photos made me feel it was finally appropriate to charge her.”

It’d certainly be interesting to know how Kermit, armed with this evidence – (or rather an acute lack of evidence) – managed to con the Grand Jury into turning this basic self-defense incident into a 1st degree murder charge.

He’d previously stated that the remaining evidence was hit & miss at best:

“If Arias had simply taken the camera from the crime scene and disposed of it on the drive to Utah instead of leaving it behind after deleting the incriminating photographs, I might never have charged her with the murder because the remaining evidence may not have been enough to prove her guilty at a trial.”

And while Mesa PD were playing around DNA testing a strand of Jodi’s hair, they totally bypassed the infamous bathroom shoe print, right there in plain sight.

Did they cross refer the shoe print with any of the roommates or the numerous visitors to the house that week? No. Did they log any crime scene contamination? No. Did they officially document that Jodi left the shoe print? No. Based on all that, do they actually know for certain who left the shoe print in the bathroom? No.

Couple all that with the blatant state-sponsored evidence tampering, the prosecutorial misconduct and the accompanying unbridled assholery witnessed throughout the trial, and it all boils down to one almighty judicial cluster-fuck.

Once again, I think certain elements of this book will come in very useful at a later date… and may even go some way towards unlocking the mystery of how one can still get a “result” at trial – without having to produce any credible evidence.

Check out this picture of the camera found in the washing machine. This was taken before the “official” crime scene pics & numbered evidence markers were added.

Note that the memory card is actually IN the camera, next to the battery, (indicated by the arrow):

And here’s the official crime scene photograph of the camera in the washing machine, from a different angle:

There are some obvious differences between the 2 photographs.

Now, here’s where it gets interesting.

Heather Conner testified that the memory card was found separate to the camera at the bottom of the washing machine. Based solely on the photographs alone, that’s simply not the case. The memory card is clearly visible in the camera in the first photograph.

When Detective Melendez testified, he stated that the memory card was already IN the camera when he received it… which ties in with the picture at the top of this page.

Now, if (as Heather Conner testified) there was a card found separate to the camera… that would mean there were actually 2 cards found in the washing machine that day… although only the 1 card ever gets mentioned and brought into trial, namely Exhibit #215 as referenced in both video clips above.

That’s the blue SD card where all the “deleted images” were supposedly extracted from:

So… if there were 2 cards, that raises the questions of what happened to the OTHER card, and (more importantly) what exactly was on it?

In addition to that, TA’s camera used a proprietary Sony DuoPro Memory Stick (seen on the left in the pic below), which is somewhat thinner, rectangular, and has notches for locking the data contained on it.

Here’s a side-by-side comparison of both cards:

Here’s what all that means:

The blue SD memory card (Exhibit #215, as presented during the trial and pictured in the plastic evidence packet above) CANNOT and DOES NOT fit inside the camera that was found in the washing machine.

Personally, I believe someone (most probably Flores) viewed images from both cards that were found in the washing machine, then selected images were put together (and date/time stamps ADDED), all prior to the camera being handed over to Melendez… with the Sony DuoPro Memory Stick card in it. (Remember – the camera wasn’t technically able to add time & date stamps to the photographs, therefore any date/time stamps were added afterwards.)

So what about the “missing” photographs?

By “missing” photographs I mean the ones that Flores saw (on one of the memory cards) but deliberately withheld from evidence, for reasons I’ll cover shortly.

Here’s an excerpt from Flores’ Probable Cause Report (from 2008):

Here’s what it says:

“On 6-19-08 I received the images located on the memory card found in Travis’ digital camera. The digital card had several pictures on it including some, which had been deleted. The deleted pictures were of Travis naked in the shower, just before his death. The first one was time stamped on 6-04-08 at 1722 hours. There were several pictures of Travis as he was clearly posing for the camera. The last picture taken of Travis alive was at 1730 hours. Some of the following pictures were of a subject on the floor of the bathroom bleeding profusely.”

Did anyone see any photographs of anyone on the floor of the bathroom bleeding profusely?

No we didn’t… and nor did anyone else.

Setting aside the fact that Flores is a lying bastard at the best of times — (which is why he got demoted immediately after the trial) — he saw those bathroom pics, even though he couldn’t (for whatever reason) identify whoever was “bleeding profusely” on the bathroom floor. What’s more, he even made direct reference to the photographs in his Report. Therefore, the pics exist – or at least they did exist until Kermit got himself involved and had Flores lose them.

So WHAT exactly did those bathroom photographs depict?

More importantly, WHY did those specific photographs never get brought into evidence?

Let me also clarify something here. This post is not intended to contradict Jodi’s testimony or her account of TA’s unprovoked attack. It is solely intended to highlight the fact that Flores & Kermit saw the additional bathroom photographs, but then ultimately decided it would be in their best interests to exclude them from evidence as it didn’t quite fit with their M.O.

Logic dictates that the photographs probably validate Jodi’s testimony regarding the sequence of events — hence the exclusion. This of course is the same sequence of events that Flores gave 3 different versions of under oath.

For anyone thinking the camera & memory card stuff is old hat, it’s not. Why? Because if there were 2 memory cards in the washing machine — and the photographs & testimonies certainly confirm that to be the case — that means the other (2nd) memory card (and all its contents) was deliberately concealed and/or disposed of… which is not too dissimilar to what happened to all the phone SIM cards, and the all the child porn images found on TA’s laptop.

So while many people may think this case is over and done with… nothing could be further from the truth. There’s still a long way to go.

And when “Kermit’s House Of Cards” finally comes crashing down, it’s gonna take a lot of people down with it… including Chris Hughes.

When that happens, you can be sure the pedo-huggers & necrophilia enthusiasts will NOT be happy.

But we will be. We’ll be celebrating… just like we celebrate June the 4th every year.

As we now know – the latent palm print proved inconclusive and couldn’t even be dated by Kermit’s own witness (Heather Conner, Mesa PD.) More on that subject will follow in a later post.
