Jodi Arias Trial – Day 53 (after trial comments)

Ok… so there’s no trial this afternoon as we thought… but even after losing juror #8,  that doesn’t stop us discussing the very brief morning session and (primarily) the 30 minutes of bullshit from Kevin Horn.

Apparently, and in an attempt to backtrack and keep Martinez happy,  Horn now appears to see no difference whatsoever between the damage that can be caused by a .25 caliber handgun (with hollow point bullets), and a .45 Magnum. Interesting.

On cross with Jennifer, it also transpired (from his January testimony) that Horn also told Flores the gunshot would not have been immediately incapacitating.

Horn then denied having had any conversation whatsoever with Flores.

When asked (by Martinez) whether or not the gunshot would have rendered TA unconscious, he replied “probably.”

When asked (by Martinez) whether the gunshot would have been immediately incapacitating, he replied “yes”.

Speculation at its finest.

I’m also glad that Jennifer highlighted his earlier “verbal errors” too, specifically about the brain being “liquefied” on direct back in January… then in cross saying he’d taken slices/samples of the same brain for examination.

Jennifer definitely had this clown on the ropes… and judging by the jurors questions, they knew that too.

After yesterday’s Flores comedy show, Dr Kevin Horn (the Medical Examiner) is lined up for his rebuttling bit today. It’s penciled in as a “short” day too, like most of the other days really. Then after that, the circus starts up again next Wednesday, May 1st @ 9 am, and will include testimony from surrebuttal witness Dr. Robert Geffner.

Closing arguments & jury instructions are scheduled for next Thursday & Friday, May 2nd & 3rd.

So… barring any unforeseen fires, floods, earthquakes, acts of God or any sudden breakouts of gross stupidity, we should be celebrating the verdict around May 8th. I’m guessing on the date of course… but I do know this for a fact…

Shelf testing (how to do it – and how not to do it)

I’m not too sure what to make of yesterday… but it appeared to be a day of sidebars & recesses topped off by an early finish.

In the midst of all that , we were treated to the Flores comedy show and his BS-riddled rebuttal testimony. He basically admitted to “recreating” the shelf set up in the closet, and doing some selective measurements to boot, but I don’t actually recall him saying he’d actually tested the shelf to see how it would react to weight.

Yes, he’d played around with it and took some photos, but wasn’t the reaction to weight the critical factor? Apparently not. Had he done that, then it would have proven Jodi’s testimony to be accurate.

I also mentioned yesterday about the shelf re-enactment a few weeks back on our favorite entertainment channel, HLN. A lot of people missed that, so here’s the brief video showing their re-enactment.

The important part to note is that when the dude momentarily stands on the shelf to retrieve the gun, he’s standing on the far right of the shelf with the holding peg directly under it. Had he stood on the middle of the shelf it would have been different altogether. No wonder Flores never weight tested it.

Jodi Arias Trial – Day 52 (afternoon session)

Following the closed door hearing this morning in Judge Pickles’ chambers, the defense motion was granted and the surrebuttal witness Dr. Robert Geffner will be testifying, probably next week.

After the short day tomorrow, the trial starts again next Wednesday, May 1st @ 9 am.

Closing arguments & jury instructions are currently scheduled for next Thursday & Friday, May 2nd & 3rd.

The rebuttlings from yesterday’s motley crew of witnesses were interesting to say the least.

It featured Jacob “HLN” Mefford, Amanda Webb (Walmart), Chelsea Young (Tesoro), Deanna Reed (ex-GF) and Michael Melendez (Mesa PD). Click here for the trial day video if you missed any of it.

The jury are returning @ 1.30 pm today… so all we can assume is that the hearing regarding the surrebuttal testimony of Dr. Robert Geffner will be up first @ 11 am (?), which will not be broadcast.

With regards to additional state rebuttal witnesses, rumor has it that Dr Horn (the medical examiner) is on the list. If you remember, Dr Horn first testified that TA was stabbed first and shot later. This testimony alone is sufficient to disprove the premeditation charges.

Flores then testified that Dr Horn told him the gunshot had come first… prior to saying he was “mistaken” on cross with Kirk Nurmi. It’s basically the only thing Flores has done since the first week in January, and he couldn’t even get that right.

Flores is also on the rebuttal list concerning the shelves in TA’s closet. No doubt, to fit in with Martinez’ story, he’s gonna say it would be “impossible” to have stepped on the shelves to grab the gun. That’s strange though, as we’ve already seen some clueless fat guy on the HLN re-enactment step on the shelves & effortlessly grab the gun twice in his demonstration :mrgreen: Yes or no?

Sourpuss, Facebook & BS Petitions

As you may or may not be aware, Tanisha (aka “Anorexia Sourpuss”) got her bony ass banned from any further meetings in Judge Pickles chambers the other week. That was due to her organizing some online hate campaign & BS against Alyce LaViolette while she was testifying. Since then she’s been a bit quiet, aside from joining the Team Arias Facebook page.

Interestingly enough, the guy that runs the page also just told me some loopy TA supporters offered him $200 for his page, just so they could take it over and shut it down. How cool is that :mrgreen:

While on the subject of shutting sites down, someone else sent me a link to a groovy online petition last week. This one was actually a petition to get this website shut down. Yay! More free publicity :mrgreen:

Apparently, a bunch of pedo-hugging retards got the hump over my TA-in-a-body-bag picture & post from the other week. Anyways… long story short… blah blah blah… they still need 230 signatures to reach their target – which at this rate should be some time in 2018. At that point, I’ll send them an autographed picture of TA’s body bag with my heartfelt compliments. So if you want to go there and sign up to help them out – and leave your comments in the page while you’re at it – click here and all will be revealed.

In the meantime, I think Gloria Esteban & medical examiner Dr Horn are on the witness list for today & tomorrow – but I’ll know more shortly. The jury are also back at 1.30 pm today. The hearing regarding the surrebuttal testimony of Dr. Robert Geffner is up first and will probably be televised too.

With the motions filed last Sunday, and a good likelihood of Dr. Robert Geffner being introduced a surrebuttal witness for the defense, we are making good positive progress for sure.

Dr Geffner is a psychologist with 28 years of experience. He’s also the founder and president of the Family Violence and Sexual Assault Institute in San Diego and often speaks out against domestic violence.

Let’s see what this week brings as Jodi once again takes one step closer to victory, and the xtreme rebuttling begins.

New motion filed + Dr. Robert Geffner listed as surrebuttal witness

Kirk Nurmi filed a request on Sunday to add “Manslaughter by Sudden Quarrel” or “Heat of Passion” charges to the jury instructions.

The defense is also requesting they be allowed to call another witness to impeach and/or discredit the prosecution’s “expert witness”. In court documents, Kirk Nurmi writes it is “necessary and critical to Ms. Arias’ defense after this court allowed the state to present new evidence during rebuttal via its witness Dr. Janeen DeMarte.”

Based on this new information – and their right to call another witness – Dr. Robert Geffner was therefore listed in the motion as a surrebuttal witness.

“The Jodi Arias trial has been going on for nearly 4 months. The defense finally finished its case last week. Or did it?

Defense attorneys may not be done after all — and they make a move that could get their client minimal jail time even if she is convicted.

There were no trial proceedings Monday, but there was plenty of legal wrangling in the case.

The defense wants to call a psychologist to the stand to contradict the prosecution’s expert witness, Dr. Janeen DeMarte.

DeMarte testified she did not believe Arias was an abused by Travis Alexander and did not suffer from Post-Traumatic Stress Syndrome. Instead she feels Arias has a borderline personality disorder.

Arias claims she killed Alexander in self-defense and cannot remember most of what happened

However, the defense Monday asked the court to add “crime of passion” to jury instructions. That would give the jury the choice of acquitting Arias on self-defense or convicting her of first degree murder, second degree murder or manslaughter, due to heat of passion.

If convicted of manslaughter, Arias would serve 7 to 21 years in prison with credit for the 4 and a half years she’s been in jail awaiting trial. The judge has not ruled on either motion.

The trial resumes Tuesday with the prosecution expected to call either two of Alexander’s former co-workers or a Wal-Mart employee.”

Dissecting the photographs [RE-POST]

Here’s a re-post of my “Dissecting the Photographs” post from Jan 27th. The only addition is Pic #6, where I added the knife & dishwasher pics that were apparently never shown during the trial.

With regards to the camera strap and its suggested usage, Heather Conner testified (on Day 4) that the camera strap was found still unwrapped and in the camera bag (exhibit #213). Kirk Nurmi also deliberately highlighted this on cross examination. Excluding the use of a secondary strap, this therefore confirms there was no strap used while any of the pictures were being taken with the Sony camera.

Pic # 1: One of the hallway pics, where the body is allegedly being dragged and photographed at the same time – also featuring “the foot” and “the pants with the blue vertical stripe”. I’m not convinced this picture was taken while the camera was on the ground. Pictured timed at 5:32:16 PM.

Pic #2: A second picture where TA is allegedly being “dragged”. Very hard to make out what’s actually shown in the picture, but it could easily be a shoe as it could be anything else. If it was TA’s body being dragged on a “sheet” (as some pundits have stated), then how would it be possible to be dragging the body and taking the picture at the same time? Pictured timed at 5:33:32 PM.

Pic #3: A picture of the ceiling “accidentally” taken during the struggle in the bathroom while Jodi was defending herself from TA’s attack. Pictured timed at 5:31:14 PM.

Pic #4: The piece of duct tape (retrieved from the bathroom floor) as seen on TA’s right arm in the “bedroom pics”…

Pic #6: This crime scene composite picture shows the knife block (#67) with 2 knives missing… and the dishwasher (#68) with the 2 missing knives in it.
