The jury needs to know who you are. they cannot only define you by this self defense case.

      • Jean, I was thinking the same thing about Jodi Smiling, but then again they would trash her for smiling!!!! So, the poor girl can’t win. But she is looking better today, white is a good color on her! Go Jennifer, you are doing an AWESOME job, she might need more pitchers of water, because she is very nervous that they are punching holes in her story!

          That dang Dr on the witness stand (don’t want to remember her name!!!) is so degrading and sarcsatic when she speaks, isn’t she? I think she is going to burn something special when she dies one day. Because you don’t lie and play make believe when a persons life is at stake.

    I think Jennifer is winning points consistently although she hasn’t landed a knockout blow (yet). She did get Demarte to concede yesterday that she wasn’t an expert on domestic violence. Continuing with the boxing metaphor, that was at least a knockdown. I believe Demarte protested she was an “expert in psychology” to save face. To me, that was like a GP saying: “I may not be a specialist in medicine but I’m an expert in general medicine.” One has great depth in a specified area; the other has general knowledge but less depth. “That was big (in my mind at least).
    Jennifer also poked holes in the BPD diagnosis this morning. While Martinez screams and shouts and rubs people’s faces in each point he wins, Jennifer methodically took Demarte’s diagnosis apart bit by bit like a surgeon compared to Martinez’s sledge hammer style. Hopefully, the jurors note the difference.

    • I was glancing around FB a bit and looking at comments, and sure enough, there ARE folks mixed in that say Ms. Willmott is kicking Tot Doc’s ass……….and as soon as they do, they are removed, blocked, and threatened.

      BUT- they are out there… we just need ONE on the jury, folks!

      • I’m enjoying all the points JW is bringing out but they are farely subtle. I think JW will pull all the contradictions, etc., together towards the end but should be done with much less subtlety

      • Well she did earlier. JD asked her to repeat the question in a different way (the nerves, shes been doing this since yesterday), and JW said, NOOOOO…… AND ASKED THE SAME QUESTION BUT MORE DIRECT.
        Who the hell does she thk she is, asking the lawyer to REPHRASE her question, BITCH PLZZZ

      • It is possible for Jodi to have both PTSD and BPS. After 6 years she may have overcome these diagnoses’. Let Jodi go home and have a life.

      Agree on the DV expert, or lack there of admission. My last post on the old page said that. That was bigger than Samuels conceding he should have re-tested.

      I didn’t really get the whole BPD thing. I think little Doc pretty much didn’t capitulate there and seemed to hold her own there.

      Hence my rams butting heads comment from the last post (which sadly is now on the morning page)

    • JW had jd on the ropes yesterday during the issue with her lack of memory on what article she had read – but jw did not go in further to delve – and then missed the opportunity by going into something else. I wish she had pressed her ‘so hard against the ropes’ yesterday, and jd would’ve had to concede (before any additional coaching from her MASTER).!

      • So you saw that, too? I happened to switch to that tab for a second (I normally just listen at work so no one in management can complain about me) and I saw him at the stand with her, going over a paper and (apparently) telling her what to say and what points to make.

    I’ve been trying to talk with a CEO today about a job and watch the trial. I’m hoping I didn’t sound as scattered as tot doc….lol.

    P.S. I even waited to call him back until a break and then the trial started back up.

          • I am lucky that I operate a business out of my home and can adjust my schedule as I go. I get up at 7a.m. and work until the trial starts at 12:30, and then get in more business work during the court lunch hour. It does keep me from doing errands sometimes. Hey, I am “TrialWatcher” and this isn’t the first time I worked my life around a trial.

            Next up….if this trial EVER ends, is the George Zimmerman/Trayvon Martin trial in June…..or if they televise the AEG Michael Jackson trial. It is better than getting hooked on fictional soap operas. lol.

            • If the Zimmerman trial is broadcast on the Hateful Lies Network, I am hoping that it will lead a lot of people finally to realize the kind of brainless, biased, toxic garbage HLN coverage consists in.

  4. I cancelled my ballroom dance lesson this afternoon because I don’t want to have to delay hearing even one word.

    • Hahah RB, its ok. I scheduled my kids dr apt for 7:45 (very early for us), so that I wouldn’t miss anything! Hahaha …. im sure others have done crazy little things as to not miss this trial either.

      • Yes. I am planning on rescheduling my pain management doctor appointment which is set for April 30th. I don’t think this trial will be over and a verdict reached by then.

    First off, many thanks to all of you who make this site possible via creation, maintainence and/or participation.

    Secondly, my question: At the end of the trial, if/when Jodi is found not guilty of all charges, does that mean she walks right away, or as soon as she’s processed out of jail like Casey Anthony?
    Are there lesser charges on the table other than murder 1?

    Sorry if I’m a little behind, I follow what I can timewise.

    I’d also like to say that I saw a video of a news interview with Juror No. 5 and I was really very impressed with her. The lead-up to the video made it sound like this former juror was going to sing like a bird to the media, but she gave a good interview and said she was reserving comment on several questions until after the trial closes, despite not being under any gag order or other restrictions from the judge.
    That being said, I thought that was rather upstanding and made me all the more hopeful that the jury members, or at least one because that’s all that’s needed, are doing an excellent job and taking it as seriously as it must be taken and have integrity.

    • Yes to the lesser included charges.

      They cascade in AZ and are automatically included. So murder 2 is in under M1, and agrravated manslaughter under M2 and manslaughter under that and so on.

        Are you sure about that…the charges being automatic? I was under the impression that since she was charged with either M1 or Felony Murder, that in order for other lesser included charges to be possible, the Judge would have to instruct the jury of that when she gives them all of her instructions before deliberations.

  7. Waves hi to everyone. I’m at work but have caught almost all of this morning’s testimony (but not all your comments) Our girl Jenny was getting a little testy with tot doc (love that name and I’m soooo stealing it). She needs to do more of that.

    Meanwhile, tot doc won’t conced anything. At this point, I think she’d have an argument about whether the sky is really blue or not.

    So, are they late starting AGAIN?

    • Hopefully the jury has noticed she is nothing but a liar for the prosecution. If she was really unbiased she would not be arguing with JW in any way.

      She is simply a mouth piece for the prosecution.

      Tot doc is biased for the prosection, there is no doubt in my mind. Instead of looking at the whole picture she picked “data points” to confirm what the state wanted.

      For me no matter how I look at it she wouldn’t have been a threat to anyone

  14. To any of the legal eagles on here. Can the obvious lack of knowledge and incorrect information (or some of the opinions) given by tot doc raise appellate issues?

    There are answers, and statements, she has made to the jury that are not correct and could only serve the purpose to inflame the jury.

    • No kidding! Could not agree more. And somehow HLN talking heads say she is not biased! I wish we had a LIKE button here.

    • I wondered about that, too; if that might be the reason JW is being so “nice” so that this witness can kind hang herself with her words and demeanor and they have it to use IF appeals should be needed, just to cover all bases as defense attorneys.

      I LOVED though when JW caught her up with the term “pattern” in the morning session and you could see Nurmi behind her trying not to grin completely! 🙂

    • I believe they could argue on appeal that the trial court erred in qualifying her as an expert — assuming she was qualified as one in domestic violence or PTSD — especially if they objected to her qualification at the time JM submitted her as his expert. If she was simply qualified at a psychologist, they probably wouldn’t win though unless they can prove her bias. Experts are supposed to be there to help the jury understand.

    • Goes to judicial error. The judge is the gatekeeper to expert testimony. If the defense had objected to the Doc being an expert, and if the judge still let her on, then there is an appellate issue if the defense can show that she was not an expert.

      I now make homonym mistakes all the time and find it horribly embarrassing. I graduated with a degree in English and used to know the difference LOL. My mistakes have to do with a medical issue and not slowing down when typing. I have a touch of dyslexia thrown in. As you know, there are hundreds of of types of reading disorders and one can have a learning issue without having a low IQ.

  18. I have to agree with Al from the last page. Yesterday, JM absolutely wiped the floor with Demarte. Today Demarte seems to be much less nervous and doing a better job…I think when JW goes “all Martinez” on Demarte that she is less effective. I hope this afternoon’s session will go better…hopefully just like yesterday.

    • What are you talking about “going all Martinez” on her. JW has handled the tot doc with kid gloves. JW could easily make her crumble. “Going all Martinez” would be saying things like, do you have a memory problem, Judge can you please direct the witness to answer yes or no, etc., etc.

They have a little chat forum ( wish we had that) which is full of ” youknowwhats!!” I had forgotten , albeit temporarily , how disgusting The prosecutions following is, and really very unintelligent their commentary is. As Dr. DoucheSharty sits up there with Steven Alexander’s sneer on her mouth and dragon nostrils flaring, they believe she is holding her own. I guess we all come from two different worlds because for the life of me , I just can’t see their POV.

  21. Remember all the fuss about nonverbal communication? The figure was 90%. If this was not a trial and we watched with no volume, the body language on the witnesses, which person would appear more credible. Who would we choose to visit with our deepest and darkest secrets? Even when AL was attacked by JM she diffused the hostile situation by talking softly and smiling. When JD smiles it reminds me of a dog, close to snarling. She is very fearful thus limits her answers as not to get caught in error.
    Has anyone noticed that Samantha has an ear piece when they go to sidebars? Maybe she always has one in. This morning it seemed like she was listening in. Probably my paranoia…..going to look for my DSM-TR for self diagnosis.

  24. Does anyone know, or know where to find out, if this judge has sat trials with Martinez as prosecutor before and what the outcomes of those trials were? History of bias perhaps?

    • I’m not sure if we can look that up on the court site or not. I was able to do so on Florida’s online docket. I’ll check.

      But if the defense didn’t motion the court for her to recuse herself, it’s pretty much a moot point.

  29. I’m curious if this is the only site that believes innocent until proven guilty? The testimony isn’t even finished yet and so many had her convicted before the trial ever started. I hope none of them ever get to be on a jury.

    • Really, Pamela. It’s scary to even think those people could make up a jury pool. One can only hope they’d be disqualified because they simply wouldn’t be able to hide their personal bias.

    • This is just my own theory: Juan spun his tale of an open and shut case. Told her to do an evaluation. Tot Doc only spent 12 hours with Jodi, less than half the time AL did. She rubber stamped Jodi as borderline personality.

          • Here’s my guess. She looks ethnic to me, she pronounced Juarez as a person who speaks Spanish would do, and it makes sense to me that JM would choose someone ethnic, given his own heritage and that he’s an immigrant.

            Plus, she grew up in Texas but there isn’t a single trace of Texas in her accent. In my experience — and I pay a lot of attention to even the slightest trace of an accent since I have an accent (according to Americans) — the Texan accent is one of the most difficult to erase entirely. Her choice of verbiage is extremely affected. A fellow Brit will understand what I mean when I say, she tries hard to be “posh”. I don’t know a good American equivalent. How and why did she work so diligently to erase every single trace of her Texas accent? As far as know, the least accented area of Texas is Austin, but even people I’ve known who grew up in Austin have traces of Texas, even if they graduated from Harvard.

            I suspect that she felt like an “underdog” as a “southern girl” when she moved to Massachusetts. Perhaps she was even teased about her accent. I understand the dilemma she may have been in. When I moved from England to Ireland at age 11, I was mocked by kids I went to school with. Again, when I moved to the US at age 20, I went through much of the same. On both occasions, I worked to try to erase traces of my accent and to sound like the “locals”. It was confusing for me, and I often ended up picking up the accent of anyone I was around because I was essentially becoming a mimic. I was never successful and it also didn’t sound right to my ears. While I was developing the ability to hear and comprehend, I was surrounded by people with English accents. As such, I still sound “correct” to myself when I pronounce words with a touch of the English accent that remains. I’ve learned not to give a damn and just speak the way I speak, sometimes sounding English, sometimes a little Irish, and on other words, positively American. But that came with maturity. This girl isn’t very mature and she’s hiding her own insecurities by attempting to demonstrate that she has a superior intellect. She may have a superior intellect. But most people with a superior intellect know they’re not endearing to others if they attempt to place themselves above others.

            Her vocabulary, while limited to actually few three-syllable words, reminds me of my ex. He got one of those “word-a-day” calendars annually deliberately to extend his vocabulary because he thought it made him sound “intellectual” and he was pleased as punch when people assumed he was an intellectual simply because of his choice of verbiage. She chooses a “big” word because she thinks it makes her appear “smart,” when she could just as easily choose two to three “smaller” and more descriptive words. A truly intellectual person knows that is not the best choice (most especially when speaking to a jury) and rarely uses “big” words when “smaller” words would do the job — even when writing legal briefs. (Trust me, I work with some of the most brilliant lawyers in the world every day.)

            I suspect that, much like my ex, she came from an immigrant family that were not well educated and were, perhaps blue collar workers. When she showed aptitudes in school, she became the “darling” of her extended family. She may have been the first college graduate in the family. When she goes home, she is probably worshiped and adored by the family for her academic accomplishments. She has a slight chip on her shoulder that she attended MSU, not the more prestigious University of Michigan, or perhaps Harvard or some other Ivy League school (especially since her undergrad was in Massachusetts). However, at home, she is still the greatest thing since sliced bread. As such, her family has made her their “hero” and therefore, she hasn’t been met with refusal in decades. As a result, she appears to me (and I’m no psychologist) to have narcissistic and superiority tendencies.

            In addition, she has spent most of her adult life in academia where speaking well and using an extensive vocabulary is respected and perhaps even encouraged. She hasn’t learned to adjust to dealing with “regular folk” since graduating. If she hopes to be successful in private practice — or in forensic psychology — she will need to adjust.

    • Psychologist here: As stated elsewhere: A *primary* use of the MMPI in forensic settings is to evaluate the *Validity* Scales. She glossed right over those, and said the profile was valid. What that means is that the person taking the testing was neither exaggerating problems, minimizing problems, or denying major problems–in other words, a valid profile = the person was not lying.

      Also, there are published studies with norms for people undergoing various types of forensic processes.

      For Forensic cases, you use the Forensic Scoring which allows you to compare the person not only to average people of the same gender, age, etc., it also allows you to compare the person in similar court-related situations, i.e., custody. I don’t think she said anything about that, which would be the very first thing I would say. Makes me wonder if she realizes the Forensic Scoring is available. There are also variety of published studies available that provide these kinds of norms. If she does not know this, as a young “fresh” graduate, I have to wonder just how much of a “forensic psychologist” she really is. I think she worked in a prison for a while. That is not the same thing as a forensic psychologist who evaluates pre-trial defendants.

      She was exaggerating her experience when asked how many forensic evaluations she had done. When she said “no more than 75,” that was an evasive answer, as I’m sure she was including the folks in prison she evaluated—those people are evaluated for completely different reasons, mainly out of concern that the person may have a psychotic disorder and are experiencing auditory hallucinations and need medication.

      They should have asked how many times she had evaluated a pre-trial defendent.

      Also, it is not uncommon, in fact, it’s recommended to interpret the MMPI looking at the 2 highest scores. However, the typical, well accepted MMPI for a person with Borderline Personality Disorder is the infamous 2-4 code type. Ms. Arias’ profile did not show that.

      Therefore, the BPD diagnosis was not supported by the MMPI which is far more objective than looking at journal entries.

I mean, surely, there are studies (research or the MMPI would not be so highly respected and widely used? Did JW expect the jury to simply imply that tot doc was so arrogant as to ONLY use selective portions of the test that fit the testimony she wished to present? She allowed tot doc to repeatedly say that many psychologists would not use those scales because the empirical data does not support their interpretation, and that, therefore, only the portions of the test she used are “valid”. Do you have any thoughts on why JW allowed her to continue to present that?

      I think they can bring Dr. Samuels back. He is still under subpoena I believe.

    • I would hope they would bring him back, for it appears her MMPI backs his contention and the contention of the defense.

    • The defense rested. Their case is over. They can’t put on any more witnesses unless they request and are granted a surrebuttal. That is very rarely granted in AZ and only if new evidence came forth during rebuttal.

      I think they now have serious grounds for surrebuttal. JM sneakily got in evidence of the ring theft, the hiding behind a Christmas tree, and the phone number exchange on an airplane. Those are grounds for mistrial if they were previously determined to be precluded (and I believe most, if not all, speculative “stalking” evidence was precluded as prejudicial and unfounded). I doubt this judge would grant a mistrial at this point. If she doesn’t, at least, allow a surrebuttal based on this, then, she will be reversed on appeal. Allowing new evidence during rebuttal is sufficient grounds for surrebuttal, at least.

      • As I said above, in AZ, expert witnesses can use precluded evidence to reach their opinions. They can testify to it in a general way; not read or quote it directly. Alyce did this too. Both sides can. It is the law.

        It doesn’t seem fair to me. And I would imagine it leaves the jury with questions.

    • JM said he needed 5 full days for his rebuttal. He used up 1.5 days. So, I think we have another two weeks before we go to closing arguments (assuming there is no surrebuttal), but that depends on jury questions.

    • Yes, Prepaid Legal is called a “cult” and “pyramid scam” all over the internet. It would be typical for someone with Dependent Personality Disorder to get caught up in that, not leave boyfriends who cheated, etc. Sets one up for domestic abuse.

She does answer questions a little snotty. I don’t know if that’s the way her voice is but she seems to talk down to people.   149. This trail will probably go down in the records as the biggest circus act ever!! It is so sad that the media and the prosecution is making this into something it shouldn’t be. This is a case about a young woman’s life. Nothing has been proven about premeditation. I also think it is awful that there was things that wasn’t let in, like TA’s journals that could have shined a better light on the life that Jodi had with him.

    • Do be disheartened, Crystal. What’s coming out in this trial is nothing new, it’s just always been well hidden. Now these attitudes about women are being brought to the surface where they are showing us their ugliness. Hopefully this trial is going to help break through some of these stereotypes that have always put women at this kind of mental, emotional, physical and legal disadvantage.

      • There is plenty of controversy in the field of psychology regarding the diagnosis of Borderline Personality Disorder as it almost exclusively applied to women.

        HLN covering only trials of attractive, intelligent young women in high stakes situations is beyond disgusting. Even worse, however, are the number of people who seem so invested in going for the jugular.

        Men kill women all the time. Odd that the majority of crime stories otherwise on HLN involve the gruesome murders of women.

        • Agree. Someone told me today that she was told by a shrink that BPD was coined by a man and the first books written were in an effort to control women. I do know that BPD is diagnosis that evolves over time. The first diagnosis of any personality disorder is usually adjustment disorder. I learned this last year in a grad psych class. The diagnosis is given for insurance reason of course. Shrinks don’t want to quickly label someone with BPD because of the stigma and because it’s actually very difficult to detect because of PTSD and trauma. Demarte slapped that on Jodi in 15 hours after giving a few tests, an interview with steven ( which one can hardly call objective data) and reading some journals and emails. She could not remember much about talking with jodi or the journals aside from the points that supported her claim.

          I think the only point she MAY have scored with the jurors who see in black and white, was when she talked about compassion and why she doesn’t walk in feeling compassionate. Her answer would sound reasonable to those who want to believe the worst about jodi or those who know nothing about evaluations and psychology.

          On a different note, I spoke to a friend who posts here infrequently but has watched a ton of trials in AZ. She remarked that in the other trials, jurors were not allowed to ask sarcastic or duplicate questions. While some say this judge is fair, I think she’s in way over her head.

  156. How many juror questions are there?? I didn’t even know there were more than 1. I am glad there are. There were hundreds for Dr Samuels and ALV. Most of the ones for them were pretty disbelieving in tone, except for a few that were really good and asked specific DV questions and made sense to me. Some were even hostile and ridiculous IMO.(the ones to ALV especially) I think we will be able to tell alot by the tone and exactly what they ask of this witness as to how they are feeling about this so far. If they ask her about her test and results, etc…thats good. Maybe they will ask her if she uses eats alot of salty food and thats why she blows thru the water…lol.

      She was removed from the jury. She was with them the whole time and commented something, (we don’t know what) about her opinion regarding who know what. It didn’t taint the jury, she just disobeyed the admonition about talking to each other about the case before deliberations.

    I just have to say something about Nurmi….and I hope everyone won'[t be mad at me, its just my observation. For awhile now, IMHO, he has been looking very bored, laid back in his chair, staring at the ceiling, looking half asleep at times, leaning back like he doesn’t even want to be there. JW is up there busting her ass and he isn;t even looking at Jodi, let alone sitting next to her, its very odd. he rarely looks engaged at all. The jury is very likely seeing this, how can they not?? I just don’t think it looks good for co-counsel to be laughing and smirking at times, when he is in such an important trial. Its just odd to me.

      • I guess he is from time to time, but many times when I watch, he just seems to be very detached. A few times he was leaning back staring at the ceiling, just seemed bored. IDK, maybe its just me. If I were a juror, I would have noticed it though,. as I know they look at everything. I wonder when he will be doing a cross of someone…maybe the next witness.

        • I noticed his demeanor about the way he sits. But after a while I thought that 1) he is a large man an appears to be more comfortable in that sideways, leaned-back position. When he sits forward, he really has to have his back straight to allow his legs to fit under the table. 2) I get a very strong impression that he is attempting to look as if he is a non-biased attorney, with no emotional attachment, who is doing his job without ‘compassion.’ Why? Perhaps to prove to the jury that even impartial, unbiased people believe Jodi and to keep his name ‘unbiased’ in hopes of obtaining business (without the hatred following him) after the trial. Just my take.

          • Just wanted to clarify why I thought the jury questioned her credibility. One example (for me) was the ‘bear and tiger’ question; JD really sounded biased about questions of PTSD and whether Jodi was attacked by a stranger or TA. I think the bear/tiger was kind of to ‘force’ JD to give an appropriate, unbiased answer (of course that would not be the ‘only’ motive behind that question, but that’s my take). Then there’s the camera question; seems to me at least one person understands this is NOT organized (or rational) behavior, so whomever asked was basically ‘calling her out’ on it.

              • I think they were more pro-defense today. But the more interesting part for me was that the questions confirmed my feelings about some of the questions to ALV and Dr. Samuel’s. I had always thought through certain questions the jurors were not calling b.s. on the doctors, but more of an attempt to fully understand through prosecution’s b.s. At the same time I felt they were attempting to clarify certain points for other jurors (and possibly TA’s family) since pro twisted the answers to a point of derangement. (Of course this does not hold true for ALL the questions for there were obviously some hostile and media viewpoints in there.)

                • Thank you. I also agree that not all the questions were negative. Juan confused everyone so much so they needed clarification. Aside from the sarcastic questions that in my opinion, should never have been allowed in, I thought some of the juror questions with Samuels and Al were very good.

                  My concern is those who wrote the sarcastic questions will in turn bully those during deliberations. I hope we have some strong jurors on her side.

  167. Ok i’ve been watching this trial for a while. It appears to me that the prosecution is a joke and JM only cares for his conviction and will do anything to get it. From what I have found out about TA and what I know about motavational speakers. Motvational speakers are very cocky and stuck up and have the ability to change and manipulate situations to their point of view very quickly and some of them take advantage of this all the time. How do I know this, at one time in my life i was one. I developed morals and could no longer live with myself and got out of it. TA enjoyed the power that it gave him he used to take advantage of girls in his life. He wanted the best of both worlds sex on his terms with women, but he would only marry a virgin. I know that he abused jodi more mentally then physical, but it abuse. I only wish that jodi could have found someone who could see through his lies and that they had supported her to get her away from that low life SOB. I know she was justified in what happened TA.       from what I have heard, and I cannot verify it, the State has LOTS of rebuttal witnesses on their list, somewhere between 8-12…..again, cannot confirm this, but it’s what I have heard. I do know they have a Walmart employee on the list, possibly coming up next, and possibly a Tesoro Gas employee as well. Other than that, I don;t know who else that have. I know originally this case was supposed to go to the jury in mid April…..it looks like it will be early June at this pace.

      • There are 15 on the list. But it doesn’t mean he will call them all. He asked for 5 full days for his rebuttal, but that didn’t include cross and juror questions. So, I’d say, more like 10 days.

  182. The jurors asked very good questions and it tells me that Dr. D. did not fair well under JW’s cross. I have met people like her in the professional world of helpers and evaluators and if you take away their written tools, they are lost. I would never ever seek help from someone like her. The jury wouldn’t either I am sure. So we will have to see what’s next in JM’s arsenal of tricks.

    • JD said the verbiage on the test indicated Dr. Samuel manipulated the answer, so she showed her the answer with JA’s handwriting, which JD didn’t want to admit to.

    • I think some was Jodi’s and the other was Dr, Samuels. I think she was trying to show that just because it was on a normal piece of paper doesn’t invalidate it, and showing that there were 2 handwritings shows that they both wrote on the paper. They were implying that the Dr answered the questions for her. At least thats what I took from it.

  185. To me, its a very good sign the Jury didn’t ask many questions. They obviously don’t care to discuss her testimony, which in my view, shows lack of interest. I’m sure someone else will say it’s because they believe her testimony and that’s fine. I chose to believe that they really don’t care, and that answer about the Tiger and Bear analogy just sealed her fate. Her testimony is staged, and irrelevant. Any dumbass knows it doesn’t invalidate your feelings regarding whether your traumatized or not because the perpetrator was different. That’s the most idiotic thing I’ve ever heard. But typical of a disability doctor that wants to work very hard to disapprove your claim.
    There is at least a couple of jurors who aren’t buying her testimony, and that’s all we need!

  186. I have to admit that part of me is petty enough that I would have loved to see this witness treated the same way as defense witnesses were treated on cross-examinatin, but I feel confident that the differences will be highlighted in the defense’s closing arguments.

    • Yes, I know how you feel, but I think JW’s style is a benefit here. If I were on a jury, JM and the way he tries to manipulates would make me question everything he is trying to dish out. Before I started to look at this case in depth, I believed JA was guilty. Then watching the trial and looking at the evidence convinced me otherwise. From these questions today, I really believe some of the jurors are being objective.

    • I know JM had a Tesoro and a Walmart person on the list so we could rehash the gas cans.

      Also he’s filed some more rebuttal witnesses but I haven’t seen the list, so who knows who he intends calling.

      I heard somewhere that he estimated 7 days for rebuttal. So far we’ve spent 3 so may be 4 more days.

  187. It might be a dumb question but im not familiar with all these disorders and there tems, can someone clarify what the prosecution accomplished by diagnosing Jodi with borderline personality?

    • In my opinion, it counters Dr. Samuels’s diagnosis of PTSD and provides another alternative for behaviour Dr. Samuels and Alyce testified about. So, essentially, it’s an alternative that the jurors, assuming they believed anything the other experts said, can choose to believe instead.

      It also paints a picture of Jodi having an unstable personality, deep rooted fear of abandonment, and the proclivity to rageful and impulsive behaviours which ultimately result in severe shame, and to be manipulative. In that, it explains some of JM’s prior questioning on cross, provides an alternative as to why Jodi lied and experienced shame, and also why some of her words (both written and on the stand) present her as a sweet compassionate person; whereas, Travis experienced both that side of her and a different unpleasant, difficult, manipulative and annoying side.

      So, essentially, it’s an alternative. It raises reasonable doubt about self defense, in case the jurors had none previously, and gives them an alternative explanation.

      I hope that makes sense.

    • IMO (and that’s all it is) I think the strategy of the prosecution was to come up with a damning diagnosis.

      Calling her a sociopath or a psychopath would give her too much credit, and not very believable.

      So they decided to use BPD, as it carries the most stigma for women. It makes her look like a “bad girl” whose just generally messed up.

      But most people can see through that hogwash too. She’s had stable boyfriends, and she’s hardly “empty inside.” That’s just Tot Doc’s nice way of continuing to parrot the HLN party line.

  188. I am depressed after that. I didn’t hear all of JM’s cross. I started hearing about the stolen rings and deleted messages and just got so down, I decided to get on the train and come home. I heard the jury questions, and her answers, and the follow up, but it didn’t make me feel any better.

    Tot doc for all her inexperience and robotic nature did a LOT of damage. JW seemed to get very flustered towards the end and she missed a very very important point: the fact that BPD is misdiagnosed in cases of PTSD. Tot doc is very clever and she never missed a beat or conceded to anything. I have only known one person in my entire life who doesn’t cuss EVER. She would find ANY cuss word offensive if spoken to her and about her. But even she has allowed me to slip a few times in conversation when I’m angry at something else. As mad as it makes me to say this, tot doc made it sound like Travis was angry, had cause to be angry, and that’s why he cussed at Jodi.

    I don’t think the jurors get abuse. Many people here have experienced abusive relationships. Many others have read the words and descriptive feelings of those of us who have been abused and have started to really understand it. But, as I experience life, I find very few people who “get” it.

    Tot doc has committed more damage to the domestic violence movement than anyone I’ve ever heard of in my life. We’ve just gone back in time to the 70s. I don’t believe in God, but if there is one, I sure hope he was watching this trial and can help us.

    All I can hope for now is there is someone on the jury who, during voir dire, didn’t quite understand the question and has been in an abusive relationship — perhaps one she didn’t previously categorize as abusive until listening to Alyce. Even if there is, I wonder if she has much of a hope of explaining it to the others during deliberation. As of right now, JM threw a considerable amount of reasonable doubt on self defense.

    I personally think the defense should be allowed to re-cross this witness. There was evidence brought forth in redirect that was completely beyond the scope. As rarely as that might occur in AZ, I think if re-cross was denied, that’s a clear abuse of discretion on appeal.

    • idk AA, I think the questions were fair, some weren’t buying JD, like how could you kill someone and not be traumatized, also lack of experience which she never did answer. JD did offend me when she said it was JA’s fault for TA talking to her that way. That’s so typical and how abusers get away with what they do.

      • I really hope you’re right tonysam. But, I think you’re seeing it from YOUR perspective. I did my very best to watch/listen in an unbiased fashion. That’s extraordinarily difficult for me to do, given that I’m an abuse victim and I was literally seething in anger and frothing at the mouth about much of what this “nasty inexperienced young girl who pretends to be an expert was saying”. But I ended up in tears both before I got on the train when JM was crossing her, on the train when I finally got a signal to hear the latter part of his cross, as I walked home from the train and had to stop a few times because I felt so gutted, and when I had to stop on the wall outside my development because I was feeling so heartbroken and couldn’t find a way to walk and cry at the same time.

        I hope you’re right, but I just don’t feel it.

          I think the trial has been draining and emotional for many, if not all of us. I can say that I absolutely believe the only real damage the “tot doc” (I think thats my favorite term for her too) did was to her own career.

          I still have faith in jurors. Anyone who is an average, everyday person can plainly see that this woman has no compassion, relies on data more than speaking with someone, has a general superiority complex, is rude, and is a Jack of all trades, master of none. She did not come off as credible or likeable, both of whcih rank highly when jurors deliberate.

          I think her career is ruined on several counts, which I would like to highlight, and then if you are still upset tomorrow, I can refer to my highlight from tonite 🙂

          1. She did not fare well under cross examination, and pretty much was discredited by her own words as an expert. No razzle dazzle by Juan’s questions to her today, can overcome what the jury heard lound and clear….”I’m not an expert” . Which brings me to the first nail in the coffin of her career. Who the hell wants to hire an “expert” that is going to fold so easily on the most important point: ” being an expert”? There goes the career as a forensic psych.

          2. Anyone who researches this quack will be able to see her on Youtube. She comes off as ice bitch Kardashian wannabe. I can’t imagine anyone would want to sit across a desk from her and spill their most intimate secrets. She won’t even give a poor abused kid a lollipop, who wants their kid to be subjected to that? There goes her private therapy business.

          3. With her full two years experience she did her best to discredit others in the profession with lifetimes of experience. Her BS regarding their ethics was beyond offensive. Once her own private business is in the shitter, what agency or Psychologist would ever want to work with her or hire her? My guess is no body, for fear that she would throw them under the bus when it suited her.

          4. I can imagine that if anyone from the State of AZ has been watching her BS about the Psych tests and how easily JW ripped her apart, she will probably not keep her State contract for long. JW clearly revealed how poor her testing skills are, and they are now in question by anyone looking for her to do testing. No State wants to be in a position to have all their decisions re: disability overturned by Soc Sec Lawyer who saw the testimony and recall it to discredit her.

          So cheer up Also- things are looking good. Just remember the tiger and bear question and that will remind you that the jurors didn’t buy a thing from her.

She clearly stated over and over and over again that there was no empirical data to support much of what JW spent most of the afternoon going over. Was she wrong? Maybe she was. But she certainly sounded confident and I bet some of the jurors bought it.

        I’m gutted today and I expressed how I felt. According to you, I don’t have the right to do that and you’re so superior. Gutted is an excellent term to describe the way i have felt several times for different reasons. Its is hard enough to live with abuse as part of your past, as many people have no idea that it never, ever really IS your past, it just doesn’t go away, it gets in your brain and stays. 20+ years of therapy and counting…and still nightmares and jumpiness. To have that problem and then be “talked” to on a forum where we are all trying to show our support for Jodi, to be friendly and nice to each other, to discuss our thoughts and ideas openly without FEAR of being attacked, but someone feels the need to constantly belittle, correct, ridicule, is just rude and uncalled for.               • Yes, it’s tonysam. She sort of apologized below, and for now, I will accept her apology. But she has ridiculed and belittled both myself and Anna Ryan (a highly respected poster) for expressing opinions that do not agree with hers. It’s been a while since she “picked” on me when I answered a few legal questions. I am NO legal expert, but I did go to law school and might therefore, be able to interpret a few things more easily (at times) than others. I try to respectfully explain what I know. tonysam has challenged me saying I’m some sort of quack annoying poster in the past. She even said (after I said I was an immigrant) that I didn’t understand American law at all. I immigrated at age 20, after university, and went to law school in the US. Then, she tamed it down and I accepted it and agreed with many of her opinions, as she does have some very valid opinions.

                However, she has apparently, chosen Anna Ryan to pick on of late and I’ve witnessed a few of her disparaging remarks towards Anna, and Anna’s dismay. I’ve had many the intelligent discourse with Anna on here and find her to be a person of impeccable quality. I have not discussed this privately with Anna, and don’t know her. However, I have been upset with things tonysam has insinuated towards Anna.

                Today, I felt that that tonysam started in on me again, and I had enough and expressed my opinion. I didn’t take the “other side”, however, I was emotionally affected by today’s testimony in particular the latter part. I am always open for another opinion (and can say the same about Anna Ryan in what I’ve seen of her posts — and I’ve been here for a while). However, being belittled and ridiculed, when I’m so obviously a Jodi supporter, is rather upsetting. I wish tonysam would just ignore my posts entirely. I would gladly ignore hers.

                As you may have witnessed, Al and I often debate legal issues, but we always do so respectfully, whether we agree with one another in the end or not. We are always respectful of one another. Joujoubaby (who is a lawyer with substantial experience) and I have disagreed, at times, on legal issues, but we have always done so with great respect for one another as well, and I consider her to be someone whose posts I long for. I just don’t feel that I should be told I’m an idiot because I feel one way about testimony and tonysam feels another. I also don’t feel I should be ridiculed for becoming emotional because I didn’t feel one day’s testimony went as well as another day’s. I hope that makes sense. I think there’s a very good way to respectfully disagree with another person while considering their opinion, without dissing the person. That’s what JM does. That’s what tot doc did on the stand. Surely, one can disagree (as most people here do automatically — and there are many who disagree with me and/or correct me when I’m wrong) without being disrespectful and condescending?

                None of us are always right. Whatever we express here is always “our opinion” whether an educated one or not. In the post below, tonysam apologizes but then takes away the apology by saying it irks her that people (who support Jodi) take the “other side” or “try to be objective”. On a hater site, I wouldn’t even be allowed to express my opinion at all. I’d be banned in the blink of an eye. I’ve never gotten the impression here that we need to be Jodi/defense robots. I feel like an abused woman once again when tonysam tells me how stupid and idiotic I am for expressing my opinion that “the other side” did better on any particular day than many here want to believe. I’ve seen the same happen to Anna Ryan. Also, if I talk about something in regards to AZ law that I’ve researched, I’m told I’m an idiot who thinks she misrepresents myself as an expert. Or, I’m told that I don’t understand American law at all (and I once was told by tonysam that I should return to my country of origin, even though I’ve lived in the US since 1985).

                • Hugs to you. Hearing what Jodi went through puts me right back emotionally where I was during the abuse. I was accused the other day (rightly so) by someone close to me that I was too hard on myself for decisions I made while in the abuse. He says I am removed from it now and can see it clearly whereas I couldn’t while fully involved. While we are stronger now, it takes very little to trigger those memories and very real emotions (probably PTSD sadly). Thank you for the compassion and worry you have for Jodi. I understand that when you look at her you can see yourself. I do the same.

                • I am sorry to hear you feel that way, I do believe this doctor did not do well, not at all. I have been so confused about all of this but when she came on the stand she was mean, condesending and annoying. She did not do well up there, not at all and her inexperience was apparent. I am new here, have read all of your comments for sometime now but was afraid to make my own. I have on a few other sites and people were so mean to me for disagreeing, here is a bit of my own story and what I posted:

                  abusers like Travis are charming and the only person who ever really knows how they really are, are the women that they abuse. He is a textbook example of an abuser, it happened to me. NO ONE knew the horrible things he did to me, he hit me on the top of my legs or my arms where I could cover it with clothing, he wouldnt hurt the face he liked to look at so I never had black eyes or scars on my face. I planned many times to get away but only did after he nearly choked me to death ,my brother heard my screams and called the police but I still denied it when they came in, I told them it was just an argument,then I just couldnt and went and got the bloody shirt he made me take off when he heard the sirens and they took him away. He lied to his family, said I had a bloody nose, he said I was a slut, he said I was crazy and jealous but it was him. When someone calls someone dirty filthy names over and over trying to convince those around them, beware, they are usually referring to themselves but trying to transfer that to you as Travis did. I believe Travis abused this soft spoken girl, I was that soft spoken girl but I got away, she almost did not and she still might be killed by Travis in a round about way, sad

        • My opinions are not always right, but it seems that people try to take the “other side” of the argument, and it really kind of irks me. I apologize if it upsets you, but I just don’t care for this “trying to be objective’ when it really doesn’t call for objectivity.

And with the jury being mostly older, I think this witness is going to come off as a smug little know-it-all who hasn’t experienced much life yet thinks she knows more than people in her field who have been practicing for 30 years. Some people of older generations don’t appreciate “youngsters” talking down to them.

    • AA….I don’t believe tot doc did a LOT of damage. In fact I don’t believe she did ANY damage. She was TESTILYING all the way through. I believe the jury could see that. Even JM was pissed at her towards the end:>))))

      • I didn’t see it as him being pissed at all, Moni. I think it’s strategy. He wants to show the jury that his demeanour is the same on cross, regardless of the witness.

        • Of course he wasn’t pissed at his own witness. What he was doing was putting a little distance between him and his girlfriend so as not to get the jury thinking that he and his girlfriend actually rehearsed all these manipulations of the truth, (mostly BS), if you will. I would call this…a type of unethical ‘strategy’. I do believe it was contrived and rehearsed…that’s why she was so quick with the answers. She had them memorized…with Martinez being the Head Coach.

    • I don’t think she explained anything about this ‘cussing,’ AA.
      First of all, if he was ‘angry because she lied,’ like baby doc said, all he had to say was that he was angry because she lied. Not call her whore slut etc.
      And second, he did not just cuss. He went on and on and on ranting and venting rage toward her in WRITTEN form, which most angry people do not do unless they go into an uncontrollable rage, threatening her and demeaning her, without ever explaining why he was angry. Baby Doc did not explain any of it. Only abusers would condone and excuse such behavior.

      I think the tiger bear question shows that someone is really thinking…I for one would not believe tot docs answer on that.

      • I said that earlier, BeeCee, at least one juror is taking his/her duty seriously. I think that question was someone who truly wanted to understand whether or not Jodi lying about who committed the attack would still cause PTSD.

      I agree. While I think JW did well, she could have really gotten into BPD/PTSD. I wonder if JW knew that? Was thinking today, how powerful it would be for a defense attorney to have a masters in psych before going to law school. I say masters because a bachelors isn’t enough. I don’t think JW knew about the connection.

      • You know, I actually had a lawyer briefly who had a masters in psych and who represented me in my divorce for about a month and a half. She got her masters in psych, then went to law school after she met her husband, a lawyer. She worked for the PD’s office for over a decade before going into private practice in family law. I was desperate and she was cheap ($2,500 retainer) whereas everyone else wanted $5,000 by then, close to the trial date.

        She was a MESS and very manipulative. I never gave her my address or home phone number. I don’t give them to anyone. My friend helped me pay for her fees and did so by credit card. When she decided to withdraw, after my pleadings were stricken (for refusal to give my abuser my current address), she actually called my friend and said she was going to court and had forgotten to bring my number. Um, seriously? She used an iPhone and texted me frequently. Number are stored in an iPhone. My friend fell for it. She was the ONLY person (other than my boyfriend, not fiance) who had my home number. She gave it to her. The bitch tried to submit it to the court. Luckily, I had been, and still am, smart enough to keep my home address 100% secret from everyone. My fiance is the ONLY person in the world who knows where I live. So, she did no real damage.

        Apart from that, she wrote me repeated brief unintelligible texts which made me scratch my head (I speak text fairly well). Her spelling was atrocious. Even in the appeal, her typos in naming one motion as “Motion in Opposing” as opposed to “Motion in Opposition” was mocked. Her emails to opposing counsel came across like a five year old. At one point, when she was discussing settlement (that I told her would never amount to anything and to cease until the other side came up with an actual offer), she wrote to opposing counsel “need vin mileage corvette”. He forwarded it to my ex, who responded mockingly “I’ve never heard of “vin mileage” nor do I believe there is such a thing. However, the VIN of the Corvette is XXX and the current mileage is XXX. Perhaps that is what Ms. ___ is looking for.” Humiliating, to say the least.

        I couldn’t even tell you the amount of times I wrote motions for her (and she represented me briefly). She continued to tell me she needed someone like me in her office because of my skills! Puh-leeze. When I finally got transcripts of her performance in court, I was completely disgusted. She actually announced in court (which is public record in FL) what type of firm I worked for, and my hours. Is it any wonder my ex was able to have someone plant a tracking device on me?

        Perhaps she would have made a good counselor. She was easy to talk to, other than that she did all the talking. But a good lawyer, she was not. I honestly wondered how she passed the bar. Her intellect was slightly lower than the average hater site poster.

  189. I think if a person was attacked by a bear and later found out it was a tiger (maybe because it was dark out), then there would be no need to retest because that is just a perception issue. But if the answers to the test were based off of a story that could have been used to deceive, then I think the test should be redone because the answers may have been to match what the person thought the made up trauma would cause.

    I’m sure no one else here agrees, but the test should have been redone if there is any indication the first test was based on a lie.

      I do agree the test should have been redone. I also see why he didn’t though and a test is only a tool. You are being fooled if you think the tests were the be all end all to the evaluation.

The way the judgd asks the questions were a lot like she asked the defense questions, telling me that it is NOT THE JURORS that we thought with the sparky type questions, I really think its prune puss tone. Other then that it also proved that there are a few jurors with more brain cells then this “so called” dr.

    Really…. a bear or a tiger attack would be different, really??? So she would fear for her life to the point of giving her PTSD if a bear attacks her but if a TIGER attacked her, Noooooo, no she wouldn’t, it be a totally different experience to HER!!! She fell into that trap herself!!

  191. OMG, my ears heard this witch say that it’s ok for TA to have used verbally abusive reactions to JA so long as it was in certain situations!! WTF.

    Yeah…Im way behind to day, just wanted to vent a little.

    What I did catch though today, seemed very good for the defense. Baby Doc is at very least going to cancel the expert testimony out, and at best lend credibility to Dr R and ALVs testimony. IMO so far anyway.

    P.s. This baby doc has me feeling like Im back in school listening to nails across a chalkboard. I have to believe that at least two-thirds of the jury feels this way too. Just my humble opinion….

      I still don’t get how they can allow her testimony considering that she is NOT an expert in DV and is NOT an expert in PTSD, or an expert in memory.

  192. After all my work I had to move this here to the PM side, posted late on AM:

    Ok, I have had an epiphany. No one has to believe me, but I can take this to any hater site & let them ram on it as much as they like & it won’t make a lick of a difference to me. I completely understand Jodi & how she fell into this bad place and what problems she brought to the meeting she had with the terribly damaged & abusive man that was TA. I understand the haters now, and why their inability to be introspective & their tendency to groupthink has brought them to the extremes that they have exhibited on social media.

    Since I am a strong believer in the MMPI, and it did show some PD for Jodi, I have been bouncing back and forth on Jodi’s personality disorder, trying on the BPD, thinking about her behavior. BPD made some sense but didn’t explain enough for me. This is the kind of puzzle that can turn me into an annoying geek and an unpleasant zealot. In addition to seeing this poor young woman on trial for her life, the pieces that I couldn’t make fit were what kept me so deeply engaged in this case. So here is my take: Jodi’s maladaptive personality problem is indeed schizotypal PD. She has an over-belief in magical thinking and this is what has hurt her so much. She is a sweet, caring, self-sacrificing person who will always do what she believes is necessary for the benefit of those around her. And she will do that under the burden of her maladaptive tendency towards seeing the world through a schizotypal lenses. So, a key thing that caused to get Jodi pulled into the dangerous, abusive web of TA was ‘The Secret’. This book can be very helpful to folks, but for a schizotypal who holds to it in spite of all the information of reality around them; in this case, that much harm is coming to them from another person that they love, it can have a devastating effect. Jodi didn’t know when to stop, think & gather data enough about how she was being treated by TA & how she was truly feeling about this . If she could have written about it, I think she could have overcome her tendency towards ineffective magical thinking (I personally love magical thinking and narratives in life, but one needs to know when they are helpful & when they are becoming detrimental). She is very intelligent, and probably stumbled upon journaling as a way to help her manage her maladaptive issues at an early age. If Jodi could have let go of the hold the ‘Law of Attraction’ had taken on her sooner, she could have made better choices with respect to TA; she would have known to set her boundaries sooner and more diligently. She is not someone so overtaken by the schizotypal tendencies, because she was seeing some real data & was making moves to get away from TA, but not enough in this case. Her mental health burden was enough when placed in combination with a scam artist like TA, that she couldn’t get away as easily as someone who did not have this type of problem.

    When others on this site talked about the heart stab and throat slitting being ritualistic, it didn’t mean much to me, but if you put all the pieces together with Jodi having schizotypal PD, that is exactly what I now believe happened in the very end. TA was in a major rage about being dumped by Mimi, wanted sex with Jodi, and used all of his salesman skills to get her to visit him. TA really needed help, God rest his soul. Of course he attacked Jodi & she was in desperate fear for her life & killed or mortally wounded him in this terrible fray. Then either she performed the ritual on him or he begged her to with his dying words. From what I see of Jodi, she would have raised heaven and earth to do what her magical thinking led her to believe was necessary at that moment to save TA’s soul and ensure he rested in peace for eternity. She would have found the strength and self-sacrifice to perform this grizzly task for him. She wouldn’t have called 911 as soon as the fight ended or run off; he was gone, or too far gone & she was the only one who could send him to heaven. Now, for me the idea of overkill turns into the ritual that I originally didn’t find relevant when several posters brought it in as a valid explanation.

    This also gives a good sociological explanation for many of the haters who are [virtually]regular caring people in their everyday lives. It’s normal to feel a strong avoidance for actions that display some level of mental health problem. Also, when we can’t explain something that seems outrageous we tend to feel fear and aversion. So those who don’t stop and think about this story & who only focus on the extreme or maladaptive aspects are experiencing emotional responses that they cannot reconcile with this beautiful, gentle women at the center of it all. It is very confusing for them & makes them more afraid of the world, and they lash out against Jodi & people who support her in their need for an answer. They fall into the trap of thinking the answer is that Jodi is evil, when she is the exact opposite.

    • Not all people with SPD have “magical thinking.” I seriously doubt she has it.

      I have a brother diagnosed with it, with avoidance features, and JA comes nowhere close to what he has.

    • I have actually thought of that theory too. Well, not exactly the schizotypal PD, but the rest of it. Especially the throat slit being what she though would send him to heaven, or perhaps TA asking for that realizing he was dying.

      I totally agree on the rest of what you said also.

      It’s definitely a possibility and also plausible.

          OT, but sometimes it almost seems to me that every single one of us carries within ourselves all of the characteristics listed for each and every “personality disorder” that has come to be defined and established by the experts over time, with the differences between us being merely differences in the qualitative/quantitative distribution demonstrated for each trait, culminating in an overall “pattern of personality traits” which varies from individual to individual and defines each one of us as distinctly as each one of us is defined/identifiable by our individual fingerprints.

        I don’t believe she slashed his throat.. that’s a mormon thing and I honestly don’t think in her state she would have done that.. nah it just doesn’t fit in my book. We mustn’t forget that the mormon religion played a very big part in this but it seems to have vanished because no one mormon will be a witness and even if the did they would lie.. Chris and Skye Hughes are examples of that and I think they are the only mormon witnesses, and in any event they are for the State..

        Other inconsequential stuff is seized upon instead, such as the blasted gas cans! 🙂

  193. I am a licensed Ph.D. psychologist with 20 years clinical experience and 15 years teaching in graduate pysch program, teaching the testing course.

    Okay, there are big, big problems with the prosecution’s psychologist worthy of appeal:

    1) Did she ask Ms. Arias about her responses on the PDS? Did she ask if she had ever had a traumatic experience with a stranger? I didn’t hear that. She is on very, very HUGELY shaky grounds for interpreting a test, concluding someone was lying, when she didn’t inquire of the other psychologist how it was administered and did not ask Ms. Arias herself about what she was referencing when she completed the PDS and why.

    2) Way, way, way worst of all. I’ve been waiting for the MMPI, specifically, the Validity Scales. I could not see the profile, but prosecution’s psychologist said it was a valid profile. That means Ms. Arias was not lying when she completed the MMPI. Forensic psychologists usually interpret this to mean that during the evaluation, there are no grounds to assume the person was denying, exaggerating problems, or trying to present him/herself in an overly favorable light…in other words NOT lying.

    Defense should have lined someone up to counter the prosecution’s psychologist – 2 other psychologists, 10 other psychologists who would all agree with above if they are being honest and not playing hired gun for prosecution.

    In absence of that, defense attorneys need to go straight the MMPI manual and the section on the Validity Scales and ask this psychologist a LOT of questions. They should also go straight to any psych and law text and look up “Uses of the MMPI in Forensic Cases.” This is a death penalty case. They should be consulting with other psychologists over the weekend.

    Prosecution’s psychologist should be held accountable. Again, this is a death penalty case.

    • This is what I said yesterday. Those points you raise about the MMPI are a HUGE deal. In particular, I wanted to know the same thing about the fact that this psychologist said it was “usable” in her opinion, and therefore, Jodi probably was not be lying, given the fact of the built in lie scales.

      Jen actually could have lent credibility to Jodi’s testimony by bringing that up.

      I will say though, it’s been years since I looked at the MMPI, so this could be wrong. But, I think I remember the scales enough to talk about it. I remember the MMPI as being extremely difficult to lie on. Credibility could have been shown for Jodi’s side….just really felt that was necessary since the lying on her part was brought up so much.

      They can’t. Their case is over. They can’t call any more witnesses, unless the judge allows a surrebuttal (highly unlikely). Even if she did allow it, their chances of using psychologists who weren’t on their original witness list would be even slimmer than getting a surrebuttal in the first place.

        • I know, but I didn’t think she was truly winning. Tot doc had an answer for everything, and jurors are jurors. I think she should have spent less time on the scales, and more time on discrediting some other stuff. That’s just my opinion though.

      I am also a psychologist who has been in the field for over 20 years, and has taught psychology. I have numerous issues with this JD.

      Did she test Jodi twice with the TSI because she didn’t like the results she got the first time? That is what I got from JD testimony.

      She sat with JUAN for numerous hours going over what she’s going to be questioned and how to asnwer those questions. Leaving out scales on the MMPI because she doesn’t like them, because they were for the defense. That a huge no, no….. unethical.

      Not asking Jodi questions, shows lack of experience…………she is not quaflified to for a high profile DP case in my opinion.

      I agre that they JW needs to consult with others over the weekend on the MMPI which I believe she’s been doing the past few days.

      Working for Bayless, I wonder if she had permission to use the TSI I for this trial? I am sure that was for the purpose of their clients, not outside clients.

      She’s a licensed psychologist and could of bought the TSI II herself, as for any other test she wanted to give to Jodi.

      As for mistaking a tiger for a bear and saying the test would be invalid. I disagree. It’s all about environment and what the client has been subject to in their life….. For example: Living in AK where you see moose, could some mistake a moose for a deer if they didn’t know anything about a moose?

      I could go on and on ranting right now……….. But I will pause and take a deep breath.

      Look at her on Psychology Today: she notes that she only works for adolescents. I don’t know what your specialization is in Tanya, but you normally focus on a few areas …. She’s stating that beause she’s a clinical psychologist she never practices outside of her scope. Well, your not a pro in all areas in psychology.

        • Artistic and creative people are typically first born children and very intelligent. However, this has nothing to do with meeting the DSM TR IV criteria for BPD .

          BPD is there about 2% of the population and typcially in females.

          I think if I was locked up in jail for 4-5 years I would also have some sort of personality disorder. These women are very compassionate in nature.

          According to the DSM TR IV migranes are prevelant with BPD.

      • I also agree there were more things JW could have asked JD….much more. But she concluded, and then there were the juror questions, which she questioned her about as well. Thats it. Then JM got to question her about the juror questions….he is done as well. The defense and the pros are both finished with this witness, and there will be a new State rebuttal witness on the stand Tuesday.

      Thank you for your post. I am somewhat confused though, hopefully you can help with this. This Dr did administer the MMPI to Jodi, and it does have the built in validity scale. So, she cannot lie on that, it would show in her score. That being said, the Dr said she based her diagnosis of BPD on this test, so I don’t see the positive point here..? She also referred to Dr Samuels notes in which he diagnosed her with a non specified personality disorder, however he used the MCMI. This Dr did not administer a PDS test though, which I find odd, especially after the MMPI showed elevated responses in several areas that could indicate the presence of that. (IMO) I know the pros main goal is to try to discredit the test result based on the fact that she took it when she was using the intruder story, and when on the stand, Dr Samuels said he should have re-administered that test after she told the real story. (something I think he should not have said) I have gone back and forth about that issue since he testified, what is your opinion as a psychologist on that issue..specifically, If a person takes the PDS test, and the trauma they list as the “triggering even/factor” is based on a lie, then do all the subsequent answers to the questions make the test invalid? Also, is it a problem to give a person the testing paper/question sheet, and then the Dr write the answers down on his own piece of paper as the person answers instead of giving them the bubble sheet answer form to fill out? It seems to be a big issue for this jury, the whole issue of the triggering event or trauma,therefore whether there is or isn’t, PTSD, being based on a lie, and I wondered what your opinion of that was.

      • IMO, the TSI is a better test than the PDS, and the results pointed to PTSD for Jodi. JD just chose to misinterpret them.

    • I’m not sure I understand point 2: are you insinuating Jodi lied on the MMPI test? The defence has been very careful to avoid having Jodi called a liar, and it’s easy to understand why!–and bringing in that line of thought seems damaging?

    • I remember during Dr Samuels testimony that someone held a knife to her throat when she was 13. I believe that was a traumatic event with a stranger too.

      Not sure if this is the info you are looking for, but that’s what came to mind with your points.

    • I did too. That question was a trick question (I thk). Even if she would’ve said, the attack would’ve been the same; AS traumatic. ?. The juror that asked the question would’ve still been left thinking; well thenjodi beeing traumatized by the intuders ir by TA attack, it STILL would’ve been TRAUMATIC. So, there IS AT LEAST ONE juror that’s not buying what this doc is talking about.

      Omg and then the camera, she’s just has no idea!

      • I honestly didn’t see it as a trick question by a juror. I think that question came from a juror who is taking his/her civic duty very seriously and is still weighing all the evidence very carefully. That juror really wanted to know about the validity of the PTSD diagnosis by Dr. Samuels and the points JW made about PTSD indications. He/she wanted to know whether or not even though Jodi was lying about intruders while answering that test, she could still have been experiencing PTSD anyway.

        Tot doc’s answer actually hurt the prosecution. First of all, if I lied and said that it wasn’t my husband that abused me but our next door neighbour, would my diagnosis of PTSD or the symptoms I suffer be any different? Do I experience different PTSD symptoms than a soldier who came back from Afghanistan about the same time my ex was arrested?

        By saying that the PTSD experience from encountering a tiger would be different than encountering a bear, she essentially told the jury that the PTSD indications for Jodi were valid but came from something else, not the intruders lie she was telling.

          that was a very telling question. It was very simple, a small detail, 2 wild animals in the same situation, nothing different at all but the species. She was trying too hard not to concede anything at all, and I think that answer was a mistake for the pros. If the question had many more facets and scenarios, that would make sense, but this was a serious question, IMO, by someone who was truly trying to find out something about PTSD and the triggering event.

        • I didn’t mean a trick question like the juror wasnt serious. I meant a trick question as to get her to answer it as to let the juror know how the dr saw PTSD and trauma. There were some questions that I felt where asked to see if this doc was bias herself.

          • I understood what you meant, LC. I just didn’t see it the same way. I don’t think jurors ask questions to see if a doctor is biased or not. You might be right. This is a strange jury! There were some questions of Jodi that were sarcastic, indeed. If you noticed, those kinds of questions seem to have disappeared since Juror 5 left.

            I see that question (bear v. tiger) as someone really honestly trying to understand the significance of the lie (intruders v. Travis) in assessing whether Jodi has PTSD or not. I’m not sure whether this is a huge positive for the defense or significant of a juror totally buying self defense or not, because you really never know with juries until they come back with a verdict. It may well be a juror who is trying to make sense of exactly why Jodi lied for his/her own understanding, but I lean more to thinking it’s someone who hasn’t made a decision yet. It’s someone who, I think, is genuinely trying to figure out a bit more about PTSD and the significance of those tests and lying while taking them. Having a juror who is thinking like that though, is always a good thing.

            • I agree with you Heather1, Ann and LC. Her response was too dang funny. Out of the three Experts–Richard Samuels / Alyce LaViolet / Janeen DeMarte…who was the most believable. The answer is: Richard Samuels and Alyce LaViolet by far. In my ipinion, Demarte didn’t even run a close second. And by the way, I have the utmost respect for education, so as to know that I’m not biased against DeMarte.

    • I don’t know and can’t make any assumptions on those jurors jou. I would say however, that the reason they didn’t have as many questions for this witness is that Martinez was not jumping around confusing all the issues , since it seems to be that the questions are mostly asked when he is badgering witnesses. That is my take on it anyway.

      • It is very difficult to read what the jury is doing right now. Since 2 jurors left and the sarcasm seems to have declined. We know by the jury watchers that #5 asked a lot of questions because they watch who puts in questions. This time HLN didn’t state how many of the jurors were putting in the questions. So we can’t tell the mix. Whenever HLN omits something, though, it is usually because the info is pro defense. If it even hints at being pro prosecution they are mega blasting it. So that might be a good sign. From the tone of the questions I would say at least 3 of those who submitted questions might be leaning toward the defense.

  195. Regardless of the content and back and forth today, I feel JW did a good job overall. She doesn’t have the same style as Kermit, and shouldn’t. She was polite and the inexperienced doc looked completely defensive in almost every answer which, if I were on the jury would give me pause in evaluating everything she said. Also, she is extremely unlikable, a really bad call for Kermit, IMO.The jury is made up of real people and real people drift in and out of hours of test reviews, they will take a topline opinion of both content and it would be impossible to ignore how unlikable this witness is.

    • I don’t know, Ann. I really really really don’t. I’m stumped that the judge allowed that. While in AZ, cross can extend beyond the scope of direct, redirect is NEVER supposed to extend beyond the scope of cross. To me, those issues were way way way beyond the scope. I honestly expected the defense to be allowed a re-cross on those.

          • Wes, unless AZ is different than most jurisdictions (which I haven’t heard in regards to judicial assignments), it wasn’t Judge Stephens’ choice to be on this case. She replaced another judge about halfway through. For all we know, she may have cringed when she heard she was next up in rotation and got lumped with this one.

            I think she tried to be as fair as possible for at least, the defense phase of the trial. She gave the defense an incredible amount of leeway when Jodi was on the stand. Most other judges would have been all over Nurmi’s ass to speed it up. But she realized the significance of Jodi being on trial for her life, and she did her very best to be impartial and give her every possible chance.

            I think she’s since become more than a little irritated (perhaps with herself) that this trial is continuing well beyond the time frame she predicted to the jurors. I don’t think she has any idea how to handle this case in front of the camera. That’s not uncommon. It’s not as if judges try cases in front of the camera every day of the week. She’s still young enough that she most likely hoped to continue on the bench for several more years. She doesn’t want her judicial career to end on this note.

            As I’ve said before, it’s interesting to me that neither us (the pro Jodi folks) nor the hater sites (the pro death penalty/kill Jodi sites) think the judge has done a good job. Each side believes she is biased against the other. In actuality, that really means that she has been more fair than either side realizes.

            Nonetheless, I think she made an enormous error today in allowing in testimony that wasn’t in evidence previously (the ring, the Christmas tree, the guy on the plane). I’m really not sure what she was thinking. That was, in my opinion, a giveaway to the defense on appeal.

              i can’t speculate either way as to how she felt about becoming the judge

              i’m not sure if a forced rotation was relevant on this obviously anticipated very high profile case, especially for a judge on her first capital case
              i know nothing of her background in major criminal trials, i suspect it was very thin
              it required a very experienced judge, especially given arizona’s high percentage of appellate reversals

              my concern is focussed on her rulings on evidentiary objections, not allegations of bias, or “prosecutors judges”

              the judge’s duty is for impartiality between sides, and proceed according to law

              maybe stephens rulings are par for arizona ?

              the parties set out the times they’ll need, not the judge … otherwise, especially in a capital case such as this it’d be a clear cause for mistrial ?
              it’s not the judges whim

              in my opinion, stephens rulings on the defense teams continuous stream of objections during jm’s cross were terrible, and contrary to judicial law

              some of jm prosecutorial misbehavior which stephens allowed:

              yelling at witness,
              badgering witnesses,
              cutting off answers, with another question, and thereby forcing the pace of questions, so that the witnesses was not given adequate time to reply, and be forced into error,
              mischaracterizing answers, or evidence, and demanding a response to such mischaracterizations,
              demanding yes/no answers, and stephens enforcing jm’s demand for such,
              mocking witnesses, have you got a memory problem ?

              the list goes on and on

              some leniency in direct examination can be ok,
              but what was not ok was allowing improper cross examination, by jm

              the above were just some of jm’s more egregious abuses which were allowed by stephens despite a stream of objections

              impartiality is not the same as letting jm, or the defense, engage in improper questioning

              her age, and inexperience is irrelevant, competence is required

              i think stephens should’ve known she was out of her depth in being able to control this vindictive prosecutor, etc

  198. There is something that dawned on me today, guys. I think that HLN would actually prefer an acquittal or hung jury. I even think that is what they expect will happen. Yea and then AFTER she got the PTSD which would be COMMON due to what she had to do to survive (who wouldn’t develop PTSD) after having to defend herself and even if it was the two intruders, it STILL very common that ANYONE could’ve developed PTSD, AFTER such a traumatic event. so idk what the big deal is and I think this is what that juror that asked the bear/tiger question is thinking.

    • That’s a good question LC. I don’t know why the pros fell into this trap. The defense had to put this type of case on so they could get all if the hearsay of the sex tape, the ims and the texts in, so it would be clear what an ass Travis was. If it weren’t for that stuff, I wouldn’t believe her either. It’s actually not the experts that convinced me, nor even Jodi. It was Travis himself. Granted, I have had access to other stuff the jury doesn’t (reading his blog, viewing his myspace, Eddie Snell, etc.), but it was that material, and the jury wouldn’t have been privy to 90 per cent of it without the experts, which is the lynchpin of the case. To everybody who thinks that forensics should have taken a more showcased role, I ask you: If you had to choose between hiring ALV & Samuels, and hiring a Henry Lee type, IN THIS CASE ONLY, what would you do? I think that they made the right call, particularly in light of the weird way the burdens of proof fall in AZ.

      • The sex tape, emails, etc. were absolutely critical to this case. From the time they were introduced, the prosecution was on the ropes, mortally wounded. Travis Alexander sunk this case himself.

        It has been downhill for them every since.

        • The thing that bothers me about that though tonysam, is that that IM on May 26th, with all the nasty names TA called Jodi, where he went on and on, disgusting names, and it lasted for hours, went from texting to IM, then as you said, there is the sex tape phone call thing which is beyond pervy creepy, with those 2 HUGE pieces of evidence admitted, the jury has never asked questions of either defense witness about them. I kept waiting and waiting for them to ask both Dr Samuels and ALV about those and I just don;t know why they didn’t. Its just weird, if I was a juror, I would have plenty of questions about those things.

        For me it’s not an either/or. For me the tape of TA’s voice was the clincher and if I was a juror, I would have had great difficulty not making up my mind for a not guitly right then and there. I just wish for the jurors who really want to know about the scene and the injuries in regard to pre-med or self defense may go to deliberations feeling they are lacking a large piece. Alyce L. tried to get into her testimony about the so called “overkill” being indicitive of self defense, but I would have liked to hear more testimony just for good measure and to really close the deal for self defense.

      I never saw anything abnormal in her pre-Travis behavior, just the slings and arrows of … being unfortunate. She could have used a little help or counseling then, since she did not get the needed emotional support from her family before she met him, it would have given her strength to avoid falling into his and his cult’s claws. Travis is the one who destroyed her, she was just vulnerable. It must be the Vunerability Syndrome Disorder, which ALL children, MOST teenagers and MANY young adults suffer from.

      • She was one of these people who tries to see the good in people, but some people aren’t good at all or else they are horribly flawed like Travis. She was a sitting duck for a cult or a cultlike outfit like Mormonism or PPL/Legal Shield, and it took over her life and ruined it.

    • If you deny the results of a valid MMPI, then you are denying a huge part of decades of work in psychology & an important scientific basis in psychology. There is no reason that Jodi cannot have both some personality disorder, and PTSD, and that is what I believe. I also believe that this personality disorder issue left her more vulnerable to TA, then other women who knew better when to push him away.

I never advocated the DP but at the beginning of this trial, I was of the mind that Jodi might be a jealous obsessive ex of TA’s who killed him in a jealous rage because I was getting my news from bits and pieces of random clips. But after a few days of her testimony I was turned completely around and this was while still being bombarded by glimpses of HLN’s ‘off with her head’ mentality. I firmly believe there is more than 1 jury member who feels the same way. That Jodi is a peaceful, enlightened, though sometimes troubled,(aren’t we all) person but was in a situation where she felt threatened and trapped. That TA used her vulnerability to play mind games with her so he could further his control over her. I hate to speak ill of the dead but, Mr Right, he was NOT! And while I know the family loved their brother, families never see the true ‘relationship’ side of their loved ones. If I were them mid-way thru I would have requested a plea. Jodi does not deserve the hatred directed at her. I hope when the verdict comes down we will have cause to celebrate.

      • I don’t believe she stole any ring any more than she slashed TA’s tires. TA was a womanizer and I’m sure there were plenty of people who wished bad things for him. With that being said, there were three things that JD/JM snuck into testimony (at least put in jurors’ minds) that was not in evidence. Perhaps more grounds for mistrial?

          • JC…JD stated that Jodi told her that during one of the evaluations/test in jail. She used it as an example of agression she did state the Jodi told her her that during the eval she did with her in jail. I was having a hard time catching the whole story because Disgraced kept cutting in the testimony with her shitty comments so I could be wrong about that.

            • I was doing HW with the kids so I didn’t hear it either. Thank you. The examples of aggression I heard demarte use were weak. I remember her talking about jodi acting out toward her mother. While that wasn’t healthy behavior, Jodi didn’t show a pattern of having conduct disorder or oppositional defiant disorder which are often noted as the precursors in adolescents before being diagnosed as having BPD and ASPD. Nothing we have heard about jodi as a teen or young adult even comes close! It’s as if Demarte took some isolated incidents, ongoing depression, discounted past abuse and current abuse and labeled her with BPD.

  213. Is there a legitimate site to rate Demarte without having to lie? Where were the haters reviewing her? I would never leave a fake review of any kind on a book or on a patient site. Just curious about that I guess.

    My issues with her were as follows: she suggested the family and friends of sex offenders do know they have that proclivity. There is no data out there to substantiate that. I could cite all my sources but I’m sure most of you agree.

    My other issue was her touting herself as some expert on DV. She tried to suggest licensure equals being an expert when we all know experience is what counts. She couldn’t even recall a major researcher in DV – Dutton.

    While the haters drone on about AL hurting victims of DV, it was Demarte who re-victimized victims out there by minimizing what travis did while trying to demonize jodi in big words.

When questioned on cross yesterday, she admitted she wasn’t an expert in DV but backpedaled today and said she was an expert because she has worked with people who were battered as well as those suffering from other issues. If you asked her if she were an expert in treating pedophilia, she would say yes and did say that yesterday. She used her degree to substantiate that she was an expert in everything. LOL

            You know what, I’ve really never driven in my life due to a seizure disorder. But about 20 years ago, I got my license because I wasn’t having regular seizures. I took JUST enough driving lessons to pass the test. I have never driven since and wouldn’t have a clue what to do. But I guess I was an expert in driving for those 5 years because I had a license, right? Therefore, I could have testified about bad drivers and/or good drivers. After all, I had a license to drive. Right?

        • Clinical psychology is just one aspect. There’s existential psychology, social psychology, abnormal psychology (where pedophilia would fall). Having a PhD in clinical psychology does NOT make you an expert in all aspects of the field.

Sexual abuse of children exist, in all areas in the Catholic Church it was 80% were Teenage boys and Homosexuals or they called themselves that. But most Families etc Most Child Molesters are protected by their family, and most of the time hide there behavior. How could Dr.D make such a gross statement contradicts the psychology of a pedophile.

    • I think her admitted inability to empathize with abused children upon meeting them is going to hurt her with the jury. No one likes to think of anyone not caring about a child. If we have parents/grandparents on the jury, and I’m sure we do, I bet at least some of them were thinking “I’d never take my child/grandchild to you for treatment.”

  216. I thought this was a juror question this afternoon to Demarte that might help Jodi.

    • Oh boy, I had my hair highlighted from 16 (when I went to college) until about a year ago (when I dyed it brown to avoid my ex finding me after “someone” hit me up with a tracking device as I was getting on the train right when things were HOT in my divorce). I don’t have implants, but have considered breast reduction. And I’ve often said I felt abandoned. I also had a boyfriend who I worked with a long time ago. I knew he was cheating on me. I checked his messages and stole a few of them that were from girls I knew weren’t clients. And let’s see, what else? Oh, I called a girl he WAS cheating on me with when I caught him in a lie. She didn’t know about me, but after I told her, she came over to my place. We stayed up all night comparing notes about him bedding one of us in the morning and the other for lunch, without even changing the sheets (ewww), and cutting up stuff he’d left at each of our places and then put them in an overnight package to reach him at work the next day. She forwarded her phone to mine (this was before cell phones) and when he called either of us, we answered, but hung up. I guess we’re both jealous murderous stalking borderline bitches, right?

        We do stupid things when we are in relationships especially when the trust is broken. Been down that same road as you………….. Once I got rid of the ex, the rainbow came out, and life was a DREAM………. couldn’t be better. Only takes one person to put us ten feet under, making you feel like a midget looking for ants, and thinking your a piece of crap. Once that person is gone, you realize that you were in a unhealthy relationship.

        This doc today, twisted everything to help JUAN……. and the state. The freakin judge was even smiling at her… very bias .

        I hope we have some smart jurors that make the right decision for JODI…………

Whether Jodi has BPD or PTSD or whatever, if I were in her shoes during that most crucial point in time and that MF’er got pissed with me for dropping his camera and I was scared to death he was going to hurt me, I DAMN sure would have defended myself. AND, if that resulted in his death, I would have been devastated. HOWEVER, if we all examine ourselves, we will realize that we will protect ourselves and those we love in whatever measure we find reasonable at the time we feel the threat.

      Other may state this better… I totally agree with defending yourself. Anyone out there please correct me if I’m wrong. JW and KN are fighting tooth and toenail for the jurors to understand how important a PTSD diagnosis is. PTSD can be treated, the person can be helped. If JM get a Dr. to give BPD diagnosis and he win a conviction..it like saying ,,no cure for BPD, she deserves Death.

      • If there is a conviction, it would set back the mental health field years by trashing her with that kind of diagnosis.

        • It is treated with psychotherapy. There is no medication for it, like there is for Bi-Polar or Schizophrenia for example. If she does, in fact, have this disorder, only talk therapy is helpful, and that isn’t something she is likely to receive in prison.

          • Medications with mood stabilizing properties, such as lithium, and some anticonvulsant (anti-seizure) medications, have been used to treat the impulsive behavior and rapid changes in emotion that are associated with BPD. There is research to suggest that these classes of drugs may be useful in BPD.

            There are several types of antidepressants that have been studied for use with BPD, including tricyclic and tetracyclic antidepressants, monoamine oxidase inhibitors (MAOIs), and selective serotonin reuptake inhibitors (SSRIs). Research has shown that these medications may help with the sadness, low mood, anxiety, and emotional reactivity often experienced by people with BPD, but they do not seem to have a strong effect on other symptoms of the disorder (e.g., anger, impulsivity).

              True, meds are sometimes prescribed for symptoms associated with BPD, and I guess there are some that can help with anxiety, depression, etc…..I just meant that as opposed to say, Bi-Polar, where medications are approved and warranted, there really isn’t any medication approved for treatment of BPD. I didn’t mean that there aren’t meds that won’t help with, for example, agitation, or other symptoms etc, just that there isn’t a medication therapy for this disorder.

          I will tend to agree with you, that bear vs tiger question is bothering me a little. At first I thought of it as positive. (I wish I didn’t over think things) Anyway, as I went about doing a few things here at home, I started thinking about it more, and recalling Dr Samuels testimony and the PDS test, and mostly the HUGE amount of juror questions, most of them sarcastic and accusatory. He said that even though Jodi’s trauma on the test was based on the intruder story which was a was a lie, the test was still valid, since an actual trauma had happened. Meaning his result was valid etc. This Dr disagrees. Then this question about the lion vs bear….could they be agreeing with her with this rather silly scenario of hiking and an attack by a wild animal? I mean, hiking and a tiger attacks??? I started thinking more and more how actually sarcastic many many questions this jury has submitted have been. Remember the “haircut’ question? I don’t know, I was really hoping there would be many many more questions, I am having a hard time with the fact that there weren’t. I know people are saying that can be good, but to me, I take it as they are believing her and have very few questions. I say this because Dr Samuels and ALV had well over 100 each. It just doesn’t feel right to me. The tone of these questions were not like the others either. It is just alot different and it makes me nervous.

          • I guess I am over-thinking too. Fewer questions, apparently from only a couple of jurors, means the jury isn’t a) questioning her findings, b) questioning her credentials and, c) worse, no one questioned her diagnosis of borderline personality disorder.

            There was discussion from one of the talking heads that some with a personality disorder is more likely to get death penalty because a personality disorder cannot be rehabilitated. That seems horrible to me as if something is actually wrong with someone, they shouldn’t be put to death. But I don’t support DP anyway.

  223. Dr drew makes me angry. The whole network has turned my stomach with their one sided coverage of the Arias trial. They have labeled Jodi guilty for months, how is this reflective of the America they claim to love? I am Canadian and as far as I know, you are supposed to be innocent until proven guilty.

    It is irresponsible for a network to incite such anger and hatred towards a person who has not been convicted.
    Also they are really mimicking bullying behaviour with their innuendo, opinions and conjecture.

    The way they throw around psychological terms like psychopath, sociopath etcetera is making the terms mean something they are not intended to be.
    They throw around buzzwords and talking points to get ratings. If they truly cared about due process, they would have both sides of the story.
    I don’t think having defence attorneys on their show who clearly are of the opinion that she is guilty counts…

    Also Abused – I watch your posts carefully and am sorry you have been gutted and feel attacked on your posts. If I may suggest, stay as professionally detached as possible, as hard as it may be, until the end of this circus whenever it occurs – and then let your emotions flood. I know, I know….easier said than done.
    I cherish your posts and thank you for your insights.
    But, one question for you and the other legal eagles. I heard JM question Dr. D today and I believe the door truly opened to solidify Self Defense and I would like input as to how I am right or wrong, and most importantly how it can be capitalized upon by the defense team.
    Dr. D said TA escalated when JA lied, etc…..just fill in the words that were used when she testified….and that is when TAgot so very, very upset and used all the “inappropriate” language towards JA.
    Isn’t this the perfect stepping stone to show how TA ESCALATED and physically attacked her on the death date? He felt (lied to, betrayed, put down….whatever the words were) and he Finally Over-Escalkated and attacked JA physically and not just verbally, which is all he was able to do with texts, IM’s, emails, etc.
    Why do you think the defense team missed this….or do you think thet will use it in the near future?
    Thanks for your attention and I would really appreciate your thoughts.

    • DB, I am not a legal eagle like Al or Also Abused but I see your point. There are many times in this trial that my lack of legal expertise leaves me wondering why something was not brought up, jumped on, or emphasized. (Usually I conclude that it has to do with strategy.)

      I am sure that in closing arguments the defense will state that Travis had reason to escalate by the beginning of June. He had lost Lisa, Mimi had made it very clear that she only wanted to be his friend (and he had had marriage hopes pinned on Mimi), Jodi had moved away – a fact that was obvious to all in the community who knew them both, (so if he had characterized JA as a stalker – even the so-called stalker had ostensibly lost interest in him), and he had financial stress. We are not privy to all of Travis’s “stressors”. (Spell-check is telling me that that word is spelled wrong. I learned about “stressors” and how they trigger violent crime from reading books by FBI Behavioral Science guys.) We don’t know, for example, what the Church Elders were actually saying to Travis about his age and what was expected of him on the marriage and family timeline. When Jodi showed up, he was well aware that she was actually on the way to Utah. Perhaps he sensed that she was taking pity on him.

      Jodi said that his anger began to show when he saw that the CD was damaged and she tried to calm him down with sex – again. When she dropped the camera he likely felt that everything in his life of value was either disappearing – she was ready to leave at that point and had the car packed – or was broken. Maybe he was afraid that she was leaving for good or that they might end up just “friends without benefits”. The thought of completely losing Jodi probably really frightened him because she was his confidante and sexual outlet. She meant so much more to him than he could really accept and it was hurting him more than it was hurting her – at that point – to keep denying it. He must have felt so alone when he saw her dressed and ready to go, with more of a sense of herself than he had seen for a long time. After living in Yreka for a few months away from him, she must have seemed like the woman he’d originally met and was so attracted to.

    • Hey DB, thanks so much for the support. I’m an emotional person, so it’s kinda hard for me to bottle it up, not to mention, it’s not a good position for me to be in after bottling up abuse, so I let it out. And then, have a glass of wine, and feel better 😀

      I agree with you that was a perfect opportunity to highlight more about intimate partner abuse and highlight the more recent criteria/information that has been studied (debunking and even criticizing Lenore Walker’s work — much as it was a leading authority at the time she put it forth). I’m very disappointed that the defense hasn’t “highlighted” (hate to use that word) more on the subject. I think they’ve missed a golden opportunity. The truth of the matter is, not many people really understand intimate partner abuse at all. JW, as much as she tries, I really don’t think she does understand. I think she missed the boat on many occasions this afternoon. She was on fire for a while and then, she got bogged down in the scales and kinda lost her place. I doubt Jodi understands the subject well either, and perhaps, JW stopped somewhat at Jodi’s bidding. I don’t really know. I’m lacking in knowledge of their strategy right now.

      Unfortunately, the only time they have to address the court again is in closing arguments. But they can’t speak about something they didn’t prove during the trial. And I personally think tot doc gave the defense theory some serious hits that weren’t clarified. I hope I’m wrong. I really do. But if I was the person I used to be (before my ex) and didn’t understand intimate partner abuse, I wouldn’t get it in this case at all. I learned some hard lessons about it. I really thought JW was going somewhere when she brought up Mary Ann Dutton yesterday. Instead, she let it be and left the door wide open for JM to come back at his witness and talk about Lenore Walker’s book which is sooo behind the times, regardless of how many revised editions she comes out with. Joujou said earlier, first lesson in trial law is when you’re winning, sit down. But I didn’t feel JW was truly winning. I saw far too many openings for JM. JW must have thought by proving tot doc wasn’t an expert in domestic violence, she won. I, personally, from my own experiences, know that it takes a lot of time to educate anyone about the subject. A few more minutes on current research, on the misdiagnose of BPD in women with PTSD after abuse, and less focus on scales on a psych test that will lose the jury .. well, that might have discredited tot doc entirely. But JW sat down. Oh well.

      To answer your question, escalations of anger followed by violence, are so common in intimate partner abuse. For me, a victim/survivor, I see right through it. Will the jury? That’s anyone’s guess.

    Funny you said that, I have been thinking all day and for some time, actually, that all the mental diagnosis, really, the entire psychological side of this case has been focused on too much IMHO. I know I am not the defense attorney, and they did need to explain amnesia during the killing. But this side of the testimony has gone on so long, that I am afraid the jury has begun to get bored, or worse, confused, Tests, diagnosis, etc……the real point, the real fact of the matter is self defense. Not BPD, and not even PTSD, but what happened that day in the bathroom. Its ok to explain what happened in Jodi’s mind, but I feel they have belabored the point for far too long. I am sure they are ready to move on, and have been for awhile, just my 2 cents.

    • I agree. Far too much focus on tests. Nowhere near enough focus on the mental state of an intimate partner abuse victim. While the defense didn’t have to prove self defense, that’s the winning ticket. Because if the jury finds Jodi acted reasonably, as an abuse victim (not just as a regular person), there’s nothing further for them to consider. I feel the prosecution threw a huge wrench in their theories … doubt. And still, as I’ve harped on many times, no explanation was given whatsoever for the “overkill” (throat slashing).

      I’m not bashing the defense. They’ve walked a tightrope here between saving Jodi’s life (and I believe wholeheartedly they have) and presenting the self defense justifiable homicide case (which I believe they’ve done some good things in, but dropped the bomb in other areas). The jury is bored with testing and basically, at this point, the experts cancel each other out at best.

      Tests? Whatever. How many people here, especially those on a jury comprised of mostly older people, have ever have a test, been told it was normal, and then subsequently, called back for follow up because there was an abnormality noted? Or, vice versa. You have a test done; you see serious faces. Then, the doctor comes in and says you need a follow up test and it could be a, b, or c. You freak out because it *could* be cancer. You go in and have the follow up test, and doctor calls you all smiles to say it’s nothing. Or worse, you go see the doc with symptoms. He/she runs their tests and tells you they can’t find the reason why you’re sick. You’re still sick a week later, and a week after that. Sure, I’m talking medical tests, not psych tests. But just think about it for a minute.

      When you’re up against someone like JM, much as I hate him, you have to realize he’s one tricky and brilliant bastard. He uses what he has going for him. And he does it from memory. He doesn’t use notes. He doesn’t shuffle papers. He’s confident and downright arrogant and he hammers home his points. He confuses the witness, but he’s rarely, if ever, confused himself. He knows the point he wants to make, and he makes it. I can’t stand his tactics and techniques. But I can’t say he’s not effective. And he’s downright sneaky, unethical and bordering on contempt. In most other courts, his tactics would be shot down. But he knows his audience, and he knows what he can get away with in that jurisdiction. I may not like it, but as the old saying goes, you gotta fight fire with fire. I’m not saying JW should have acted like him. But her shuffling papers, long silent periods, inability to find exhibits when needed, and her overemphasis on tests, tests, tests, was not the most effective way to handle this.

      I really really really hope I live to eat my words here and that Jodi is acquitted. But to me, because of what JM was allowed to do, tot doc or not, he made his point and cast serious doubt on self defense. I say there’s no way Jodi gets the death penalty and I sincerely truly absolutely doubt she gets life without parole. But for me, the biggest stickler in this case (and Al and I have concurred on this several times) is the throat slash. And there wasn’t one single piece of justification given throughout this trial for that or even overkill in general. Whether the burden is on the prosecution or not, the jury needed something to hang their hat on, and they didn’t get it. So, my belief is Jodi gets a lesser included offense. I hope I’m wrong. I really do.

    She did not dye her hair after June 4th. She did not even try to cover it up. Everyone on her facebook knew she was now a brunette. There ya go haters, no premeditation. Why would she dye her hair to try to disguise herself, but then post about it all over facebook!

          But that doesn’t prove premeditation anyway. And JM has completely dropped that issue because he was caught pants down on it. I have no doubt the defense will use that at closing arguments to discredit his premeditation theory.

    Comparing Jodi Arias to Ted Bundy and mischaracterizing Travis Alexander’s abusive text message or IM which assassinated her character is just beyond the pale.

    I am really afraid what will happen to her if and when she gets out.

    I hope she and her family have access to a civil lawyer to sue that outfit for defamation.

  231. So I have been searching the internet to try to figure out where this ring thing came from and the only place I found is HLN. Shannon Hogan was on NG saying that TA had a ring that JA stole. And we all know where she got her information from. Hearsay twice removed and why JM wouldn’t put someone on the stand to testiy to this. I think JD going along with this is beyond any ethical boundaries Dr. Samuels and ALV crossed. JD never had to explain where this information came from, because if it was in the emails or texts, why wouldn’t JM have brought this out with Alyce.

      I thought he didn’t quite make enough money for it, or did they give out rings for different levels of sales?

      There’s been so much information or disinformation about this trial I have lost track.

      • Really isn’t that the truth because all this crap is coming from friends of TA, who are making up one story after another and JM is doing whatever he can to get these bullshit stories in without any proof and the defense has no chance to counter act on them. I had a low opinion of JD, but now it is even lower if that is possible. She repeated what JM wanted her too, without any evidence to back it up and I hope it comes back to bite her.

        this is according to Beth Karras or Jean Ceasarus, (sp)
        She said that it was a ring that TA had bought for an old girlfriend many years ago named Linda. This girlfriend told him that he needed to stay in school or go back to school, (I forget which) and not start working with PPL, or she wouldn’t stay with him. He said no, he was going to work for PPL, so they broke up. He kept the ring, and was going to trade it in eventually for a nicer one for whomever he proposed to one day. No idea where all this info came from originally.

        • Shanna Hogan who got it from TA’s friends, who really know how to tell a story, and how it ended up being spewed from that women on the stand, did she talk to TA-no, was this in an email, if it was where was that? TA had many people in and out of his house and never locked his doors. This should never have been brought up with any thing to back it up.

          • It’s too bad the defense couldn’t have had someone refer to the stolen gun as a .22 caliber instead of a .25 caliber. It might be true; it might not be true. As long as the jurors hear it. If the prosecutor can have a witness drop unverified information into the case, why can’t the defense do the same thing? Too late now, I guess.

    • I was thinking about that too. The only difference between the information tot doc reviewed and ALV reviewed is what? Think about it. They both reviewed the same correspondence and police interviews and TV interviews and interrogations. So, what else is there that is different? Get it yet?

      Answer: Travis’s brother Steven. So, where did tot doc get the information? It has to be from Steven. It seems it was a rumour perpetuated after Travis died. Maybe one Travis started BEFOREHAND. He might have pawned the ring and someone said “oh show me again that ring you bought Deanna that she refused, Travis, so sad!” And Travis might have said “Jodi that stalker bitch, stole it.” After his death, someone told the family. Steven told Flores and/or JM. And there you go.

      Am i wrong? Was it in some other interview? I don’t know. But this to me, seems to be the only logical conclusion.

      I’m also worried about all of us. If we expect an acquittal and don’t get one, we’ll be gutted. I was a person who believed in positive thinking. I wrote a book on the subject. I toured the country speaking about it (usually opening for opening speakers — I wasn’t famous). And then, in the depths of my despair, I remembered what my grandmother said: expect the worst, hope for the best, you’ll never be disappointed.

    SHANNA HOGAN, JOURNALIST: Yes. In one of Travis`s previous relationships, he was in love with a woman, and he actually bought an engagement ring. And at one point, he — it ended up not going through. He didn`t get engaged, but he kept that in his house.

    And during the time that Jodi was living in Arizona, she had actually come into his house several times. He had caught her breaking through the doggy door. And one point he noticed that the engagement ring had gone missing and was very suspective [SIC] that Jodi was the one who had actually stolen that ring, because she could not stand the thought of him having something that tied him to another woman.

        • Ladies, gentlemen, ever given your number to someone you met on a plane after a riveting conversation? I sure have. Risky behaviour???? Once upon a time in my life, it was part of networking.

          Today, as an abuse victim/survivor, with my ex still alive, I don’t give anyone my number and I have a Google Voice number I can change for $10 within minutes. Giving my number out IS risky behaviour for me today. My mail gets filtered though my state’s address confidentiality program to a PO Box, then to another PO Box, and ultimately gets picked up randomly and infrequently by someone other than me, and only people I trust, who then give it to me in person. It means that it takes forever to get my mail, but I eventually get it. Packages get sent to a PO Box and thereafter follow the same process. Or, I send them to other people, or have them order stuff for me. It’s all random. I never want there to be a pattern anyone could prove of where any sort of mail or overnight mail goes. My ex has ways and means of tapping into those. My job doesn’t have my address either. If they pay for me to take a cab home, I have the driver drop me off at random places and walk the rest of the way. I don’t let anyone have my address or real number. The court gave out my confidential address they weren’t supposed to, but I was smart enough never to have given them my real address, and all they had was a UPS Store address. As I suspected might happen, they gave that out but it’s nowhere near where I live, and once I discovered it was out, I discontinued it immediately. So I remained alive. It’s not an ideal life and it costs more this way, but it’s kept me safe and alive for the last 2 years and a month Giving out my real information today, that’s seriously risky for me.

          But back then before my ex, puh-leeze! I gave out my cards like candy.

          Is the witness allowed to watch HLN if they are on the witness list? I thought they are told not to?

          It seemed every negative comment made about TA was never allowed regardless of the source but every negative comment, real or alleged, about Jodi was gleefully allowed inside this court room.

When JD was talking about personality, she said that Jodi, on the flight home from the memorial service, exchanged phone numbers with some man.   236. Whew, finally finished watching today’s testimony.

    On the bright side, the Lion and Bear question shows a juror on Jodi’s side and the reply was bogus . . . I would assume either event could lead to PTSD unless one was a teddy bear 🙂 JW also did a great job of tripping her up on what she didn’t know . She sounds like an expert, but she reminds me of a sophomore, which means fool. The saying is Freshman don’t know anything, Sophomores think they know everything, Juniors are starting to realize they don’t know it all, and Seniors are wise enough to know how much they don’t know, but how to find the answers. Samuels and LaViolette are Seniors and DeMarte is a Sophomore.

    On the negative side, two big heresay things got in: A stolen ring that JM had to rephrases as a ring she took, but with very dramatic pauses, and the flight from the memorial service with Jodi getting someone’s number on the plane and then calling him. I wanted to go back and listen to that again after what I saw on Twitter, but I can’t find it.

    Anyway, bottom line is it seemed like more help than harm today, so that is good.

  237. Just listening to the Juries questions now.I think the jury is very bias, there questions were very mild not at all nasty like they were to LaViolette and Samuels and him filling in the answers or something.

    • This jury should have been sequestered. I think anytime a trial is televised especially, the jury should be automatically sequestered. After watching all the bias crap I saw on HLN, I think they should quit televising trials.

They are not sarcastic and shitty like they were for Dr Samuels and Alyce,the ones they had for those 2 witnesses were LOADED with sarcasm and even hostility at times,now, they asked about who filled in that sheet on the test, they asked about the “no jury will convict” comment, overall do not seem to favor defense IMHO. The main thing to me, was that were so FEW of them. I know that there were easily over a 100 each for Dr Samuels and ALV and just a few for this witness??? Why?

        There were very few I was working couldn’t watch JM but saw JW and the Juries questions, they were very respectful to Dr.D. Since its the prosecution that is suppose to have the BURDEN of Proof it looks bad that the Jury was so nice to Dr.D and NOT nice to Samuels and LaViolette.

          I agree, They were extremely respectful to her! I had assumed that there would be several questions, actually MANY questions from them about her background, her career, experience, years in her field, etc etc…nothing! To me, no questions regarding her degree and experience means just that, they don’t question her experience. Next…NO snarky questions at all, nothing sarcastic about her test results or how she tested, how long she spent there, who else she spoke to, like they had for Samuels and ALV. They GRILLED those 2 about their techniques!!! And the grilled them about who they spoke to, how they asked questions, every little detail. They asked her practically nothing. It just can’t be good to have so few questions for the pros. and hundreds, mostly shitty for the defense. I am TRYING not to let this get to me, but I can;t help it, it IS the jury, and it bothers me alot. Yes….the burden lies with the State….and if you put ALL the questions in a BIG pile and read them all back to back, it doesn’t sound very good at all. And that isn’t even adding in all the questions they had for Jodi. I’m more than a little upset.

          • I’m glad you guys noticed some of what I felt and got slammed for earlier. I feel like a human being again 😀

            I think it’s important though to remember that criminal juries are inclined to believe the prosecution at the beginning of the case. The prosecution represents the state, and is supposed to be the representative of the people of the state. The jury are the people of the state. Most people think defendants lie and/or hire fancy lawyers to get them off. Plus, in homicide cases, the prosecution goes first and they see all the nasty crime scene photos first. So, they *are* biased. But, they’ve sworn an oath to consider ALL the evidence before reaching a verdict.

            Gradually, as they sit there day after day after day, which are mostly boring days, especially with technical experts, cops and medical examiners, they start to wonder if there’s something more exciting about this case. They can’t talk about the case while on the jury, but everyone wants a fascinating store to tell at the water cooler or dinner party afterwards. “So, Joe, I heard you were on jury duty the last few weeks/months. Tell us about the case.” Instant conversation starter. Everyone gathers around to hear the tales. As such, at the end of the prosecution’s case, most jurors have kinda tuned out.

            Then comes the defense case, and it’s sort of exciting. It’s something new. In this case, there were lots of salacious details. Quite brilliantly, the defense kept Jodi on the stand for ages. The jury might have become bored with her after a while. But, she was right there in front of them, the woman who engaged in juicy sexual acts, and who ultimately killed this guy. They heard about every aspect of her life. They started to call her “Jodi” not just “the defendant”. She became a person to them.

            At first, Nurmi might have seemed a bit slow to them. He’s a heavy set big guy who talks slowly and in a sort of monotone fashion. But he got out a lot of details. And methodically, slowly but surely, he made his points. Contrasted with the short aggressive, often belligerent prosecutor, the jury’s interest was held to some degree, at the very least. They don’t know the ethnicity of Nurmi’s name. But his voice is soothing and he exhibited a great deal of compassion to the defendant .. the murderess .. and they saw her as a regular girl, too, quiet, soft spoken. Then, they saw how smart she is and how she held her own against the short ethnic aggressive prosecutor. That may have turned some of them off a bit, but they knew Jodi by then. They’d watched her every single day. She wasn’t just the defendant anymore. She was Jodi, a regular girl, who could be their kid, their sister, their neighbour. She was also a beautiful smart girl who could have gone far in life, done anything, been anything. What the hell happened?

            Then, the defense switched it up with bubbly Jennifer, a fast talker who is energetic, quite the opposite of somewhat casual but confident and slow talking Nurmi. She’s an All-American girl. She brings out likable Dr. Samuels. He presents a lot of interesting information. It’s stuff the jurors can use in conversation too. Everyone knows a war veteran or relative of a war veteran in this day and age after the country has been at war for over a decade. Now, the jurors can speak with some confidence about PTSD. “I heard about it in this trial, I was a juror in.” “Really, tell me more.” Then, the ethnic aggressive prosecutor rips him up and paints the picture of a befuddled professor. But did he ruin everything Dr. Samuels said? Maybe not quite (per today’s jury questions anyway).

            Next up is the folksy lovable Alyce LaViolette. For days, the jury truly enjoyed her. They were riveted by her tales and looked forward to serving their duty, as long as it had been, by then. Whether they believed them all or not, she told a compelling story. She schooled the prosecutor more than once and he never really discredited her. She seemed so wholesome and caring.

            But the jury was getting bored. They wanted something different. JM banked on this. He gave them an inexperienced but very book knowledgeable expert — a complete contrast from the last two. He kept it brief. His point was: I had to grill the last two phonies. Now, let me give you someone competent who tells the truth without all the fluff. He didn’t want a witness with stories. Fresh was a contrast he wanted, and he got it. And the jury got what they wanted too. You have to keep them interested. And they still are. Even though some days have been tedious.

            Thinking about it, perhaps Nurmi should have done the cross on tot doc. But I’m sure they divided the work and JW was the one who wanted to do the psych/dv work. Nurmi focused more on other experts. Still, I think if he’d crossed tot doc, with his slow methodical, unseeming methods, it might have been more of a contrast. He’s unfazed by anything. He also recovers very well. JW got frazzled. She didn’t appear confident even when she was winning. And she lost her place too often. I’m not blaming her. It was a lot of stress. But although she quit while she was somewhat ahead, she left too much that was open for JM on redirect. JM is a tiger in the courtroom. Give him an inch, he takes a yard.

            When all is said and done, will the jury believe two experts with 30+ years of experience who were both likable and personable, or a smarmy booksmart woman with little experience and extreme confidence? Who knows.

            But the one thing I believe the jury was waiting for after Dr. Samuels and ALV, was an explanation on the overkill. One or two of the questions submitted to ALV bordered on asking that. The jury never got that answer. And that’s the biggest hole I see in hoping for acquittal.

            But, as I’ve experienced personally, you just never know with a jury. They can surprise you beyond your wildest dreams. What happens in deliberation is truly magical.

            I realize much of what I’ve said above is an unpopular opinion here. I don’t expect everyone to agree at all. But please don’t attack me for it. I’m on Jodi’s side, and if you don’t know that by now, well, you haven’t read many of my posts and probably haven’t read any.

              She was confident during direct with J.M., but during cross, all that water-guzzling/hand-wringing/nostril flaring, betrayed her for the inexperienced, rigid test-giver she is.

              You are very smart, I think you are right you can never tell with Juries, But the difference was night and day. Your right about over kill which I believe that PTSD would explain, The fact that Jodi’s Parents berated her stated she was always a problem is not good.
              I was not happy with The Juries questions. They made their mind up in my opinion.

She seems to be a Narcisist, that is listed underneath the Personality Disorders she keeps trying to put on to Jodi. Martinez’ act is so damn stale already now he is bringing up topics already discussed, and found to be not pertinent. in this trial.

    Jennifer had her stumbling today. She couldn’t even remember articles she supposidly read just last week about DV. This girl is so inexperienced in the fields of PTSD, and DV it is funny. This is the best Martinez could do for his so called expert.

  239. UNIDENTIFIED FEMALE: Let me ask you this about the MCMI (ph). Is a person able to fake their answers?

    SAMUELS: If someone had studied the construction of the MCMI, or any psychological test, for that matter, meaning they went into the literature, did a comprehensive examination of why particular items were chosen, how to answer various items to throw off the test, it`s conceivable that it can be done. I might be able to take that test and generate a result that isn`t consistent with my personality.

    However, the average person is not sophisticated in that area. Literature has to be searched for, and it`s not always very accessible, and it`s complicated. And it requires an advanced degree to truly understand how these tests are formulated.

    So while it is possible, it`s highly improbable that someone could feign the results on the MCMI. And also, there are certain validity indicators within the MCMI which would detect when someone is either distorting or lying. There are certain characteristics that are pointed out to you so that you may need to take with a grain of salt some of the results that you obtain.

    UNIDENTIFIED FEMALE: All right. And with regard to Ms. Arias`s validity scales on the MCMI, how did those come out?

    SAMUELS: They came out within the norm.

    UNIDENTIFIED FEMALE: OK. So no concerns, then.

    SAMUELS: I had no concerns.

    • I didnt dislike Dr Samuelsbut there is in fact, an issue with him and his testimony.Thats a fact, the jury made that clear. He certainly could have done things a little better, been a bit more organized. I did have a slight concern with why he chose to administer the MCMI test to Jodi over the MMPI. I know its still valid, it just seemed a bit unusual. I also know he gave her the PDS, and that was a good idea, but the fact that he wrote the answers himself while she took the test did not seem very professional to me. It just didnt make sense, he had the answer sheet available, he is a psychologist. I think it just made the jury suspicious, and in fact, they questioned him about it several times during juror questions. He also scored her test and made several errors when he transposed the scores from one paper to another. Then he admitted on the stand, twice, that he should have re administered the PDS to Jodi once she told him the story about the intruders was a lie. The jury hammered him with over 100 questions, and many were downright hostile. I do not believe they have taken much, if anything, he testified to at face value. Its a shame too, he just made a series of bad choices.

    1) Did anyone notice how DeMarte apologized to Wilmott early on today for mis answering a question…hmmm I thought she said she doesn’t apologize?? She doesn’t feel the need to as a professional??

    2) DeMarte admitted to not being a trauma or domestic violence expert but she says she is an expert per her license? She is also not a member of any Trauma Associations nor has she ever attended any of these conventions or events specifically, but yet she is still an expert?

    4) When Wilmott referenced an event from Jodi’s journal today how come when DeMarte was asked how could she not even recall it? Sounds like she got paid for research she didn’t complete thoroughly, could it be because she was already in JMs pocket??

    5) DeMarte said Jodi told Dr Car and Dr Samuels more information than Jodi told her. It’s completely conceivable to understand why after observing DeMarte’s stone demeanor. I wouldn’t open up to her either. And because of this obvious fact, DeMarte’s test results of Jodi should be deemed as I admissible in court.

    6) I could be mistaken, but I thought I heard DeMarte say she didn’t get the chance to read all of TAs correspondence with Jodi. How is it possible to make DeMarte’s characterization of Jodi and TAs relationship admissible in court when she doesn’t have enough supporting evidence to make an informed decision about TA at the very least. Furthermore, she stated that TA spoke to Jodi like shit when he “felt” she lied to him? First of all how can DeMarte characterize TAs feelings when he is deceased? she even said earlier that she couldnt speculate on his behalf because he was deceased. The more she talks the more she digs.. She she not be allowed to provide professional opinions on something she hasn’t even concluded her research on?? Is it me??

      They are in evidence, at least part of them. And ALV also saw them all and formed her opinion in part on them, so it’s not unreasonable to believe they were available to tot doc. .

    • I am still trying to figure out why Dr. D said she just ignored entire chunks of the test results and that this was a common practice by psychologists (on that personality test). Huh? If the psychologists don’t ALL give the tests the same way and evaluate them with the same protocols, then WTF good are they in terms of those fabled DSM diagnoses? Clue as to WTFness: The S stands for Statistical.

      BTW also love the way Dr. D had to look so much stuff up, vis a vis what acronyms were, to be precise with her “verbage”. (Looked up waaay more acronyms than Dr. Samuels – he only double checked the name of the PTSD test. Everything else he looked up was data about Jodi.) and he was slammed for looking anything up at all by those self-serving license abusers on HLN.) Does all this searching she conducted today for precise test language mean that if Dr. D were given her license exam on April 18 at 9:00am she wouldn’t have aced it? I thought she was supposed to be a whiz bang.

      If experts brought in to trials are there to clarify for the jury, then why do you have a generalist like Dr. D clarifying the work of specialists like Dr. Samuels and ALV? I think her testimony should be thrown out.

  246. There is definitely at least a few critical thinkers on the jury. Given that access to education is so much easier these days, I would bet its at least 50/50. Further, psych 101 is probably offered at just about every edu institution.

    No way will Jodi be headed to DP. Not only are some of those questions from the jury good for defense, but in a group of jurors theres bound to be at least 3 who have known someone like Travis who has played with either their own head, or a loved ones head. This conclusion, I’ve based just solely on the fact that stats for sex crimes on women are 1 in 3, and most do not tell. And while I do not think TA date raped Jodi (even tho he did mess w her while sHe was sleeping and that could have been construed as very similar),…from this one could conclude that since there will be jurors who understand based on their own personal experiences that they will not find her guilty. It’s obvious Travis was a pig toward women. The defense did an outstanding job showing that, which is also why I think Jen chose not to totally go into what she could have with the MMPI testing… And this premise is also based on the human fact that we can and will be biased, especially with something so emotionally charged. There are bound to be some big biased opinions coming out in deliberations that will lean both ways, and IMO, more in favor of Jodi.

  247. Oops. Posted above without saying, even though I used the example of date rape, I was trying to get at abuse in general. Someone if not a few on that jury will get it.

    Even with the bs about her getting on his FACEBOOK and what not, I think will not hold much weight. We all know people who have done that…it doesn’t prove premeditation.

    I mean, to me, they were both messed up and in a f’d up way co-dependent in an extremely mentally sick relationship that obviously had a real bad ending. With that said, Travis was very much so the more powerful instigator of the two.

    Also, about her CV, didn’t JW asked her specifically about whether she gave presentations about DV other than the poster presentations she gave before she got her license and she said no? Now it seems like she just didn’t want add those things to her CV because she doesn’t think anyone would be interested in reading about that? Doesn’t that defeat the purpose of having a CV to begin with?

  252. I have a good friend in the US and whilst she has always told me that in the US if a woman is abused, its her fault, I didn’t know how just how bad it was.. until now when I see and hear it with my own eyes and ears.

    Its straight out of the Middle Ages.

    I think President Obama ought to step in and put a Stop to this Right NOW and STOP the State ruining Jodi’s life any further. Its totally and utterly inhumane. But a normal blood sport for the USA. I honestly cannot find words strong enough to say how I feel about this SHAM of a trial, and how America treats abused women–because none would be adequate :/

    • You know, until this trial, I didn’t know how bad the domestic violence could get. Sure, I’ve seen a lot of movies and shows which depict women in situations as these and then they snap. But I never felt I was getting the whole story. This forum and this trial has opened my eyes big time. I mean I’ve always empathized, but now I actually have a better understanding.

      And this chick is pretty much shitting on all victims. It’s despicable.

    • Not that I had much faith to begin with. Watching the Prosecutor and Judge has shown me how bad it is. This is a serious case with a woman’s life at stake. The media has made a circus of it. While I hope there is just one juror who sees that Jodi was abused – I am afraid, at this point, that Jodi will be convicted. God I hope I am wrong.

    I’m new to this site, and so happy that I found it. I was ‘Jodi’ years ago, and our stories strike a very eery (sp) parallel. My heart goes out to her. In DV, it does come down to who is going to come out of this alive. Fortunately, I didn’t kill the monster I lived with, although there were a few times when something snapped in me, and I know I could have. That trigger/switch in my mind, happened so quickly and without warning, that I can absolutely understand how/why Jodi snapped. I understand the fight or flight syndrome. I actually still suffer from that today, all these years later. I understand the fog/loss of memory….I drove for miles, not remembering how I got from point A to B and back again. I have compassion for this young girl, who, to me, is very fragile emotionally. I sent an email to JW, and in that email I stated, that if this was pre-meditated, who would leave so much evidence behind. Again, going back to the ‘organization’ of her actions. No way would she have left the camera in the washing machine…no way. Insofar as Demarte, she’s a mere embryo compared to the expert witnesses the defense had. I love ALV, and she was very likeable and explained everything in ‘laymans’ terms, without making it ‘simplistic’ (Demarte’s word). How dare she say that with a courtroom filled with ‘lay people’ who may not understand all the phsyco mumbo jumbo that came from her mouth.

    I laughed so hard, when she was talking about the tiger/bear differences. Huh??? Really??? This girl, is book smart, and has no idea about ‘real life’. I’m hoping the jury sees what we all see, and discounts her credibility and testimony.

    I have watched this case from the beginning..even pvr’ing it when I’m not home, because I didn’t want to miss a moment. I’ve become very passionate about this case, and I hope all survivors, get on board.

    This is for Ms. Demarte….I don’t have a license in DV, but being choked, thrown across rooms, demeaned verbally, emotionally and mentally abused, therefore almost losing my soul, MAKES ME AN EXPERT….so, little one….THERE ARE MANY OF US OUT THERE, AND WE’RE ALL EXPERTS.

    Ok…enough of my ranting….thanks for listening all…I look forward to next week’s testimony. In the meantime, I will as always, keep Jodi in my prayers…

    • Hey, I am new here also, only have posted a few times but I can sympathize with your post, I would never ever go to someone like her or send any of my children to her, she was so brutally cold and uncaring. To be unbiased does not mean you have to be uncaring? She turned me off completely, I found this site and was so happy to be able to share instead of being looked at as if I had two heads for believing Jodi. I never ever went to the police, for eleven years, I put up with the abuse. When it was good it was really good but when it was bad it was really bad and the worst part for me was the horrible things he would call me and say to me, I would even ask him, just hit me, get it over with, that was less hurtful than his words. I had three children, my family was not wealthy but his was so I was scared to leave, he promised he would get my kids from me, that he would make ME look crazy and jealous and in the wrong. He was tall, handsome, charming and never met a stranger, I see so much of him in Travis’s actions and in Travis’s words. I finally got out of my situation when my brother called the police and even then, I almost lied to them about what was going on but something clicked and I handed them the bloody shirt he made me change out of before they came in and finally it was over, well, almost over. We went to court and true to his word he tried his best to make me the bad person, his mom said, why didnt I ever know she was abused? I saw a few bruises but she bumped her legs (his favorite place to hit me because it could be hidden) on her desk at work, one time I did get a black eye but I “was really clumsy and bent down to get something out of the van and hit my head on the side window” well, that was the story I was told to tell. Anyhow, I could go on and on, they all finally found out when they themselves lived with their son and finally after many years believed me. How is Jodi a vixen as those jerks on HLN call her? Four boyfriends in fifteen years that she is still friends with? The sex acts, you pretend you like that to please him, so he will be nice and like you because you dont think you are worthy enough for anyone else after years of him telling you that you are not worthy and dont bring you around his friends or family. Anyhow, this doctor knows nothing of life and has no experience and anything she said should not be considered, not in this case

      • also, I lived in St George Utah and was not a mormon, some would not let my children play with theirs because they were not mormon, I was looked down upon because I drank coffee and wore a bikini. You know a mormon from the temp of their caffiene I guess because I saw plenty drinking cokes and pepsi’s, you were made to feel bad and not good unless you were mormon and that is another thing Travis did, he had another thing to put her down for until she became that and then messed her head up by having sex, which is not allowed. One year in St George the 4th of July landed on a sunday and New Years eve on a Sunday so everyone there was yelling Happy New Year and celebrating the 4th of July on the 3rd of July and the 30th of January, a whole dam town, that is how powerful they are, how they control your mind and your federal holiday even! Ohh, Chilis bar and grill? They made them take down the bar part and it became Chilis Grill, one liquor store in town that was closed on Sundays and by seven every night, oh the list goes on so Jodi had many things against from the very beginning by being with Travis

  256. Does anyone know what is going on with the trial being televised today (Friday)?. My understanding yesterday was that there is no hearing Friday or Monday. I just got home and turned on HLN and they are showing Jodi’s trial. Was it my misunderstanding or did HLN screw up again??

  257. I’m new & normally don’t get involved these things. But I’m so appalled at the way the prosecutor has been conducting himself. And apparently it’s ok for him to yell, scream, and degrade the professional witnesses of the defence. At least they didn’t yell back.

    But when Jennifer professionally questions one of his witnesses, the witness is the one who does the screaming.

    It seems to me that Judge Sherry should have warned Mr Martinez that if he continued this behavior, he would be through handling this case. At least Anthony’s prosecutors to witnesses like human beings (though Ashton would get spirited.)
