A sweeping new ethics complaint by lawyers for Jodi Arias accuses Maricopa County Attorney Bill Montgomery of covering up misconduct by his lead prosecutor in the infamous murder case.
The complaint, filed Tuesday with the State Bar of Arizona, alleges Montgomery allowed prosecutor Juan Martinez to engage in unethical conduct during the trial and took steps to make sure the public would not find out about it.
Lawyer Karen Clark said Montgomery failed to supervise Martinez. She alleges he blocked public records from being released, including personnel records and depositions of employees who complained Martinez harassed them.
Clark also filed an ethics complaint against Martinez, citing new evidence that shows he wrote his tell-all book about the Arias case while the trial was unfolding. She has previously accused Martinez of giving a blogger and a media personality unprecedented access to the Maricopa County Attorney’s Office and case files during the trial.
Martinez has been the subject of at least seven bar complaints since 2015. The county has paid out more than $150,000 in attorney’s fees to defend Martinez.
The State Bar in December accused Martinez of unethical conduct in five murder cases over a 10-year period, including Arias’ case.
The Bar said Martinez:
- Compared a Jewish defense attorney to Adolf Hitler.
- Asked jurors how they would like to be strangled by the defendant.
- Disregarded instructions not to repeat telling jurors that the father of a victim could never call his son again.
- Asked jurors to imagine having their throats slit by the defendant (the conviction was overturned by the U.S. Supreme Court in 2016).
- Told a defense lawyer during a trial sidebar that he would “f–king want to kill myself” if he were married to her and later said that she should go back to law school.
The crux of the latest complaint was Martinez’s relationship with bloggers during the trial. It alleged Martinez engaged in flirtatious or sexual relationships with the women to get inside information on the jury. The complaint also alleged he used the women to leak information about the case on social media.

The political corruption shown in this move by Ducey is staggering. I can hardly believe it. How did this Arizona Republican party produce Senators McCain and Flake?
Yeah, and “coincidentally” all this one day after the ethics complaint against Montgomery was filed.
I’m not a legal expert but I’d guess this is like an espcape card from these complaints because what threat and possible punishment can they represent when he does not even have that job anymore – and he was never in danger to be entirely fired anyway. Wow, this is so dirty and rotten.
I don’t think anybody should be surprised that Bill Montgomery is covering up a lot of JM’s bad behavior. This kind of thing happens in all areas of life and business. It only seems to get attention when it occurs in places like this that involve the public trust. I think Clark & Adams are earning every dollar they are getting. I got the impression that Montgomery did not want JM to get disbarred because he either doesn’t have a lot of confidence in the other DA’s to get the same results as JM did, although unethically at times or because he simply didn’t want o have to go through the process of trying to replace him with somebody less experienced or more ethical. I could be wrong.

I noticed this article while going through the AZ Central website. The website won’t let me read it without signing up for a subscription but I got the headline. It states that Maricopa County has paid out nearly $170,000 to defend JM for all his ethics violations. That seems like a lot to me! Apparently, Montgomery didn’t think so?
They will be paying a lot more too.
Unfortunately, I dont expect anything other than another ineffective “hand slap” out the Arizona justice system regarding Jodi’s bar complaint. Since Martinez’s bill is paid by the state and they are loathe to admit any wrongdoing, I just can’t afford to outbid a corrupt state and that’s why I won’t contribute to Jodi’s bar complaint expenses. They have an “end justifies the means” mentality and don’t want to discourage present or future prosecutors from obtaining the injustices they obviously crave.
So what do we all do just look the other way? Yes, the Legal Crooks have a monopoly in AZ. Yes it is CORRUPT in AZ. What will it take to open the brainwashed citizens of AZ’s eyes? Who will stand up to these HORRIBLE “Officers of the Law (UGH)”??? There has to be someone in that state that has one ounce of Honesty in them that may/will make a difference. Ideas anyone?

I started to get this impression several months ago that many people just do not believe that Arizona cares about how unethical JM has been because of the fact that Arizona has a lot of violent crime and these people have gone to prison for real long sentences. The DA office has probably “run the numbers” so to speak and decided that $170K for JM’s behavior is a very small price to keep Maricopa County “safe”. The next question would then become… How much is too much? That number might be much higher than any of us would venture to guess! Any thoughts?
That might even want me to steal a car in Maricopa county to meet this moron in court and give him fire on the stand. 🙂
