In the #JodiArias courtroom waiting for the hearing to begin on pornography. Former Arias attorney Maria Schaffer is here.

  8. William Pitts

Back in #JodiaArias trial. Today’s evidentiary hearing is on allegations that the defense and Mesa Police destroyed evidence of porn on Travis Alexander’s laptop. Follow me on Twitter for live updates @william_pitts

The defense destroyed? What is he talking about? Give that man some coffee.

  9. Michael Kiefer @michaelbkiefer · 7m 7 minutes ago

#JodiArias former attorney, Maria Schaffer, on the stand being questioned by Jennifer Willmott.

  10. Michael Kiefer @michaelbkiefer · 5m 5 minutes ago

Schaffer says there was “voluminous evidence” seized by Mesa PD in #JodiArias case. She and co-counsel Greg Parzych went to view 06- 2009.

  11. Michael Kiefer @michaelbkiefer · 5m 5 minutes ago

After evidence was brought to room by Det. Flores, Schaffer and Parzych were escorted in. First journals and other writings.

  12. Michael Kiefer @michaelbkiefer · 4m 4 minutes ago

Schaffer says there were cellphones that were plugged in and fired up by Flores. Martinez was there. Then they looked at computers.

  13. Michael Kiefer @michaelbkiefer · 3m 3 minutes ago

Flores had to find cords for the computers, then he plugged them in and turned them on. Martinez “perused files” in Alexander’s computer 1st

  14. Michael Kiefer @michaelbkiefer · 2m 2 minutes ago

There was nothing else plugged in, i.e. no “write blocker” to prevent changes in files. There were many selfies. Martinez looking for porn

  15. Michael Kiefer @michaelbkiefer · 2m 2 minutes ago

Schaffer says they did not stay until 5 p.m. Their investigator left early. #JodiArias

  16. Michael Kiefer @michaelbkiefer · 20s 20 seconds ago

The computers were still on when Schaffer and Parzych left the room where they examined computers. Now Martinez does cross.

  17. Michael Kiefer @michaelbkiefer · 8s 8 seconds ago

Martinez says the meeting was set for her convenience. She answers, “And for you.” He calls up a list of items requested for meeting.

  18. Michael Kiefer @michaelbkiefer · 45s 46 seconds ago

Schaffer says, “At that time, you wanted to see the images as well, sir.” She tells him that he told her that he had never seen the evidence

  19. Michael Kiefer @michaelbkiefer · 1m 1 minute ago

Martinez saying that Schaffer insisted on turning on the computer though not a good idea, that they laughed. She denies.

    • Even though Martinez is lying here, he still implicates himself in his own lie: He acknowledges that he knew it was not a good idea to turn on the computer, ( and since he knew THAT, he knew all of the legal implications, and he knew it would affect evidence.)
Even though he lied, and said he laughed, even so, saying that he laughed shows he knew something was wrong, and he condoned it anyway, and he never reported he didn’t follow proper protocol, etc.)

I’ m inferring and extrapolating from a tweet, but still__ his own effort to protect himself by lying about the situation, makes him culpable anyway.

  20. Michael Kiefer @michaelbkiefer · 1m 1 minute ago

Martinez says Schaffer commented on the number of photos. “You made that comment,” Schaffer answers.

  21. Michael Kiefer @michaelbkiefer · 19s 20 seconds ago

Schaffer says it was Martinez’ idea to fire up cell phones and computers. Schaffer was just taking inventory at that point, not examining.

  22. Michael Kiefer @michaelbkiefer · 6s 6 seconds ago

Schaffe said that she need to estimate what kind of experts she would need and ho much it would cost. Martinez unable to trip her up.

  23. Michael Kiefer @michaelbkiefer · 46s 47 seconds ago

Schaffer says that she has to view evidence before asking boss for funds. Martinez says you have to fire up the computers to know.

  24. Michael Kiefer @michaelbkiefer · 34s 34 seconds ago

Frankly, Mr. Martinez, I did not know if you and Mr. Flores were going to let us turn on the computers that day.” Schaffer

  25. Michael Kiefer @michaelbkiefer · 16s 16 seconds ago

Martinez says she turned on the computer. “You authorized Det. Flores to turn on the computers, Mr. Martinez.”

  26. Michael Kiefer @michaelbkiefer · 44s 44 seconds ago

Schaffer: “If Mr. Martinez had told us that turning on the computers would destroy evidence, we would not have allowed that.”

  27. Michael Kiefer @michaelbkiefer · 20s 21 seconds ago

Schaffer: “Both the prosecution and the defense have a duty to preserve evidence…” regardless of who it may be harmful to.

  28. Michael Kiefer @michaelbkiefer · 15s 15 seconds ago

Schaffer did not know that turning it on would delete evidence. The only person who touched it and went through files was Martinez.

  29. Michael Kiefer @michaelbkiefer · 30s 31 seconds ago

On June 10, 10:20 p.m., the computer was turned on and “quite a few files were gone through and modified.”

      • SJ – According to Flores’ report, a search warrant was executed at TA’s home on June 10,2008 but the time was 9:53 am, which was a full half hour after the time it was turned on/powered up. No one should have touched anything before that time.

        • What I am trying to say is, no one had any right to touch that computer or laptop until after the search warrant was issued, however it was powered up a half hour before the search warrant. It may well have been one of his roommates that did it and not the police, since it would have still been inside the house at that time.

        • Hi Debbie,
Yes… the phrase “comedy of errors” springs to mind in relation to Mesa PD and their antics.

    • I wonder who would have been looking at Southwest Airline flights out of Mesa, perhaps to Cancun??? This was AFTER TA was deceased also, so it was someone else looking perhaps for a flight to Cancun to the PPL conference after they brought TA’s body back and went through TA’s computer to check for items to copy or delete??? Also, MPG said TA’s body was taken to another location for five days to perform Blood Atonement on TA and then his body was brought back to his house and placed in the shower with the symbolic cup & sacred underwear placed in washer for blood atonement ritual! The time frame of when the computer was accessed would correlate to when TA’s body was brought back to his house, which would be June 10th!!!

Who rummaged through the files? Was it the person checking out the computer or was it the computer itself? @michaelbkiefer #JodiArias

        • I’m not sure they ever had it in their possession. They talked about going through his email with the help of a webmaster but they could do that from any computer by going to the email website and never touching T’s computer. But maybe I’m missing further information.

            • Alter the computer? Or the mail? The mail stored on his email server space, they could mess with.

In order to mess with his computer – or any mail stored on his computer – the computer (where ever it is) would have to be turned on and connected to the internet and then it could be changed or manipulated by someone who knows what they’re doing. (I’ve had tech support on the phone who asked to access my computer – it’s creepy to watch!)

              • I know I had to do the same with my computer and it is strange to see tech support do things with your computer and your not even touching it. If they knew when the computer was going to be checked out then they maybe could have done something to it from somewhere else. It would have been a short time frame but if they were expecting it not so hard. I would still think there would be a trail of that too.

                • And it would have had to have a internet connection, R. Love. I wouldn’t think a police department would have ‘free wi-fi’, so someone with access to the computer in evidence would have had to establish a net connection — I think that’s too much of a stretch. If you’ve got someone inside to establish a net connection you’ve got someone inside to do the dirty work.

                • Maybe. . .but there were some pretty shady things happening around the police department and the prosecutor’s office. . .”so will we ever know”?. . My new favorite saying. LOL

                • Response to R.Love comment 11/21/14 7:08 pm: I had technical support control my computer on several occasions, once recently, & it is strange to see how it operates.
…For information on what I am talking about please Google: teamviewer and click on link or ,,, and it explains how to download (free) the program or I guess you can buy the software in a store, or the person doing the controlling (the controller) sends you that link.
…You send your IP# to (the controller) & he/she sends a drop down box which has your IP# in it & the program issues you a password#, in that box.
…You tell the controller by phone or text (that password) & he/she does something with it on the controller end.
                  …Then the controller he/she, tells you don’t touch anything ! !
…And the controller can do anything to your computer & move anything around & you see it on your screen. …You can also move things around but the controller will say Don’t touch anything! …
…The controlling computer can be (anybody, any computer) you give access to.
…And, to get out of it I guess you just exit the program or turn your computer off & on again.
…The only thing I know is to send the IP# & the password & take my hands off the keyboard & off the mouse. ….The operation is weird ! !
………It is possible that Travis could have turned over control of his computer to someone (a remote controller) as a routine operation when he wanted to go to sleep or do other things, IMHO. …Someone whom he would trust. …
…But surely, all these thing would be found out by the defense forensic computer expert Neumeister. …Maybe strange thing will be found out next time he is on stand??? ..In my opinion. …Hope I did not do any typos!

            • It will be interesting to see whether JM calls the POS PIO as a witness today – make him get up there and do what he did about the order-of-injuries “mix-up” — he’ll say he “misunderstood” the instruction that he shouldn’t turn on the computer, he thought the rules said he COULD, and he’s not a doctor – er computer forensics specialist – so he wouldn’t know about these things.

          • Journee,
If Flores takes the blame, I’m sure his price for doing so will be at least 2 million. Or, he’s going to turn on Martinez and blow the case wide open. But, would Flores ever take it on himself to take any action (like tampering with evidence) on his own that might destroy JM’s case? Martinez would have him “suicided” (sic on purpose)

            • Now that you mention it, there was a tiny hint of Flores rebellion when Nurmi finally got him on cross a few weeks ago, wasn’t there? Very difficult to say for sure, going just by tweets, but it really sounded like he was standing a little more firmly on his original position (gunshot first), not doing the meek, fall on his sword “I made a mistake” thing. I don’t remember what was said, but I remember posting that he’d all but lost his job already anyway and maybe he’d decided not to cow-tow to JM anymore.

  85. JW needs to ask whether ALL of that porn and related stuff had actually been deleted and had to be restored by BN, or whether some of it was ‘in plain sight’ and state witnesses just lied about it…

or, I dunno, is that a good question to ask since the motion is about the state deleting the evidence?

    • This is the only real opportunity they’ve had from the very beginning to get anywhere, I’m praying they exploit it in every way they can! Free Jodi!

      • johm,
        I’m with you.
This is all of what juan and many others did not want to be told.
They thought that they could just whisk her own off to prison.
Hopefully they will be taking Jodi’s cell. All of them together.

@jeffgoldesq but did Martinez cover up porn use in last trial. That is the issue.

WOW these people are smart, aren’t they!!!

  87. I am so livid, fuming, I can’t even describe how angry I am. We are looking at disbarment, criminal charges, and immediate halt to current retrial bc of this evidence now coming to light IMHO. I firmly believe that this prosecution team is in this up to their eyeballs – they were in full control and possession of this computer the entire time. Who accessed on June 10, 2008? It could only have been prosecutor’s office. No one else! I also believe that the first defense team atty was purposely set up on June 19, 2008 with the JM and Flores knowing full well that when that computer was turned on more evidence of the porn would be destroyed IMHO. They were hoping that all this would be destroyed or hidden so as to never be discovered and if it ever came to light they would be able to point the finger at the first defense atty. The first defense atty did nothing – it was all the prosecution team IMHO. And again as I have said before if not for this need for vengence and this retrial to try to kill Jodi NONE OF THIS WOULD HAVE EVER SEEN THE LIGHT OF DAY. It is through the prosecutions’ own arrogance that this has come to light thankfully for Jodi. What should happen now? This retrial should be halted immediately!!! The criminal conviction should be set aside and Jodi should either be given an immediate retrial on the criminal charges or she should be released and the case dismissed with prejudice as a remedy for the complete injustice thrust upon Jodi Arias who was denied her constitutional rights to a fair trial. IS ANYBODY WITH ME ON THIS????

    • JM will blame Mesa PD, and that might work to get *him* out of trouble, but it’s still going to weaken the status of Jodi’s conviction – as well as the convictions of everyone else whose cases hinged on computer forensics at Mesa PD.

  111. Just now when BN called JM Juan I remembered – this is another sticky problem for JM, because TWICE during the first trial BN testified in evidentiary hearings and BOTH times JM agreed to stipulate to the evidence BN provided because BN does so much work for the state – he couldn’t afford to discredit a witness he uses so often.

The public information officer just got called back to chambers. Are we gong to get kicked out again?

  124. Hello, I’m new here but have been following this site and the updates quite closely. It was hard to keep quiet after reading all of this about this legendary witness. He’s possibly the best one we’ve ever had on this case. He made Juan so angry that he just charged out of there like a whiny baby? Hahaha. Oh lord. This is gold.

      • Thank you. Juan can be very entertaining… but the judge just annoys the crap out of me. Is she asleep? If I were her, I would end this fiasco right here and now. This has dragged on for too long. It is a complete joke.

  125. Michael Kiefer @michaelbkiefer · 44s 44 seconds ago

Here comes the clone identified as “Tony.” They grabbed the wrong image and sent to Martinez. They then sent a correct one. Tony is a tech

  126. Michael Kiefer @michaelbkiefer · 35s 36 seconds ago

The hearing is going to end here. Martinez is demanding copies of other clones. It will reconvene Dec. 4.

  127. Michael Kiefer @michaelbkiefer · 20s 21 seconds ago

Neumeister asks if after having the computer for six years, he wants a copy of everything Neumeister has. N says he already has it.

  128. Michael Kiefer @michaelbkiefer · 27s 27 seconds ago

Judge asks if they can just get it. Martinez says it is at Mesa PD. Neumeister asks to see broken computer. Martinez says no.

    • IMO, what JM really wants is for his guys to get their hands on the exact ‘clone’ that BN worked with so they can destroy/lose/discredit it.

      • If they are smart they better make sure that they have a copy of the clone so if that happens there is still a copy available to examine

  129. Michael Kiefer @michaelbkiefer · 13s 14 seconds ago

Wrong copy was initially sent marked “Tony” and from a Dell Computer. Martinez noted Alexander had a Compaq. Tony, a tech works on a Dell.

  132. In my opinion, JM is desperately trying to deflect from the fact that there was a ton of porn on TA’s computer that had been accessed and searched for by the user (TA) according to what Neumeister testified to. The prosecution has had the computer for 5-6 years before defense were even allowed to examine. The defense is not even done with their examination of this computer but JM is desperate to stop this bc he knows that this is damaging his case beyond repair IMHO. Accusing this expert of damaging the computer is simply not credible. It was always in the hands and control of the prosecution. KN and JW need to stay strong and focused and not allow JM to deflect but stay on course to demonstrate and prove that this evidence of porn was purposefully hidden and destroyed to the fatal detriment of the defense. So much so that there is only one remedy – to set aside the criminal verdict and either dismiss with prejudice or grant a new trial. Neumeister said it himself on the stand that Juan was trying to skirt around the fact that there was porn on the computer.

    • They will proceed, I think. From what Jen posted early in the day, it looks like Monday will be the only trial date next week. Wed and Thurs were already black for the holiday, and Nurmi goes before the appeals court on Tuesday on the sealed courtroom issue.

    • The retrial should stop but knowing the history of JSS she will plod ahead anyway. It is going to take a higher court ruling to stop the retrial. How can they proceed with a retrial on whether to put Jodi to death or not when it is crystal clear that she never received a fair trial and her constitutional rights were flagrantly violated??? The criminal verdict needs to be set aside. I would think KN and JW are arguing for a hold on the retrial but JSS cant see missing her golf games…….so we must keep on schedule ………yeah right

      • BB,
I agree. It seems like a waste of time and money to continue when there is such a cloud of suspicion hanging over this trial now. Does Martinez have any credibility left? I don’t know if JSS has a boss that could step in and advise her to call a stop. Maybe, it will come to a screeching halt next week after they have the weekend to mull it over.
It sure is nice to “hear” all the haters whining and crying though. It does a body good.

    • A no-brainer to me, but we are dealing with the clueless masses still buying into the TA “image”. There’s absolutely no telling what really existed on the phones, cameras, computers far beyond what we are learning now.

      • It would support Jodi’s case if there was, but for the motion it doesn’t matter – what matters for the motion is not that there was porn, or how much of it there was, or what kind of porn it was, it is whether or not the prosecution knew about it and concealed it from the defense.

  133. BTW anyone remember the famous comment TA made about a 12 year old on the sex tape? This is the same kind of mentality that a statement like “teen porn is not child porn” unfortunately may produce….No child porn is okay, period, no matter how old the child.

    • According to a few episodes of L&O SVU (love ’em or hate ’em, they do like to tackle issues that police and courts are currently struggling with –

There are people who are LEGALLY producing “teen porn” – by using young looking models and/or age regression software. As long as the models are of legal age, there’s no law broken.

  134. What a day! It’s the most fun I’ve had…almost ever. And, none of it had such prolonged pleasure. I wonder if the Neumeister (does that translate to the “new master?”) was showing the lack of regard people that work around Juan Martinez have for him. He didn’t hold back any punches. Juan is a paper tiger. He can dish it but he can’t take it. This is going to be such big news, I can’t imagine someone won’t say to a juror: “Did you hear what happened to Juan.” As someone said on Twitter, Juan is going to be a joy to live with the next few days.

    • I think Flores and Horn should be locked in the house with him for the weekend to endure each other after JM’s fabulous day!

    • I was away and had to catch up with everything ^^^^, and you know what? I ahd the biggest smile on my face the entire time 😀 😀

What a day, indeed….. Neumeister ROCKED!!!!! He called out the frog for what he is, no fear, no holding back, no beating about the bush! He did a great job, deep down I wish the jurors were i that courtroom today so they could see with their own eyes what a slimy corrupted person Martinez is. As I’ve said before, he’s a disgrace to the Judicial System. Poor Lady Justice!

Computer expert Neumeister says that 70,000 files were scrubbed, zeroed out by a program that is not on Alexander’s computer. #JodiArias

Wonder how that happened and who did it. I watched a TV show about an Australian prosecutor and a child porn case. They were talking about being able to detect when a computer had been scrubbed.

    • It looks like the prosecution computer investigation was either bungled or something more sinister was at play. Either way, bad day for Mr. Martinez. I wonder if he wishes he could turn back the clock to the time before going for the death penalty. He is digging in deeper and deeper.

  136. Thank you my darlings you are fighters. So I will be dancing tonight. What a weasel Juan is. Really a liar thank God somebody checked him. Go on I know karma is a bitch but a bitch will come and bite you in the ass.

  137. I hope he gets what is coming for him [Juan] no one should be that disrespectful. Only Juan, what a little man complex. I pray for her I know she loved TA but Jodi it is time to live. He was a abuser. NOT GUILTY EVER.

  138. Dancing at home with hubby for my girl you go girl. Never have I seen a miscarriage of justices. Wow if nothing is done it will be a disgrace to America.. The world is watching.

  139. I am really hoping that all this stuff holds up in trial and that Martinez gets his due. It will be interesting to know if his new sidekick at his table in court remains with him now or if Flores comes back.

    • Where is Flores?
Maybe he couldn’t be in court because he’s going to be called to testify.
He has to be at some time. In fact why won’t they have a serious investigation?
It’s not right that Jodi had to sit there and be called a liar by everyone when they KNEW who the real liars were.

      • I am not sure where Flores was today Aly. It was reported that Martinez’s boss was sitting at the table with him, most likely because of the allegations brought forth by the defense.
