Misrepresentation and Deceit in the Arias Trial: Crystal Blue Persuasion
(Fact Based Reporting by Rob Roman and Amanda Chen)

“Somebody lied to you about important facts in this case.” – Juan Martinez

“If you believe what the defendant is telling you, then all the arguments begin to make sense.” – Juan Martinez

According to Juan Martinez:

If it is written down, it’s the truth. If it’s not, it’s a lie. A white lie is just as bad as a regular lie. Not telling the full and complete truth at all times is a lie. Omitting details is lying. Anything that anyone says happened that is not in their diary is a lie.

If you are attacked or beaten by your partner and you don’t document it, tell someone or call 911, it never happened and you are a liar.

You are a liar if, after you do something unspeakable, you do not tell every person you meet what you can remember about what you have done.

Somebody did lie about important facts in this case, and we’re not talking about Jodi Arias. We have broken these lies down into five categories. The headings in bold type are assertions made by Juan Martinez in his closing argument .

These are the categories of lies:

White Lie: Typically a white lie is a harmless lie that is often done to be polite. Here, it’s a lie that plays into Martinez’ themes and theories, but it’s immaterial to the murder charge. These white lies are far from harmless.

Exaggeration: Something from the facts or testimony is taken out of context and magnified. It’s a fish story where a mountain is made out of a molehill.

Misrepresentation: This includes presenting mere speculation as fact, and changing the meanings of facts. It’s a deliberate effort to skew a fact to align it with other facts in the case.

Mirror: It’s a manipulation of the jury. Juan Martinez is projecting his own feelings, motives and ideas, or those of others, onto the defendant.

Whopper: It’s an obvious untruth in light of the facts. It’s deceitful and a breach of integrity.

Let’s examine more of the territory covered in the prosecutor’s all-important closing arguments:

The Manifesto and Salt Lake City:

“She has signed a Manifesto just in case she becomes famous” – Juan Martinez

This is another thing Martinez dug up in Alyce LaViolette’s notes. The prosecution had no witnesses attesting to any “Manifesto” and it was never entered into evidence, even though Martinez wants the jury to believe that Arias made copies and autographed the copies in jail in Yreka.

Even if she did, it’s just the same “intruder story” again, and Arias has already claimed she invented the story as a stalling tactic. Reporters have requested proof of the Manifesto from the prosecutor’s office, and they’re still waiting:

“This woman who claims she never went to Salt Lake City” – Juan Martinez

Martinez tells the jury Jodi testified that she was never in Salt Lake City, Utah. She was in West Jordan, on the far outskirts of Salt Lake City. This honest answer is a lie and a manipulation, according to Martinez, because a gas receipt near West Jordan states “Salt Lake City”.

This is simply a trick of semantics.

“Staging The Scene”:

Arias believes “she will not be convicted, after she has staged the scene for you”.  – Juan Martinez

It’s The Mirror. The most important question here is why does Martinez feel he needs to add all the ornamentation you see throughout the trial? This is yet another behavior that El Espejo, the mirror, attributes to Jodi Arias.

Juan tells the jury that “in the light of truth you can see who she really is.” “This is an individual who is manipulative.” “This is an individual who will stop at nothing and will continue to be manipulative and will lie at every turn and at every occasion that she has.”

This from the man who peppered the trial with lengthy inquiries and discussions about Bobby Juarez, high school era windows and doors, happenings from Arias’ life when she was 5 and 8 years old, the backspace button, the criminal, the stupid sister, the gopher, the dog, the chameleon, the wildebeest, that thing, Snow White, the Shack, the Christmas tree, the Ring and The Fog…

      • Ah, well, I am always brief when I think I might be the first poster – LOL I want to get it done fast so nobody will beat me, but I try to say something more/other than “First!”

        I don’t agree with everything the article said about Jodi, but I won’t take offense at that because – even as we see here in the population of Jodi supporters – people have differing opinions about where Jodi may or may not have been ‘in the wrong’. For example, the authors seem to believe that Jodi actually did all of the so-called ‘stalking’ things, they just don’t agree that those things constitute stalking. And they make no mention of Steve Bell, or of the fact that Travis described Deanna to Jodi in the same way he’d described Jodi to some of his friends.

        But I DO agree with everything the article said about the despicable prosecutor.

  1. Thank you all, for continuing to put into words, the gut feelings I’ve had each time kermit opened his mouth. His method of acquiring justice is like legal terrorism.What kermit wants to be the truth is not the truth. All kermit ever PROVED is you can still manipulate opinion. Someone somewhere please put the stops to this fiasco. Free Jodi!

  2. Jodi Arias Trial – Day 16 – Part 2

    I just got finished watching the above video of Jodi’s trial and Jodi stated that Travis told her that when they had sexual encounters, while roommates were in Travis’s house, they had to be quiet because the WALLS WERE THIN and you could hear everything!!!

    SO, how come the roommates didn’t hear anything the day Travis was killed, especially, since Travis told Jodi that the walls were THIN??? Gunshot, dragging, thumps when camera hit the ground, loud thump when Jodi got body slammed, commotion, probably Napoleon barking, etc.????

    I just don’t buy the fact that the roommates didn’t hear anything going on OR didn’t smell anything after five days and they were in and out of Travis’s house and said they thought Travis was in Cancun!!! GMAB!!!

    When Kermit would obsessively object all the time and Jodi would say sorry, Nurmi finally said to Jodi that she DID NOT have to say sorry, it made me feel SO, SO, SO HAPPY!!!!! I thought good for you Nurmi!!! I guess Nurmi brought Kermit off of his dumb pedestal he was on!!!!!!!!!!!!!!! Also, if you watch that video, watch how Kermit tightens his mouth and shows his teeth in the most fierce way when he objects??? Eewww, gross looking!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    Jodi, don’t worry, all the torture and embarrassment that you had to endure, all the hating on you by haters, all the lies about you, all the bad wishes for you, all the eye rolling, glares of pure evil, death threats to the witnesses who wanted to testify for you (and there were many) and even to ones who did testify on your behalf, will soon be over!!! The truth is being uncovered all over the place and soon the whole truth will be exposed and the big cover up uncovered!!!!!!!!!!! So, hang in there, Jodi, because your day of freedom is near!!!

    • I almost forgot: I have just one small objection: BPD is a personality disorder, I don’t like it when Jodi is being labelled ”mentally ill” because the majority of people associate and confuse this term with other mental illnesses like schizophrenia for example.
      The term ”mental illness” is commonly and broadly used by all of us but most of the times it is used rather generally and unfortunately LOOSELY. I mean, look at it this way: a List of Mental iIlnesses includes schizophrenia and panic attacks or sleep disorders. Certainly, there’s no comparison between those 3, right?
      Not to mention that it was Tot Doc DeMartian who made that diagnosis. The Defense expert witnesses didn’t testify that Jodi suffers from BPD. Dr Samuel’s assessment was PTSD, which is far from BPD.

      • I agree, Maria. I think Jodi was and is a very normal woman who was just trying to love someone and who was driven nuts by a sociopath playing mind games with her. There is nothing in her past that indicates any kind of mental illness prior to meeting up with Travis and to use any behaviors after she met him as an indication of mental illness is just a subtle form of blaming the victim (“There must be something mentally wrong with her since she kept going back to him.”). If that’s a symptom of mental illness then we have a lot of mentally ill women in this world who apparently just need to be taught how to be less caring.

        • And traumatized not just by Travis, but by years of unjust imprisonment in a highly restrictive jail, savage public attacks by a vicious prosecutor, and unspeakable abuse by national media.

          To Maria’s point about terminology: I think it is definitely wrong to call all the DSM categories “mental illness.” The general term should be “mental disorder,” and the list of them runs the gamut from mild and transient to catastrophic and chronic. A large proportion of the population qualifies for a DSM diagnosis. In fact, arguably everyone qualifies for an ICD-10 diagnosis of physical disease, but it would be absurd to call everyone sick or ill. Also, there has been a large amount of recent criticism of DSM for, among many other things, pathologizing normal behavior. Jerry Wakefield has many fine papers and two books on this subject, if anyone would like links to them. Unlike Jerry, I think the DSM is essentially garbage from beginning to end.

          In particular, I think it’s something of a stretch to call BPD “mental illness,” even if Jodi met the criteria, which I doubt. Her lawyers, as I recall, said the state viewed her as “ill,” but said this only as a legal and PR maneuver to take advantage of court rulings against executing the “mentally ill.” I think Justus’s description is a lot more accurate than DeMarte’s.

          • Justus, Chris, Maria, good posts. Dr. Geffner’s direct testimony also clears the air (Trial Day 54) on the topic of BPD v. PTSD.

            I believe in years to come mental distress will be looked upon and treated in terms of a spectrum, with the above-mentioned acronyms and several other trauma or anxiety-related diagnoses having hit the dumpster.

            Right now no one can observe Jodi and draw any conclusions about her lifelong mental state.
            She has been facing a possible death sentence for years. She has been in continual maximum mental distress since June 4, 2008. She has been incarcerated since July, 2008.

            Chen and Roman wrote a very incisive piece about the dynamics of JA and TA’s relationship, while dissecting the ways in which the prosecution exploited TA’s misrepresentations about same.

            But seriously, let’s leave the psychological diagnoses to the professionals. They have a difficult enough time as it is to get it right, given the circumstances*.

    So if I am getting it right, only what is documented is accurate. Whatever is just said has no credibility that it is true?

    If that’s the way kermit is playing it, I don’t recall any entries in Jodi’s journal stating that she killed travis… (evil smile)… nor do I remember any info telling us that Jodi had written in her journal that she was thinking of killing travis so that crosses out premeditation too…

    I can go on and on about what was NOT documented and yet kermit used so many assumptions and made them into facts even though they were only assumptions… HIS EVIL AND BIAS ASSUMPTIONS…

    This article should be sent to the defense team…

  6. I’m still shocked at how twisted-up Martinez and HLN managed to make this case. Great article! Martinez consistently put forth fabrications. His questioning of Alice LaViolette was particularly full of misrepresentations:

    “Doesn’t it seem a little strange to you that in 50 percent of her relationships somebody comes up to her and tells her that her boyfriend is cheating?” Martinez asked. LaViolette said she was only aware of that happening once and would need more information to formulate an opinion.

    Why was he allowed to put forth that she said it happened 50% of the time?

    and this one:

    “LaViolette said she has seen evidence Alexander has a history of telling lies, more so than Arias.”

    Yet, Martinez calls Jodi and everyone who testifies for the defense a liar. The hypocrisy was MIND BLOWING.

    • I think the 50% thing came out of the fact that it happened with two out of the four of her longtime boyfriends – with both Matt and Travis, someone who happened to come into the restaurant where Jodi happened to be working told her the ‘boyfriend’ was seeing someone else. In the Matt/Bianca scenario, as Jodi described it, these common acquaintances were telling her because they thought she should know. But with the Travis/Lisa situation, Jodi didn’t actually tell us about the event directly, only that it was something she and Travis were fighting about after the fact – I *think* it was even after Jodi moved back to Yreka that the fight happened. But since Jodi was a ‘secret’ to most of Travis’ peripheral acquaintances when he was dating Lisa, I think it’s likely in that situation that the person passing the info along didn’t know Travis and Jodi were still involved – was just sort of chattering ala “hey I remember you, you used to date Travis, right? yah, he’s dating that girl Lisa Andrews now.”

  8. I want to thank SJ for showing the article on this site. I cried when I first found this site almost one year ago, because it was the ONLY one standing up and speaking for Jodi. I think that’s heroic. I often read all your comments here.

    To Journee, it’s true that many of us have difference of opinion. Jodi did look in the window, she did show up at Lisa’s home, and she did go into Travis’ phone and computer. She admitted all these things. We just said that is normal behavior and even people pay detectives to do these things, it’s not stalking. I never heard of Steve Bell. Travis described Deanna to Jodi in the same way he described Jodi to Deanna? I want to know more about these, it’s very interesting

    To Maria, Dr. Samuels diagnosed Jodi with PTSD and Personality Disorder NOS (non-specified). We believe Jodi has an untreated mental illness since childhood, but so do many artist, actors, and very accomplished people. We do not believe it is BPD, and Dr. DeMarte used many fictions to support her diagnosis. Jodi was very stable during the four years with Darryl, so we think Travis’ lies and treatment of her may have destabilized her. This is when the friends called her mom and she called home very upset. We could be wrong. I think Travis called Jodi a stalker was two face behavior to explain to other girlfriends.

    To Sam, I saw that comment of the 50% by Juan too. How stupid. Haven’t we all had the same experience?

    • After I write this, I’ll go back and watch Lisa’s testimony again – but it was my understanding that Lisa and Jodi both described a time when Jodi walked into TRAVIS’ house, found Travis and Lisa standing in the kitchen, and bolted from the house without a word – and that Travis went after her. I have not heard a story of Jodi walking into LISA’s house…. that really WOULD be weird and I might have a different opinion of Jodi if I find out that happened. Not that I’d see her as more guilty, but quite possibly a bit crazier than I’ve given her credit for.

      Steve Bell was Lisa’s ex when she started dating Travis… a jealous and possessive sort whose own history suggests HIM as a likely candidate for the tire slashings and the anonymous email to Lisa. The email was judging Lisa, remember, in a very Mormon way, for presumably doing what Jodi did with Travis all the time. I think if it was Jodi writing the letter, she’d have just told Lisa what Travis was doing with another woman. Might have even outed herself, as she did with the girl from the text message.

      The bit about Deanna was in Jodi’s testimony – that Travis said she was possessive and kind of crazy and for Jodi not to let on about their relationship when they met. And I agree the ‘stalker’ stuff came straight from Travis, and that he may have even used the term to describe *other* women to friends and women, just as a way to cover his ass as a player – knowing his women might cross paths, he used the stalker story to keep them from getting friendly with each other (and comparing notes).

      • Journee, you’re correct. Jodi came in to Travis house when they were in the kitchen. I made a mistake. That’s even better for Jodi. It’s right at the start of the cross. Thank-You for explaining about Steve Bell. I also think like you that Travis told one girl that the other was a liar or a stalker or anything to explain why the other girl was around or calling. Deanna, Lisa, and others say she came in to Travis house or was there baking cookies. This must be because of Travis and his open-door policies. I think she didn’t know when it was okay to come over and when to not come over. Jodi was just coming over and this was her habit.

      • Yes Journee I too remember that: Jodi walked in, found the two together, was obviously shocked and stormed out WITHOUT making a scene.
        And again you’re right as to why Travis came up with that ”stalker” idea. How convenient… In order for him to NOT have to explain his player nature and the fact that he was dating multiple women at the same time, he somehow thought it was easier to tarnish their reputation to others by claiming they were obsessed with him and went as far as to call them stalkers. Remember he did pretty much the same with Deanna; he told Jodi Deana was not over him, that she was clingy and wouldn’t let him go so him and Jodi had to tiptoe around her so as to hurt her feelings. How hypocritical…
        And btw, I know first hand that no matter how smart you think you are, yes you can be deceived by such people especially when you trust and/or are in love with them. I remember years and years ago, a boy told me that he wasn’t dating this girl but whenever I’d point out to him the numerous times he was seen with her in public places he’d tell me that the girl was obsessed and yes! he even used the word ”stalker” (in Greek of course, LOLOL) .
        So, there you go! We are not accusing Travis of being a monster or that he deserved to die because of his uncontrollable libido, but just trying to emphasize that he was undoubtedly a liar who used and abused women, both mentally and psychologically. In Jodi’s case, he unfortunately ”resorted” to physical abuse as well.

    • travis’s tactic was playing double standards with all females:

      • It was Sky Hughes who in 2007 suggested that Travis was a womanizer who used Jodi physically and referred to her as a “skank”. She also said that he was emotionally abusive and a “heart predator” who liked to collect women. She said “Travis, with love, you are a heart predator. You take great joy in making women fall for the T-Dogg. You laugh about what you can get away with. It would scare me to death if my little sister liked you, in fact I wouldn’t allow it.”

        Now, this is a FRIEND of his saying this. It’s not me. It’s not any of you who support Jodi. These are direct quotes from Sky Hughes about Travis, but they were never used in the trial because Judge Stephens called them “hearsay”.

      • Maria, I totally agree. Although it was a way for Jodi to express herself, somehow haters found a way to twist everything she tweeted around and mock it.

        So, yes, for the meantime, it is for her best interest not to tweet. At least until the trial is over.

      It is really ironic how those haters go on and on about how Jodi is a ‘cold blood murderer’ and yet they chant and pray for Jodi to get the DP. What does that make them?… (rhetorical question)

      I just hope that individual doesn’t have children of her own… I would be afraid tho know what morals she is teaching them… pfff. For shame.
