Jodi Arias Trial – Day 53

After yesterday’s Flores comedy show, Dr Kevin Horn (the Medical Examiner) is lined up for his rebuttling bit today. It’s penciled in as a “short” day too, like most of the other days really. Then after that, the circus starts up again next Wednesday, May 1st @ 9 am, and will include testimony from surrebuttal witness Dr. Robert Geffner.

Closing arguments & jury instructions are scheduled for next Thursday & Friday, May 2nd & 3rd.

So… barring any unforeseen fires, floods, earthquakes, acts of God or any sudden breakouts of gross stupidity, we should be celebrating the verdict around May 8th. I’m guessing on the date of course… but I do know this for a fact…

    • I am very frustrated about the defense. It has been a long trial, why the heck do not the defense have a forensic expert and a ME? The dura mater was intact at autopsy and the bullet did not enter his brain. The bullet barely caught his skull and would have exited very near the entrance wound if it was a more powerful gun. It changed the direction when it hit the skull (inner) second time, then glided inside the skull and passed the sinus region. He was mindful to clear and blow blood at the sink, that was not an act of a man being murdered, or he would not have exposed his back to more attack and taken his eyes off his attacker. Could anyone here tell the defense that the dura mater was intact? The momentum was toward his facial skull and most of the energy was absorbed by the bone, not his brain.

      • Joyce, to be honest, I feel for the defense. They are fighting an uphill battle with this judge. It’s not so easy for them to be able to present witnesses. I think most experts are afraid to touch this case. 🙁

      • I do believe the jury will see it exactly the way you stated it. I was very surprised OJ was not found guilty, but for some reason the jury couldn’t convict him without reasonable doubt . More reasons in this case for the jury to have reasonable doubt. Jodi will be free soon. Relax and Thank God !

        • I am also wondering why we don’t have a forensic expert and ME. Since I am not an attorney and don’t understand why not, it looks to me like the jury can get her on the murder 1. I know what that guy in the blue shirt was saying wasn’t completely true. My background is in medicine. I understand the circumstances when being shot in the frontal skull. But will the jury know what to understand? There is so much bull being thrown around by Martinez but I hear so many positive things about him. The jury has to hear this also. I just don’t trust this system in Arizona. The reason the jury couldn’t stay was because they don’t have security at night and the weekends. The Judge said it herself. So if the verdict is not in Jodi’s favor, I know it is a system problem in that Arizona Court House. Multiple system problems because of the many death threats on the defenses side. Like a Witch Hunt, Lynch Mob. All the no real fact stuff.
          Also, for Miss infantile psychologist many people develop Borderline Personality Disorder once they have been through the Trauma of a PTSD event. They don’t have to be exclusive of each other. So infantile psychologist sounded very stupid to me. But to the masses, who don’t know any better. But does the Jury know better? That is what concerns me. Just the fact that infantile psychologist got on the stand as an expert witness and didn’t know something that renders experience needs addressing and whatever the law does about a clueless expert witness.

          • Or a person with PTSD can be diagnosed as follows: PTSD with some borderline features. That is a more common way to address the abandonment issues a person may have.

  4. Do you think Dr Horn is going to make a convincing argument that TA was stabbed first then shot? I hope the Defense is fully prepared for this….I’m a bit worried.

      • Seriously. How can anyone think he was shot last based on the blood evidence? The doctor is going to have a tough time proving that he was stabbed first I think. I am not a pathologist but just understanding what I do know it isn’t easy for me to see it. I will have to wait and hear the evidence he is planning to testify to.

    • I have no idea, Linda. I can tell you this. My brother was shot in the head (way worse than Travis) and he walked to his truck (with help of friend) several hundred yards away, was fully coherent all the way to the hospital (about a 15 min drive), and did not slip into a coma until he was air evacuated to a different hospital.

      AND, he is alive today!

      • Of course! This happens all the time. It is the only thing that makes sense. Travis was shot, either fell or not, got up and went to the sink and then flew into a rage.

          This happened in 1993. He was shot in the head when his friend’s gun accidentally discharged and ricocheted off a rock, and shot him in the back, left side of his head.

          We thought we were going to lose him. But, the doctors did an excellent job. He has short-term memory loss, but that’s it.

          The reason I call BULL on the ME is because of this.

          Remember, he went to ONE hospital first, and then was airlifted to another hospital that’s another 15-20 minutes away by air.

      • Wow! That’s great for your brother. And I assume it went through his brain (Dr. Horn’s big argument last time)?

        • Yes, it did AA.

          When my brother got to the second hospital (Barrows Neurological Center) in Phoenix, the doctors had to cut his head open on the helipad and remove a huge blood clot.

          Then, when he was on the operating table, they removed the part of his brain that has to do with short-term memory.

          He is alive and well. Is married with two kids. This is 20 years later!! 🙂

        Yes, the brain is a funny organ. There’s stories posted everywhere on the Internet of people getting shot in the head and living to tell about it. So the idea that Travis would have been immediately put down is ridiculous. Especially not by a .25 bullet which is a step above a pea shooter.

  8. While we wait for court to start, I thought I would pass this info along (not sure if it has ever been posted).

    It seems that TA refinanced his house in 2006. He got +/- $100k out. Then, there are several entries as what appear to be “workouts” with the bank in 2008.

    So, I guess he blew through money like “shit through a tin goose” and then couldn’t pay the bill!

    • That explains the revolving-door of all those roommates AND why he kept borrowing from Jodi.

    • No wonder he could afford that closet full of clothes, the BMW, etc. I saw alot of that, used to live in Vegas. Several of our friends had 2 or 3 mortgages on their homes, lived like rich folks. Travel here and there, fancy cars, boats, I always thought, wow, I must be the only one here thats broke! lmao….. and now their like hundreds of thousands upside down, can’t refi, can’t sell….stuck, or they walk away and declare bankruptcy.
      Seems like the SW had major issues with this. Now you can buy a house down there for under 100k

        • agreed, just seem to see it more down in the SW then places like Seattle. Maybe its because the home down there fell in value so much. Up here, we didn’t see our home depreciate like there, so its more obvious.
          The stats show that the SW was the foreclosure capital though for sure. Vegas topped that list for years.

    • 2006 in Arizona, a house was like a giant ATM. Want a new BMW… no problem, just refinance. Want a boat and some ATV’s… why not, just take the money from your home’s equity.

      The whole economy here for about 4 years was buying and selling each other homes with make believe money. Basically one giant ponzi scheme.

      • The way it was explained to me by my ex’s Dad who is a Bishop: Mormons do not believe in Hell but multiple levels of Heaven. So Hell to them is the lowest level of Heaven. It doesn’t make sense but that is my understanding. I thought Hell was Hell and definitely not a part of Heaven.

      • JC- You are so correct on that one. I did research last year when my little girl suddenly became afraid of ghosts, because the kids in school told her the school had a ghost. The Bible has many scriptures that discuss exactly what you stated.

As a doctor again I have seen people hurt badly in the head without losing consciousness and continuing to make purposeful movements. And just how much of the brain did it involve. I thought it barely hit the frontal cortex.

    • There was aspirated blood and blood/mucus mix (spat out) all around the sink in that bathroom. You can even tell a difference between the two just looking the crime scene pics. I’m a nurse and I call BS on this doc’s testimony!

    • NH, My question as well…. the juror should have asked ” specifically, head, brain” injuries. Now the info that the 100 or so autopsies he did which involved a 25 are left open. Why didn’t JW question him on that. Seems trial was rushed today.

    • Good one. This shows exactly what the frontal lobe injury would do. Yes, he would have been stunned but the blood came from the face and he would have choked on the blood more than he would have been incapacitated by the brain injury. And from this I am not even convinced he had a brain injury that was sufficient to do anything.

    You have to take into consideration the adrenaline surging thru the body. The fact that the body doesn’t realize it’s been shot for a minute. Not everyone is going to be incapacitated that quickly.

    • I’m guessing as it relates to JW last questions, that if the gun shot had happened after the throat was cut, it would have been impossible for the bullet to have passed through at the angle it did. She is smart!

    • YES! The juror questions indicate they are NOT buying his theory. He evidently does not recall the PHOTOS…SO he mustn’t have taken them into account when he did his final report. I can’t believe that NO ONE asked…”If the brain was like pudding how can you be certain, absolutely CERTAIN that the bullet fully penetrated the brain to the extent of rendering TA fully incapacitated immediately?”

    • Wouldn’t you? Horn is so dangerous. He made mistakes in his autopsy, and fell under the spell of Martinez.

      But I think the defence still has resources.

    • Yes I believe that’s where is stopped – in over right eye, downwards towards left cheek where it stopped.

  54. Why didn’t jw point out the bathroom sink scene and all the blood splatter, to prove that he was not knocked out with the bullet, but was able to walk over to the sink and spit out blood all over?

    • I think intro that the jury will remember the pic of the sink..I did when JW was crossing him about the blood coming out of sinus and or mouth.

    Not so sure about the tone of the questions…

    • “How frequently have you seen injuries from a .25 calibur weapon?” Asked b/c (imo) they may feel he doesn’t have a lot of knowledge in this area.

      “Can you explain why you think Travis was still alive when his throat was slit.” Again, not a lot of confidence in this doc if the jury is asking him to explain himself.

      “What could happen that could allow Travis to still move well?” They don’t believe doc’s story about being immediately incapacitated.

          • LC, That is why I got a dog. I grew up afraid of them and didn’t want my children to be afraid…now they love dogs and are comfortable with them. I’m glad because having a fear of dogs can be debilitating at times. My dog is awesome. Boston terrier.

              • My dog is a Boston Terrier…the name is misleading though. Bostons don’t have any typical terrier behaviors; no hunting skills, not an alarm (barking) dog. In fact, they were initially bred as fighting dogs but the opposite happened… they are considered “The Gentleman’s Dog” because they have no purpose (job) except play and snuggle and love everyone.
                I’m sad to hear your terrier is in poor health 🙁 13 years…I feel anxious for you.

  82. Good morning everyone.

    So, my 14 year old son and I had some fun last night. We did some experiments on 2 book shelves.

    both bookshelves are the same

    -Each complete unit is 84.2 inches high
    -Each unit is 36.4 inches wide.
    -Each unit is 14.5 inches deep.
    -The material of all wood pieces are made from pressed particle board and covered with a thin paper finish.
    -The pegs are 1.2 inches long, round, with no “flat” side., leaving approx. 1/2 inch sticking out, when they are placed into the peg holes.
    – Peg holes are 2 inches from the front of the unit and 2 inches from the rear of the unit.

    The unit is secured to the wall with wall anchors.

    All shelves are empty.

    We placed shelves 1 foot, 2 feet and 3 feet off of the ground.

    My Son is 14, he weighs 121lbs. he is 5-7.

    1st observations showed that the shelves, when hand weight was applied at the leading edge, would NOT flip up the shelf. I am 220lbs, 6-3. I was able to get the shelf to “flip up, but it was only after figuring out the correct angle to apply MUCH pressure to, using my hand. It was more of an “in and down” pressure, almost as if I was “gripping” the shelf. It had to be applied directly to the top corner of the shelf.

    2nd observation. My son wore tennis shoes. When simply “trying his weight out” on the lowest shelf, he was able to get the shelf to tip. When trying this same thing with his shoes off, he was only able to get the shelf to tip when he pushed only on the very edge of the shelf.

    3rd observation. My son tried to grab a ball i placed on the top of the unit. With only instructions to “grab the ball off the top”. he was able to get the ball without using the shelves at all. He used a method of “jumping and pulling himself up with the non-ball hand”. It appeared that this was in fact the simplest way for someone to get this ball.

    4th observation. I instructed my son to NOT use his “non-ball grabbing hand” to secure himself in any way. He then used the 2nd shelf, which was 23 3/4 from the floor. We repeated this a total of 13 times. The first 6 times he was wearing his socks. When he placed his foot near the “peg edge” of the shelf, he popped right up and grabbed the ball. The shelf made no movement. We did this same thing again with tennis shoes on. The shelf again made no movement. Finally with tennis shoes on, i instructed him to step on the middle, wear we had placed a piece of tape, marking the center of the shelf. The shelf broke. It broke on the front left edge, above the front Peg. The board itself did not snap, but rather the hole that holds the pegs “ripped” or “chipped” through and the board flipped forward. (consequently his foot fell down to the bottom shelf breaking it in half)

    ( replaced shelves, same unit)
    5th observation. I instructed my son to attempt to “flip the shelf, WHILE grabbing the ball”. His first attempt failed, and he simply grabbed the ball. The second try (with tennis shoes on this time) he was able to “flip up” the front edge of the shelf, causing his shoe to “stick” to the board and slammed/slid forward off of the unit. We attempted this several more time with the results being whatever we chose. He was able to make the shelf stay, or flip up, depending on how he applied the pressure and how “deep” he put the toe of his shoe onto the shelf.

    New unit
    6th observation. With empty shelf’s and shoes on, my son placed his body weight slowly onto the lowest shelf. It held his weight with no breakage, while he put all of his weight on the shelf.. Next, he “quickly stepped onto the center of the shelf” to see if it would hold all of his weight, the peg hole again ripped out. However, the shelf started to “tip forward” just as it “ripped out”. (this became key to my conclusion)

    7th Observation. I then asked him to “climb” the shelves, as if they were “steps”, using his hands on upper shelves or the top of the unit, to assist with balance and weight distribution. He was able to do this, if he did it very slowly. I instructed him then to do it in a “mad rush”, but making sure to use each of the lowest 3 shelves. This did not turn out well, as it was hard for him to make his body take such small steps. (this also helped in my conclusion) In a rush, stepping all 3 shelves, using hands, he was able to make the first 2 steps, but the third shelf flipped up in the back then slammed down, breaking both Peg Holes in the back of the shelf.

    8th. finally observation (playing around) I (220lbs) was able to grab the ball when using my empty/open hand to hold the unit for support. I did this on all 3 levels of shelves. I placed my foot at the “peg edge” each time. I was not able to do this without using my empty hand to secure myself on the unit. All 3 times the shelf broke2 times at the “peg hole” and once it broke almost in the center, although i had stepped near the “peg edge”.

    We had 1 shelf that was not broken yet, so we experimented with “depth” vs. weight, to see were the “sweat spot” was that didn’t flip the shelf all the way off the unit, but did bring up the back edge.

    lastly, we place a “full to the rim” cup of water on the shelf and had my son “grab the ball” using his free hand to secure himself with the top edge of the unit. NOT A DROP OF WATER SPILLED!

    So, what did my son and I learn? I concluded that it is VERY possible that Jodi could have used the shelves as a step and not break them or flip them over. I concluded that it would have been MUCH MORE likely that she would have “broke” the shelf before she “flipped it over” And that it is HIGHLY unlikely that she could have flipped it over if she didn’t have “grippy” shoes, such as tennis shoes on. We were not able to flip the shelf, when trying, without breaking it first, when we had just socks on. We concluded that the spot on the shelf and how deep you put your foot in changed the outcome. We placing the to only 1 in deeper than “just on the very edge” allowed the shelf to be pushed on without flipping up. When explaining this i could see someone saying they just put their foot on the “edge” of the shelf, as Jodi explained, because it only took 2 inches or a tad less to change the weight from “flipping” to “over the front Pegs. We concluded that if the weight was applied over the front pegs that the board would break before it would tip all the way forward. We concluded that it made a huge difference if we used our free hand to help balance, distribute our weight as we made the step.

    Finally we put the shelf at the 3 foot height, carefully using both hands i was able to step up, WITH BOTH FEET,(all of my weight) onto the shelf, i then was able to use one hand to SIGN MY NAME on the top of the unit. It held long enough to sign my entire name! I know this doesn’t prove anything that Jodi said she did, but it held a man with ALL of his body weight that is twice her size on a shelf HIGHER than she needed for several moments, not just a “quick burst” of no solid weight.

    IT IS VERY LIKELY THAT JODI COULD HAVE USED THE SHELVES TO STEP UP. She probably would have had to use her free hand to help secure her and the weight. She most likely would have had to step on the side of the shelf, near the Pegs, not in the center. Unless the attempt had broken the shelf or failed, it would not have disturbed anything on the shelf, unless her foot pushed something back. The action on the shelf would cause no movement.

    • Forgot to add, that maybe she didnt even use a step…she was afterall very rushed.. My son made it obvious that he would not have even used the shelf. he was still able to get the ball when it was in the middle of the top. Only when it was pushed to the back was it hard for him, when not using the step.

    I saw the best comment to describe what happens when somebody is shot with a .25 caliber. And this sums it up. He said if you shoot somebody with a .25 caliber gun and they find out about it, they’re going to be very upset. Bwhaha.

    Then there was a guy who did extensive research on hand gun stopping power (Evan Marshall) and he took the actual reports from emergency rooms to document his data. He wrote significant books and is considered by many an expert on this type of research.

    • That may be so, and in fact is. I actually own a copy of Marshall’s book. But you can’t expect the jury to know this. The defense needs to have brought this out, and they didn’t.

      • We have to have faith that the jury will be able to reconcile his horseshit with their own common sense. These are not dolts on the jury–at least not the ones asking the questions.

        It will be common sense that a stab to the superior vena cava is not a wound that is going to produce blood immediately in the mouth or nose, especially if the person is upright. It is like stabbing a jugular or carotid main artery and would pump blood directly out of the wound. So the blood in the sink from stabbing in the shower does not compute.

        The shot at the angle Travis was lunging at her puts the bullet in the exact location with the exact trajectory of the bullet path. And it won’t be lost on at least one of those people that the State did not explain how blood was spattered ALL over that bathroom in every corner without a fight.

        It won’t be lost on at least one that the the chief detective in the case testified in a hearing that the ME told him the shot was first. It won’t be lost on them that Martinez didn’t want Jodi to say where he got that gun. It’s not heresay if she’s testifying to her own personal knowledge and it shouldn’t have been disallowed.

        There are a ton of things that don’t add up and no matter how Martinez tries to describe a sphincter as not being an asshhole, it’s going to be readily apparent to one of those twelve that he is.

  91. Dr. Horn is clearly testilying. He won’t even concede that it is possible for a person to function after being shot with such a small caliber gun, no matter how minimal the chance. He cannot be 100% sure and the jury knows that. This jury is not stupid. I think we should research this matter and post our findings here so they have “ammunition” next week. 🙂

        • JW and KN are doing an excellent job. JW came into the case later on and the amount of work done on the psychology and dv with alv and Dr. S. is mind boggling. The autopsy report doesn’t lie or change per JM’s whim. Page 1 of the Autopsy Report lists the causes of death. Findings are listed in order of significance to cause of death. Knife wounds are listed as primary and the gunshot wound as secondary. The brain is described in the report as having more preservation than he described today. The jury will have the autopsy report and it speaks for itself.

  98. I think the defense has done a great job in many ways, but today was the proof in the pudding!

    A good attorney does not show all their cards while the witness is on the stand to rebuff or argue what they are saying. JW obviously has alot of things she can bring up during closing, which is where she needs to do it. This garbage of Det. Flores lying on the stand is a big one, but the Dr. changing his testimony from earlier is probably the biggest! Although, we as the viewing audience would love to see her jump on every word, its not the way to handle to it.

    We all know this trial can go either way, but I’m confident in the way this defense team has handled themselves, and if the jury convicts on circumstantial evidence, then there is nothing that can be done about that. The issue at hand is PREMEDITATION, she’s already admitted to killing him. The defense has filed for the charges to be offered as manslaughter, and if the judge was smart, she would allow it.
    There is WAY too many conflicting testimonies on the states part to even get close to beyond a reasonable doubt.

    • Totally agree, Melvis. I also want to add that the way it looks to me, the D has tried this whole case with appeal in mind. They have made a really good record of an utter tornado of a case, and teed it up really well for the appellate team, should it come to that.

My own perspective about the Defense has been a mixed bag. Some days have been harder to watch them than others. I have not understood why some expert witnesses were not brought on board. This was a critical day imo because again the jury is gone for the weekend and they have these autopsy images left in their minds, along with Horn’s biased fabrications. I wanted JW to go after Horn with the same determination she had with totdoc.

    • Last week, there was some kind of facial expression or body language going on one day during questioning a witness. The live stream I was watching showed the defense table starring over at the jurors several times. It was obvious something was going on that they did not like. Well, I’m guessing..if this was the same juror that made facial expressions during Nurmi’s cross with Deanna R., that may of been enough to get her dismissed.

  104. Medical examiner was a huge piece of this case. I think this was a big day for a defense. In most people’s minds crime scene evidence tells the story and is weighed heavily during deliberations. It’s clear the prosecutions explanation doesn’t fit 100% with jurors based on the questions they asked, pics they’ve seen and now a wispy washy ME.

  107. On HLN, Def Lawyer Brian Silbur (I think) has some excellent arguments about the gunshot. DT should have done a better job with researching on this, knowing it was coming, and rammed that info down Horn’s throat! This was the crux of the trial – the sequence, etc. What the heck was up with the DT? Can’t they consult with people who know more on this and other matters that they are low on info with? I am furious. They should’ve had their foot on his throat, and also Flores throat and never let go unless and until they coughed up the truth. P*SSED now.

I have heard pathologists even on HLN, SHOCKING! who say that he wouldn’t have necessarily been incapacitated. Even JVM interviewed someone who knows people have gotten up walked around with a gunshot in the brain. Why alternate information to show this was never introduced to the jury is beyond me. And one of the reasons I eventually came to this page – among many – is the fact that we are supposed to believe she attacked with a knife while he was sitting in shower with his knees bent and just inches from his chest. Yet we are supposed to believe that heart wound came first, with enough force to deliver a deep enough wound that would have been fatal eventually. Don’t believe that BS story for a second. Makes no plausible sense when you look at the way he is sitting. In addition, how is it premeditated murder if she used a damn knife? She – according to the prosecution – went through all the steps of making sure she didn’t get caught, but yet runs the risk of using a knife and getting hurt or killed herself when she could have just used the gun first? If I were to believe the prosecutor that the knife came first, this is 2nd degree at most for me. No way can they convince me it was premeditation because of a missing .25 but then turn around and say she killed him with a knife.

          • It DOES make sense Ashley. Really even if JW didnt pin Horn to the floor, its true what you say. I hope the jujury see it that way too. Its even more apparent that it WAS NOT a premeditated act.Really who brings a gun and ends using a knife instead and risking themselves to loose and die. Doesn’t make sense at all, I dont know why Martinez even went this route too.

      • I agree with you Melvis. Anyone who is closely follow can see……there a reason why JW stopped. She made her point and moved on…….ME answered the same question three diffrent ways at three diffrent times.

        • I don’t know that if that’s enough though Moni. I originally believed the prosecutor on this until I saw where a pathologist said he could have still gone on (somewhat dazed and disoriented) after a gunshot wound. Only then did I question everything. Had I never heard others say that, his three different answers may haven not been significant enough for me, because regardless of how he worded them, it’s still the same answer, Travis would not have been able to walk around after that shot.

          • I would have never had to hear that even. As I heard a story about a burglar in
            Atlanta GA just last year that broke into a home an the woman hid her children an
            herself in a closet when the intruder opened the closet door she shot him in the face
            4 or 5 times with .25 he then proceeded to leave get in his car an drive to the hospital!

            The cops stopped him in route! so I knew when they said .25 big possibility of LIFE
            after the shot to the face.

        • Totally, Moni. People, even without realizing it, wait for that Perry Mason moment. It doesn’t happen. Witnesses don’t “break” on the stand, despite what Vinnie Politan says. If they get pressed too hard, they are more likely to say something conclusory that contradicts what the cross examiner is trying to get out of them. Lawyers should never give them a chance to explain themselves if it can be helped. Willmott is the picture of discipline in this regard-a shining example of good trial practice skills. We can never predict what a jury will do, but as far as how it looks from the sidelines, JW/KN are a study in “How to Do It” and JM the very emblem of “What NOT to Do”

          • As much as I like JW, can’t help but say they should have had their own M.E., so even though I watched all of his testimony BOTH times, I don’t see how he was tripped up enough to convince a juror that he was wrong, because as you said there was no Perry Mason moment. Hence the need for their own M.E. or at least some statistical evidence to show he was wrong.

Getting the chance to read other comments now and seeing where people think she’ll really be able to bring this home in closing. I still can’t help but wish they had brought in their own.

  108. I don’t remember Jodi saying anything about how close TA was to her when the gun went off. She said he was lunging foward with arms out towards her and eventually grabbing around her waist. That doesn’t mean he was at point blank range that would cause the stipling.

    • Exactly! they keep saying that about the stippling around the entry wound. But why
      did they not find gun shot residue on her bloody hand print also?

      He was not right up against the gun when it went off. She does not know the exact
      feet he was from her when the gun went off either. An the body was washed off.
      An we know after you wash your hands the residue is gone also so why would
      Travis’s Head be any different?

      Those guns also you can’t shoot one efficiently if further than a few feet away
      they are not powerful at all. If she had it right up to his head like they want to think
      I would think the bullet would have came out the other side possibly. But the further
      away the less powerful the shot with a small caliber gun.

      very close up not in a weird place like above the right eyebrow going downwards?

  111. HLN is breeding hate in a country that has more than its share of it right now. There’s all the strife cuz of the depressed economy and the middle class being thrown under the bus. There’s shootings going on at schools, and bombings at marathons. Republicans and Democrats can’t get along so we can’t get anything done to help the economy.

    Then HLN with their biased views on this trial, are inciting people that mostly do not know anything about the trial. They follow it when they get home, and get their opinions ruined by Nancy Disgrace, Jane “very mouthy mitchell, and Dr. Smut.

    This breeding of anger from people who may already be very angry is dangerous. We all know that most of the people in this country own guns of some kind. If anything were to happen to Jodi or her attourneys, or anyone who testifies for the defense HLN would be in for a very large suit.

    They have a responsibility to be unbiased to prevent this kind of hatred.

    • Agree 100% Dave…and even scarier is the fact that the FCC will do NOTHING against them, I’ve tried. They say “news distortion” isn’t grounds for any penalty. Even if they are registered as a NEWS station, they are allowed to do this.

    • I totally agree!! They present themselves as a legitimate news agency, so they *should* be acting like one. Not inciting public outrage when there’s already a problem with anger turning to violence.

      The irony is that they *pretend* to care about stuff like bullying and discrimination. But that’s the very stuff that’s written all over their own programming!

      They have the resources and influence to affect people – and like Krista mentioned yesterday, not everyone has the Internet or 500 channels to choose from to get their news. I have very basic cable and I have HLN, FOX, ABC, and NBC to get my news from, and I am a fan of none of them. Sad part is, I normally just watch PBS which is free anyway. But I have to have cable to get Internet. See what I mean??

      • I do….I had that same problem for quite awhile, until I started paying more attention to the internet and getting my news from there.
        CSPAN is about the only place left where you can see things for exactly what they are. Too bad, they don’t do more news…:{

        • I lived without cable for most of my adult life, until I wanted to upgrade from DSL and was required to have the minimal cable package to get cable Internet. That was five years ago.

          Before then, I was happy reading my news from the Internet, until they started adding comments sections. It seems that the “news and views” culture started before HLN, who took it and ran with it and that’s what we’re seeing now.

          I was never interested in Facebook or Twitter, although I bookmark a few people and follow them. But the electronic lynch mob HLN has formed on those places has made me swear them off for good. It’s such a cesspool of hate and bullying, it’s just not worth it.

      • Do you have FSTV or LINK? These are both good news stations, but they cover more international stuff or Federal level issues. Amy Goodman is my hero, I was wishing she would cover a little of the Arias trial with respect to the media and haters, but I have not seen any coverage.

  112. Jurors are not allowed to tell anyone what trial they are serving on. So say Juror #3 goes home tonight, and hubby starts telling her something that he read online or saw on tv. Then what? If the juror ignores hubby and walks away; he may keep prodding her and spilling beans about what he heard about. The juror is not supposed to say I cant talk about that. That would be a dead giveaway as to what trial they are serving.
    I find it hard to believe that the jurors husband or kids or whomever would not know what trial the family member was on. I also think that at least one if not more of them HAS seen coverage of the trial. There is just no way no how that has not happened.

It’s a death penalty case, and I don’t care how much people complain about the money it takes to defend her, our system of justice is set up that everyone gets a fair trial. Without another M.E. it’s not fair. Maybe that’s an appealable issue?

  113. I found out via twitter that Juror 8 was in the courtroom up until the dog came in and there was a break? That he was dismissed in the mean time and only missed the very end, admonition and adjournment. It was also noted that he put a question in the box this morning for the doc. I missed this mornings testimony but I thought i was pass that on.

      • Very good point. This happens all the time. And a .25 clipping the frontal lobe or temporal lobe would not have incapacitated him. Like I said he would have choked on the blood first.

          • Studies have proven that individuals who have suffered a frontal lobe brain injury often show drastic changes in both social and sexual behaviors. When comparing damage to the frontal left and right lobes it appears damage to the right lobe can lead to pseudopsychopathic behaviors.

Reasonable doubt about why and when she dyed her hair. Can’t tie this in to pre med.
    DV – treatment psychological and emotional abuse has been proven through written words by TA
    Control – exerted by Travis, she moved to Mesa, she joined his church, she had to socialize with his friends, not hers; she became so intertwined with his personna that she lost her own.
    Unfortunately imo, Jodi’s testimony will not be taken seriously because of her capacity to tell lies. I think it will come down to forensics and the pros has not done well in this regard. Sadly, this man used and abused Jodi and I think something happened on June 4th that set off a physical altercation and she lost it…… As far as juries go, one never knows what they will do. It has been an ugly trial and I am really shocked at just how vicious many people have become over it. It doesn’t leave much hope for the human race if people haven’t evolved from the “Roman gladiator days”.

    • Jodi’s going on the stand helped bring in a lot of hearsay through the experts, though, so in the end it was probably worth it. Plus it gave her a chance to humanize herself to the jury, which will probably help if there is a penalty phase.

    The bullet entered just above the right brow through the skull and ended up in the left cheekbone right above the mouth. Unless its path curved through the brain — SOMEHOW –, it looks like it didn’t even enter the brain or just nicked it above the brow.

      • I am a doctor, radiologist, but I am embarrassed by his testimony and I am not a forensics pathologist by any means. He cooked the evidence and was speculating. Sad to see someone do that.

    • Not at all. I think if anything it clipped the brain. The facial injury would have been bad and bloody but it fits in beautifully with the blood evidence in the bathroom. No doubt in my mind it was first and he kept coming.

      • This case about Phineas Gage is a classic case of front lobe injury I learned about in my anatomy classes and it keeps coming into my mind today. About a guy who survived frontal lobe damage. His story is much different but shows how you can still live with this type of injury.

  119. If the jurors only knew one thing–that the bastards at Maricopa County changed the bullet from being first to being last only AFTER she changed her plea from not guilty to self defense, it would be a short deliberation.

I feel safe in assuming you wouldn’t feel that it was right to try to ruin the careers of third parties who had nothing to do with the crime.         • No, you are right, jjb. For the life of me, I can’t understand what they would really gain in the end. As much as they will convince themselves that they are deserving/entitled to any of it – eventually its going to rankle in their soul – leaving them with no peace. I get the sense when I watch them ‘react’ to things in court that its not coming from a good place, as in, it rarely feels genuine for me. I could be wrong. It might have been more impactful if they had remained more stoic. Just know how I would’ve not reacted.

  124. If we can’t see the track through the brain, then there’s no way of knowing if the bullet passed through the brain.

    The gunshot would was right above his eyebrow, and lodged in his cheek.

    At that angle, even if it passed through a small portion of the brain, is not a kill shot by any means.

    I have a hard time believing that an intruder in GA can get shot in the face 5 times and walk away, but Travis would be immediately incapacitated.

  126. My uncle was a mortician-as well as some of my other family membres and I have personally gone with them to pick up the deceased. And, some of them were victims of gun shot wounds to the head. In fact, one was a suicide victim whose body was not discovered for two days Not only could you smell the decomposition from the front of his apt bldg.—-with the doors closed!—- when we went to ready him for transport the brain matter had already liquefied! Making it virtually impossible to tell whether there had been any brain damage or not! So, if TA’s body was discovered later than that, there would be absolutely no way in hell that Doogie ME would be able to tell if there was any brain damage or not! Go get ’em JW!   127. So, basically the case has been argued. We have one day of testimony left, but that is to refute the DR.D testimony with a defense witness. Since we already don’t believe DR.D, the testimony will mean nothing to us here, it will not change our opinion. Therefore the arguments, as far as info for us to debate, is finished.

    Now that OUR case is over…let’s talk:

    To start, before the trial began, the defendant was innocent of Murder 1 and Pre-meditated murder. (Innocent until proven guilty)

    Then evidence came in, during trial, to attempt to prove the state’s case for M1 and PM. (and possibly added lesser offenses of Murder 2 and manslaughter)

    I know this will be hard for some, but let’s debate the evidence. (Just like there are people blind to the evidence that says she is guilt, we also have people here that will ignore the evidence and simply say she is innocent) I am asking for truly open minded thinking. No prejudices.

    Has the state proved beyond a reasonable doubt that this was M1 or PM?

    I am going to hold my opinion and reasoning until later.

    if we could try and keep this in some sort of format that everyone can understand, that would be great. I would suggest:

    Evidence that leads to PM: (Facts that PROVE PM)

    Evidence that leads to M1: (Facts that PROVE M1)

    1) She has admitted that she didn’t mean to kill him, but that she did in fact cause his death. (Obvious evidence, so I added this to start)

    Please keep in mind, and even though I WHOLE HEARTADLY DISAGREE WITH THIS, the state of AZ does count Circumstantial evidence the same as primary evidence. So please feel free to add evidence that is circumstantial, as the jury will be instructed to do the same we deliberating.

  128. I still see nothing in the news about a bomb threat and I would think that they would have posted something if that were the case.

    So now I am left wondering why, if the trial has to be wrapped up on one day of testimony, the judge would recess until next Wednesday? It makes no sense. The defense will have almost no time to present their surrebuttal, unless that was the point all the time (which I think it is).

    • MB, they said the dog was a standard procedure they do everyday but today they where running late.
      As far as the day being over early, idk but I wouldn’t be surprised if the reason was to give less time to the defense. If they needed to take a few days with dr Gaffner will they nit be allowed, did the judge give them a time to do the rebuttal?

    I have been reading along your comments for the many days of this trial. Also I have read just a few of the awful comments posted under the youtube sites that show the trial coverage.

    First let me say that I live in Alabama now and have had PTSD since 15 yo due a serial killer in our high school and a personal run-in with him. I am conservative in life and politics and most importantly, faith.

    That is just a summation of “me” so you can put me in a catagory in your own mind’s eye. Oh, and I am white and 49 yo female 🙂

    I want to share some thoughts with y’all.

    1. Listening to the prosecutor frightens me and makes my PTSD symptoms worse.

    2. Y’all are really nice here by comparison to the ‘haters’ as you call them. I honestly do not see how anyone holds onto and keeps fueling so much hatred.

    3. The horrible comments said about Jodi, Willmott, Nurmi, and the variouse defense witnesses have been filled with hatred, bile, and violence. Much like the typed words of Travis to Jodi and completely opposite to the calm replies from Jodi to Travis even in the heat of the moment. Since God takes every word said even in secret and calls the unrepentant to account for those words, it would seem that the ‘haters’ are in a world of hurt and need to fear more for their own destination than Jodi’s.

    4. HLN is cartoonish at best and is so vile to me because the subject matter deals with life and death. They make a mockery of the American Judicial System in front of the whole world and bring shame to the best and most hopeful system man has ever been able to come up with. While far from perfect, I would not trade it for any other judicial system in the past or present world. I shudder at the thought!

    5. Travis Alexander was a very very bad man. There is solid evidence of that. And while some may say, “but he wasn’t deserving of death”, in the sense that we all are deserving of death for our sins, yes he was. The real question should be and is, “was Jodi in the right or wrong to take his life?”

    6. The two defense attorneys are so nice aren’t they!!!! Very kind and respectful and professional.

    7. I had a longstanding run-in with a borderline personality disorder sufferer and he (passed away now) acted to a T like Travis Alexander. I just wanted to mention that because I thought it to be very ironic that the disorder is given to Jodi.

    8. Finally, I would like to thank you for the opportunity to express my thoughts and to let you know that it is a high compliment to you all that I am willing and able to do so with regard to my PTSD. I would never venture out like this if you all did not seem very level-headed. 🙂 and kind-hearted. 🙂

Jodi was indeed a very foolish young lady to go back to that man, but we have all been young and foolish. And if there is any punishment to be served for it, these years in prison should be enough.         • Welcome Holly, I was hesitant to post here also. I’m not a fighter and was shocked to read the hate on the other sites before running across this one. I’m glad I found it because I would most likely of tuned out to the trial due to the witch hunt effect.

          I completely agree with you that Jodi’s spent enough time in jail for this crime that she’s admitted to. There are many more true evil criminals in this world who’ve done far far worse.

          I’ve also done foolish things in the past and I’d bet I will do foolish things in my future. I know if my past was examined under the same microscope as was Jodi’s JM would have a lot more that I’ve said and done in my lifetime that he could spin into making me appear to be the worst foul mouthed psychopathic creature on earth.

          I’m glad you found this site. These folks here are bright, funny, kind, compassionate and have great taste in music! Plus they have the cutest furry family members ever 🙂
